    NCSL Staff Contact Overview Since the enactment of charter school legislation in Minnesota in 1991, the number of states with laws allowing for charters has swelled to 36 plus the District of Columbia. Most recently Oregon and Oklahoma passed legislation in 1999. And while only 350,000 students attend approximately 1,700 charter schools nationwide (compare this with 52.2 million school-age children and about 108,000 schools), this reform is indeed popular. This rapid growth is likely to continue, especially with the bipartisan support charter schools have seen in state legislatures across the country. Defining charter schools is difficult given both the variety of the charter school statutes and the types of schools that have been created. Simply, charter schools are public schools that are freed from, in most cases, local and state regulations. In return for this freedom, charter schools are held accountable for student performance - if the goals of the school set forth in the charter are not reached, the school's charter is not renewed.

    Overview Since the enactment of charter school legislation in Minnesota in 1991, the number of states with laws allowing for charters has swelled to 29 plus the District of Columbia. In addition, legislatures in Utah, Idaho and Virginia have passed laws in the past two weeks that, if signed into law, will make the total 32. And while only 170,000 students attend approximately 800 charter schools nationwide (compare this with 52.2 million school-age children and about 108,000 schools), this reform is indeed popular. Given that President Clinton has set a goal of 40 states with laws and 3,000 charter schools by 2000, this quick growth is likely to continue, especially with the bipartisan support charter schools have seen in state legislatures across the country. Part 1. Definition of Charter School.
A charter school is a public school established under Minnesota Statutes section 124D.10 as either a cooperative or a non-profit corporation. Charter schools and their sponsors are subject to the requirements in Minnesota Statutes section 124D.10. Part 2. Sponsorship Responsibilities.
To support, improve, and enhance elementary and secondary education in Minnesota, a MnSCU college or university may serve as a charter school sponsor consistent with its mission, MnSCU policy and procedure, and Minnesota Statutes section 124D.10. Sponsoring institutions shall comply with all statutory sponsorship requirements and shall adhere to sponsorship standards established by the Minnesota Department of Children, Families, and Learning (MDCFL). n rural Henderson, Minnesota (pop. 910), miles separate neighbors, winters arrive early and stay late, and residents prize community and individualism alike. It should come as no surprise that a public charter school here would aim to raise self-reliant learners. In its eighth year, the Minnesota New Country School (MNCS) does just that, mixing the intimacy of a one-room schoolhouse with 21st century technology. Students of all abilities and interests find their place here, with teacher-advisors, each responsible for a group of fifteen to eighteen students, serving as generalists first and specialists second. The school combines freedom with responsibility, structure with flexibility, and book learning with practical experiences like working at the corner drugstore. In helping students negotiate these dualities and gain the skills they need, MNCS overturns many conventions of teaching and learning. MNCS at a Glance School runs throughout the year, in five- to seven-week blocks. Following each block, staff have a planning week in which they document student achievement, work with individual students, write grants, and address the business concerns of owning and operating a school.

I n Minnesota, a group of teachers and education professionals has turned to a cooperative in an attempt to improve accountability for student performance and overall school success. Its members are seeking alternatives to the existing framework of traditional educational governance and structure through a teachers' cooperative. They have taken control of their instructional programs and professional futures.
In 1994, a group of educators at the Minnesota New Country School (MNCS) in the Minnesota River Valley, took these goals to heart by forming EdVisions Teacher Cooperative. MNCS was originally located in three storefront buildings in the sponsoring district of LeSueur-Henderson, about 60 miles southwest of Minneapolis. The school opened its doors with 65 students, and has since increased its enrollment to 130 students in grades 7-12. The increased enrollment forced MNCS officials to relocate from LeSueur to a new, $1.2 million facility in Henderson. The new building was the result of a partnership between USDA Rural Development and local investors.
It is no coincidence that MNCS is an innovative public charter school enjoying substantial success in terms of state-measured student achievement. The MNCS teachers were confident their approaches to teaching would make a difference, and they were eager to have more control over the educational process.

AEL's Region Minnesota passed the first charter school legislation in 1991. Seven years later, about three-fifths of the states had followed suit. In 1999, President Clinton announced federal aid to 32 states that had applied for charter school funds. Existing programs were granted a total of $54 million dollars, and $41 million dollars was earmarked for start up grants for the express purpose of increasing the number of charter schools from the more than 1,700 that currently exist to 3,000 by the year 2001. Policymakers in AEL's region (Kentucky, Tennessee, Virginia, and West Virginia) have approached legislation more cautiously. This issue of Policy Briefs provides an overview of charter school legislation, looks at concerns specific to AEL's region, and reports on the status of charter school legislation in four states. States wishing to enact effective charter school programs should grant charter schools complete legal independence from local school boards and contracts establishing clear performance standards. These were the findings of a report, Charter School Innovations: Keys to Effective Charter Reform, issued today by the Reason Public Policy Institute. "The success or failure of charter reform is highly dependent on the technical features of a particular charter statute," says study author, Theodor Rebarber, vice president of a company focusing on charter schools. "In five years, 26 charter statutes have been established, nationwide, due in part to renewed interest by the general public and consensus among both political parties about building a more dynamic educational system." RPPI¹s new study identifies several key components that are necessary for a state to consider when establishing a charter. The primary recommendations are: allow charter schools to be completely independent legal entities free from district governance; provide blanket waivers from regulations except in the areas of performance-based goals, health, safety and civil rights or certification requirements; create independent charter-approving entities and insulate them from political influence; establish direct state funding for schools, include operating and capital revenues; ensure access to long-term financing structures for facilities and other up-front costs; and avoid overall caps on the number of charter schools in a given jurisdiction.

Introduction: The charter school movement is one of the fastest growing education reforms of the Nineties. In 1992, only two states, California and Minnesota, had passed charter school legislation. Charter Schools
Charter schools are nonsectarian public schools of choice that operate with freedom from many of the regulations that apply to traditional public schools. The "charter" establishing each such school is a performance contract detailing the school's mission, program, goals, students served, methods of assessment, and ways to measure success. The length of time for which charters are granted varies, but most are granted for 3-5 years. A charter school is accountable to its sponsor—usually a state or local school board, or in some cases municipal government or a college or university—to produce positive academic results and adhere to the charter contract. At the end of the contract term, the sponsor may renew the school's contract.
Generally, states apply fewer regulations to charter schools and demand a higher level of accountability for results. If charter schools fail to produce the results outlined in their contract with the state or other authorizer, the school can be closed. Moreover, as schools of choice (i.e., parents voluntarily enroll their children there), charter schools are held accountable to the public because if they cannot attract students, the schools cannot survive.

By the end of Citizen 2000's first year, the K-12 school had dropped its high school grades, due in part to financial problems. But Vanessa and Victoria were happy and making good grades. Then, rumors about the school's shaky finances grew louder, and some parents withdrew their children, but Diaz stuck it out. The school's director declared bankruptcy, and the school closed its doors, sending Diaz and the parents of roughly 200 children scurrying to find new schools...
