Student Researchers: Jen Scanlan, Grayson Kent The U.S. military is waging a war on planet Earth. "Homeland security" has become the new mantra since September 11, 2001, and has been the justification for increasing U.S. military expansion around the world. Part of this campaign has been the varied and persistent appeals by the Pentagon to Congress for exemptions from a range of environmental regulations and wildlife treaties.
The world's largest polluter, the U.S. military, generates 750,000 tons of toxic waste material annually, more than the five largest chemical companies in the U.S. combined. This pollution occurs globally as the U.S. maintains bases in dozens countries. In the U.S. there are 27,000 toxic hot spots on 8,500 military properties inside Washington's Fairchild Air Force Base is the number one producer of hazardous waste, generating over 13 million pounds of waste in 1997. Not only is the military emitting toxic material directly into the air and water, it's poisoning the land of nearby communities resulting in increased rates of cancer, kidney disease, increasing birth defects, low birth weight, and miscarriage.

Current Projects The Rule of Law Program works actively with the Institute's other programs as well as other organizations such as the United Nations Development Program in its ongoing work. Current projects of major focus include the following: Project on Peacekeeping and the Administration of Justice As many of the questions raised by the report are crucial to the success of future peacekeeping missions, the United States Institute of Peace in 2001 launched a multi-dimensional collaborative project on the challenge of the administration of local systems of justice in the context of post-conflict peacekeeping and peacebuilding. The Project on Peacekeeping and the Administration of Justice is designed to respond to these questions with respect to the construction of transitional systems of criminal justice in post-conflict territories. This includes cases in which the international community may exercise executive authority in administering the system as well as those cases in which the international community provides technical assistance to local authorities. The goal of the project is to produce both policy guidance and practical tools to aid the planning of future efforts.

The US military: A creeping civilian mission

It seems that the United States military coup of 2012 has arrived about 10 years early. Well, okay, not the full-fledged classic coup, led by a general on horseback. But, as they say, close enough for government work.
First, more about that coup. In 1992, a then little-known deputy staff judge advocate lieutenant-colonel by the name of Charles J Dunlap Jr published an article titled "The Origins of the American Military Coup of 2012" (1) in the US Army War College's military journal Parameters. In a plot that was a cross between Arthur Koestler's Darkness at Noon and the movie The Siege
While Dunlap, now a brigadier-general at the Air Combat Command, has not weighed in on this recently, the last two trends have been evident for many years. The Goldwater-Nichols reforms passed by Congress in the 1980s greatly strengthened jointness among the traditionally separate armed forces and the increasingly conservative and republican nature of the armed forces, which is well documented by journalists and academics.

365Gay.com , October 2, 2003 By Doreen Brandt, 365Gay.com Newscenter, Washington Bureau Washington, D.C.— The military’s highest court is being urged to remove sodomy laws from the code of conduct. When the US Supreme Court nine months ago struck down sodomy laws in Texas and other states, the ruling did not affect the Uniform Code of Military Justice. The military sodomy law, section 125, applies both to heterosexual and homosexual sodomy regardless of where the act takes place, meaning that even married couples could be prosecuted for committing sodomy in the privacy of their own home. Technical Sergeant Eric Marcum was convicted of consensual sodomy with a fellow airman of the same sex at Marcum’s home. At least two other cases are moving forward that challenge the military sodomy law. Both of the cases involve heterosexual sodomy. Today three LGBT rights groups filed friend of the court briefs on Marcum’s behalf. Lambda Legal, the ACLU, and Servicemembers Legal Defense Network argue that in light of the Supreme Court ruling Article 125 must be struck down as well. An amicus kbrief was also filed today by noted military sociologist Charles Moskos and eight other social scientists and military experts. Their brief disputes the military’s assertion that consensual sodomy undermines unit cohesion or military effectiveness.

Dean Robert C. Clark Announces Change to HLS Military Recruiting Policy
Post date: August 26, 2002 1:30 p.m. The following is a memo from Dean Robert C. Clark to the Harvard Law School community outlining changes to the school's military recruiting policy for the 2002-2003 academic year. This academic year, for the first time since this School adopted a policy prohibiting discrimination on the basis of sexual orientation, the U.S. military will be allowed access to the facilities and services of the Law School's Office of Career Services ("OCS"). Because of the significance of this decision, I write to inform you of the history of this issue at the Law School and the path that led to this course of action. At the outset, I would emphasize that the decision is the product of intense discussion and careful deliberation after the military raised the issue with new rigor this year. Regrettably, no reasonable alternative was available that could satisfy the disparate views on this issue. I have personally struggled with this issue, because I recognize the pain that some members of the community (especially our gay and lesbian students) will endure because of the change in practice. For many of us, a policy of nondiscrimination on the basis of sexual orientation reflects a fundamental moral value. There are numerous ways to express this value and pursue its implementation, however. Our decision to permit military recruiters access to the facilities and services of OCS does not reduce the Law School's commitment to the goal of nondiscrimination on the basis of sexual orientation.
