In James v. State , 731 So.2d 1135 (1999), the Supreme Court of Mississippi held that Miss. Code § 97-37-5 , which prohibits convicted felons from possessing firearms, did not violate Article 3, § 12 . The Court, looking at an issue of first impression, reviewed legal authority from other jurisdictions concerning their exercise of police powers in limiting state constitutional provisions that guarantee a right to "bear arms." Following this review, the Court found that the right to "keep and bear arms" in Mississippi is not absolute, but subject to the reasonable exercise of the police power. James

CranioSacral Therapy Outlawed in Mississippi?

Razo, managing editor Mississippi law governing massage therapy prohibits therapists from engaging in the "manipulation or adjustment of osseous tissue," and it appears that the Mississippi State Board of Massage Therapy (MSBMT) has lumped CranioSacral Therapy (CST) into this definition as a prohibited massage therapy practice. Massage Today first learned of the situation from Mississippi therapist Brenda Eiland, NCTMB, RMT. Ms. Eiland, who studied Visionary CranioSacral work at the Milne Institute in Big Sur, Calif., was alarmed when she discovered that the Milne Institute application to become a Mississippi CEU provider was denied. A letter signed by MSBMT Executive Director Beverly Limbaugh to the institute stated that its program "does not meet the requirements for approval." Eiland subsequently contacted the MSBMT to find out if practicing CST in Mississippi was illegal.

Medical malpractice claims in Mississippi are generally governed by the common law and by statutes applicable to other torts. Except as noted below, there is little legislation specific to medical malpractice. Statutes of Limitations A medical malpractice action must be brought within two years after the alleged act, omission, or neglect is discovered or with reasonable diligence might have been discovered. Miss. Code Ann. § 15-1-36 (Supp. 2002). In the case of death caused by medical malpractice, it is the heir's date of discovery that controls, and this can be no earlier than the date of death. Gentry v. Wallace , 606 So. 2d 1117 (Miss. 1992). A claim accruing on or after July 1, 1998, must also be brought within seven years after the alleged act, omission, or neglect occurred. This statute of repose is tolled until discovery for claims arising out of foreign objects left in the body and claims that have been fraudulently concealed. § 15-1-36. Special provisions extend the time for an action on behalf of a minor or mentally disabled person, based on the injured person's status on the date the cause of action is discovered or with reasonable diligence might have been discovered. For a minor six years of age or less, an action may be brought within two years of the minor's death or sixth birthday, whichever is earlier. For a minor with no parent or guardian, an action may be brought within two years of the minor's death, the appointment of a guardian, or the age of majority, whichever is earlier (except that the appointment of a guardian will not be deemed to occur until the minor's sixth birthday). For a mentally disabled person, an action may be brought within two years of death or removal of the disability, whichever is earlier.

Chief Justice Prather began practicing law with her father in West Point, Mississippi and following the death of her father, she practiced law with husband, Robert Brooks Prather. For her first judicial experience, she served as a municipal judge for six years and subsequently as chancery judge for eleven years where the majority of her work was in family law and equity. With that judicial experience, she was appointed to the Supreme Court where she has served eighteen years, ultimately becoming Chief Justice. Although dealing with all areas of the law, she is fortunate to have had some input into development of the law of equitable distribution of marital assets and Sixteenth Section Land management law. Chief Justice Prather and her husband are parents of three adult daughters and have two grandchildren. She is an Episcopalian and former member of the Vestry.

by Douglas O. Linder It was an old-fashioned lynching, carried out with the help of county officials, that came to symbolize hardcore resistance to integration. Dead were three civil rights workers, Michael Schwerner, Andrew Goodman, and James Chaney. All three shot in the dark of night on a lonely road in Neshoba County, Mississippi. Many people predicted such a tragedy when the Mississippi Summer Project, an effort that would bring hundreds of college-age volunteers to "the most totalitarian state in the country" was announced in April, 1964. The FBI's all-out search for the conspirators who killed the three young men, depicted in the movie " Mississippi Burning ," was successful, leading three years later to a trial in the courtroom of one of America's most determined segregationist judges. Sam Bowers , the Imperial Wizard of the White Knights of the Klu Klux Klan of Mississippi, sent word in May, 1964 to the Klansmen of Lauderdale and Neshoba counties that it was time to "activate Plan 4." Plan 4 provided for "the elimination" of the despised civil rights activist Michael Schwerner , who the Klan called "Goatee" or "Jew-Boy." Schwerner, the first white civil rights worker based outside of the capitol of Jackson, had earned the enmity of the Klan by organizing a black boycott of a white-owned business and aggressively trying to register blacks in and around Meridian to vote.
