Criminal Identity Theft and Assumption Deterrence Act
In October 1998, Congress passed the Identity Theft and Assumption Deterrence Act of 1998 (Identity Theft Act) to address the problem of identity theft. Specifically, the Act amended 18 U.S.C. § 1028 to make it a federal crime when anyone: knowingly transfers or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law. Violations of the Act are investigated by federal investigative agencies such as the U.S. Secret Service, the FBI, and the U.S. Postal Inspection Service and prosecuted by the Department of Justice.

New Jersey Statutes 2C:51-1: Basis of disqualification or disability
Any legal disqualification or disability because of someone’s conviction of an offense or sentence on such conviction must be:
  • Necessarily incident to execution of the sentence of the court;
  • Provided by the Constitution or the Criminal Code;
  • Provided by a statute other than the Criminal Code, when the offense is defined by that statute; or
  • Provided by the judgment, order or regulation of a court, agency or official exercising a jurisdiction conferred by law, or by the statute defining such jurisdiction, when the offense, conviction, or sentence is reasonably related to the individual’s competence to exercise the right or privilege of which he is deprived.

Proof of a conviction as relevant evidence:
  • Upon the trial or determination of any issue; or
  • For the purpose of impeaching the convicted person as a witness is not a disqualification or disability for the purpose of this law.
