With its passage of the New York Charter Schools Act of 1998, New York last December became the 34 th state to authorize or implement charter schools.
As a result, roughly two-thirds of the school districts nationwide now are subject to an educational reform that has yet to prove its worth but has raised the most serious practical and philosophical challenges to the viability of public education in our country's history. In New York, a charter school can be established through an application submitted by teachers, parents, school administrators, community residents or any combination thereof. Though charter schools are subject to the same health and safety, civil rights and student assessment requirements of other public schools, they are exempt from all other state regulations.
The Case for Charters The case for charter schools is quite simplethe arguments typically revolve around the alleged failure of the public schools. Though many have contested the validity of these charges (educational researchers Gerald Bracey and David Berliner prime among them), the news media, the political establishment and a large segment of the public have become convinced that our schools are failing to serve the children with whom they've been entrusted.

Charter Schools: Early Learnings
In This Issue
The purpose of this Insights is to examine the concerns and difficulties charter shcools are encountering in the early stages of planning and implementation. The empirical research that is beginning to emerge from charter sites in California, Colorado, and Minnesota provides some valuable lessons for policymakers, parents, and educators. The problems are highlighted not in an attempt to derail support for existing charter school policies, but rather to better inform those in the position of shaping and drafting future policies. Comparison Of Charter School Legislation In response to the public's growing frustration with the pace and scope of school improvement, legislators, educators, and parents are increasingly turning to charter schools as the reform of choice. Viewed as a compromise between "throwing" additional dollars at the current system and moving dollars (and students) into the private sector with vouchers, charter schools are popular because they promise relatively cost-free innovation within the boundaries of the public system. Over the last few years, the charter school movement has gained significant momentum in the U.S. In 1991, only one state, Minnesota, had passed charter school legislation. By 1994, a total of eleven states had enacted charter school laws. This year, at least 23 states, including Arkansas, Louisiana, and Texas, considered charter school bills and several enacted legislation.1 To date, more than 200 charters have been granted to schools in at least nine states (Walsh, 1995).

Under each of the nation's 35 charter laws, school districts and other sponsors have the responsibility to both authorize and oversee these less-regulated, more-autonomous public schools. Growth despite continued reservations Increasing attention to oversight whether they should exist to what kind of oversight they should be given once approved. What needs to be done Legislative fixes School districts will and should continue to be the dominant source of sponsorship for charters. But, to ensure prompt and fair consideration of proposals, pending legislation should be approved that continues to increase the number and diversity of sponsors, ease appeals to the State Board, provide explicit funding for the cost of oversight and set deadlines for local board consideration and action. Oversight and renewal process All district and other sponsors should be encouraged to build on what's being done in St. Paul and Northfield, as well as other states like Colorado, Massachusetts and the District of Columbia. Explicit accountability procedures should be in place at the time charters are granted and be used to provide a basis for both ongoing oversight and eventual charter renewal. Early experience elsewhere suggests that a combination of internal and external assessments and site visits may work best.

  • HURDLE THIS: The Department of Children, Families and Learning (CFL) in Minnesota have decided to severely curtail the usefulness of the Federal Charter School Program Grant for that state’s charter schools. Despite guidance from the U.S. Department of Education to the contrary, the CFL has told charters that grant money can’t be used for most of the unavoidable start-up expenses that go with navigating the bureaucratic maze a school is asked to complete before it begins to serve students. The CFL’s unnecessarily restrictive guidelines make it seem like the department isn’t really focused on helping charter schools get off to healthy starts. From the June 2002 Monthly Letter
    800-POUND GORILLA: While crisscrossing the country on charter visits, U.S. Secretary of Education Rod Paige showed his commitment to educational alternatives and excellent schools ... including in St. Paul (MN), where he addressed parents and local leaders at the Academia Cesar Chavez charter school. This last visit was none-too-soon, as opponents there are pressing to reverse the charter trend that started in the land of 10,000 Lakes. The unions have proclaimed a dismantling of charter school as part of their legislative agenda (see below, for more), and the Minneapolis Star-Tribune newspaper has gotten into the act with a series of misleading and error-laden reports on charter schools.

FAQ Definition Charter schools are nonsectarian public schools of choice that operate with freedom from many of the regulations that apply to traditional public schools. The "charter" establishing each such school is a performance contract detailing the school's mission, program, goals, students served, methods of assessment, and ways to measure success. The length of time for which charters are granted varies, but most are granted for 3-5 years. At the end of the term, the entity granting the charter may renew the school's contract. Charter schools are accountable to their sponsor usually a state or local school board to produce positive academic results and adhere to the charter contract. The basic concept of charter schools is that they exercise increased autonomy in return for this accountability. They are accountable for both academic results and fiscal practices to several groups: the sponsor that grants them, the parents who choose them, and the public that funds them.

The Schoolcraft Learning Community opened its doors in 2000 and is Bemidji's first charter school. Schoolcraft specializes in small, multi-age classrooms, with a focus on hands-on learning experiences. The school's founders say they've gotten little support from the Bemidji School District. (MPR Photo/Tom Robertson) There are 88 charter schools in Minnesota. About two-thirds of those are in the Twin Cities. But a growing number of charter schools are popping up in greater Minnesota. Supporters say starting charter schools in rural Minnesota is tough. They face resistance from school districts afraid of losing students.

Meadowlands: Charter School a Survivor

Four years ago, we reported on the opening of one of Minnesota's first charter schools in the tiny, remote town of Meadowlands. People in Meadowlands worked like mad to create a charter school because the district was planning to close their little school. They had to figure out everything from how to schedule buses to how to get grants and donations - because charter schools have to survive on less money than other schools. Four years later, there are 26 charter schools in Minnesota, and the little school in Meadowlands still survives. There's not much to the town of Meadowlands. It's way out in the woods northwest of Duluth. It has 135 people, a gas station, a scattering of houses, and a school.
