ELITISM IN LEGAL EDUCATION:
THE MICHIGAN LAW SCHOOL AFFIRMATIVE ACTION DECISION MISSES THE POINT

JURIST Guest Columnist T he recent University of Michigan Law School case implicates certain matters that respectively are unfortunate and/or are almost certain to be issues of future contention in education and law. These matters were presented to the Supreme Court by the Massachusetts School of Law, a small reformist institution in northern Massachusetts. MSL filed an amicus brief, taking neither side, which made a point that we believe no other brief made. MSL’s brief explained that it is the desire to be elite that causes law schools to have to resort to affirmative action in order to enroll sufficient minority students. That is, desiring to be elite in a profession that is riddled with elitist thinking to a degree unequaled elsewhere, law schools rely largely or predominantly on the LSAT in their admissions processes. They demand high LSAT scores in order to be “elite.” They do this even though they know that minorities have traditionally scored badly on the LSAT and will not be admitted in sufficient numbers when the LSAT is the major determinant of admission. Then, to overcome this elitist predilection which is deliberately built into their admissions processes, law schools engage in affirmative action in order to enroll minority people. Thus, the law schools knowingly discriminate

    The most powerful argument in the Michigan case. By Peter N. Kirsanow y far the most persuasive brief in the University of Michigan preference cases is the so-called "green brief" or "generals' amicus brief." The generals' brief has captured more attention than perhaps any other except the one filed by the Bush administration, and it's the one that most troubles conservatives. After all, it contains arguments supported by serious men in the most serious occupation. During last Tuesday's oral arguments before the Supreme Court, Justices Ginsburg, Stevens, and Souter especially were fascinated by the arguments set forth in the brief, and peppered advocates with numerous questions about the points made therein. Rarely has a non-administration amicus had such an impact.

WOLF BLITZER, CNN ANCHOR: A ruling in the 1970s on affirmative action left some confusion in its wake and has been cited by both sides on the controversy. Now there's a question whether today's rulings cleared up some of that confusion or added to it. Our legal analyst Jeffrey Toobin joining us once again from New York. Jeffrey, is it fair to say this is a mixed bag or is it a huge victory for those who support affirmative action?
JEFFREY TOOBIN, CNN LEGAL ANALYST: Well I think the people who supported affirmative action basically they dodged a bullet, because, you know, if the court was going to do anything dramatic, I think, based on the makeup of the court, they were going to get rid of affirmative action altogether. Here, they supported the principle. I think that is a significant victory.
What is going to be difficult is designing programs that comport with what the court said about affirmative action. Obviously, the law school program is OK. The undergraduate program is not. What's going to be difficult is the law school has a very individualized approach, but the undergraduate program is huge. They have thousands more applications than does the law school.

Submitted by Alan Bruce Chaput Henry CHAPUT: Born 22 March 1887 at Goose Lake, Michigan. Seventh child of Onesime CHAPUT, a trapper, and Melvina LABRIE, a homemaker. Mother died in 1893 of typhoid fever when Henry was five. Married Florida DUGAS 1909. First son, Milton, born 1910 at Munising, Michigan. Second son, Clayton, born 1912 at Gwinn, Michigan in his parent's home. No electricity, no water, no plumbing. Father died 18 June 1919. First wife, Florida, died 1923. Married second wife, Rose REMILLARD, 1925. Due to asthma Henry quit mining in 1925 to become a timber jobber. Owned and operated two taverns in New Swanzey. Died 9 December 1950 in Forsyth Township, Michigan of carcinoma of stomach following a year's illness. Interned at Gwinn, Michigan.
Submitted by Alan Bruce Chaput Florida DUGAS: Born 20 February 1890 in Quebec. 5th of 13 children of Peter DUGAS, a farmer, and Cordellia TREMBLEY, a homemaker. By 1896 Florida was living at Little Lake, Michigan. Married Henry CHAPUT 1909. First son, Milton, born 1910 at Munising, Michigan. Mother died 1910. Second child, Clayton, born 1912 at Gwinn. Deceased 5 July 1923. Florida died from complications arising from a goiter operation at Henry Ford Hospital in Detroit. She died a few weeks after she returned to Gwinn. Cause of death, myocarditis. U-Michigan Gets Broad Support on Using Race washingtonpost.com By Charles Lane Washington Post Staff Writer Tuesday, February 11, 2003; Page A01 As the Supreme Court faces its biggest showdown over a racial issue in 25 years, America's business, education and labor leaders are throwing their weight behind the University of Michigan's bid to preserve race-conscious college and university admissions. Among the organizations and individuals who are planning to submit friend-of-the-court briefs supporting the university are several dozen Fortune 500 companies, the nation's elite private universities and colleges, the AFL-CIO, the American Bar Association and a list of former high-ranking military officers and civilian defense officials, according to attorneys involved in the case. Though its ultimate impact on the court is difficult to gauge, this impending flood of briefs shows the degree to which the American establishment has embraced the pursuit of diversity through race-conscious means since the court's 1978 decision in the Bakke case. Regents of the University of California v. Bakke, the court's last major ruling on race-based admissions, has been interpreted to mean that race may be a "plus factor" in admissions as long as there are no strict numerical quotas. These pillars of U.S. society have lined up behind Michigan less to defend the particulars of its admissions programs, which award extra points to minority applicants, than to defend an array of race-conscious policies and practices they have come to believe in and rely on and which could be threatened if the case goes against the Ann Arbor school.

I regret that I wasn't here a few weeks ago when the statue came down. (Applause.) I understand you had quite a party. I don't blame you. A lot of the people in the Detroit area had waited years for that great day. Many Iraqi Americans know the horrors of Saddam Hussein's regime firsthand. You also know the joys of freedom you have found here in America. (Applause.) You are living proof the Iraqi people love freedom and living proof the Iraqi people can flourish in democracy. (Applause.) People who live in Iraq deserve the same freedom that you and I enjoy here in America. (Applause.) And after years of tyranny and torture, that freedom has finally arrived. (Applause.) I have confidence in the future of a free Iraq. The Iraqi people are fully capable of self-government. Every day Iraqis are moving toward democracy and embracing the responsibilities of active citizenship. Every day life in Iraq improves as coalition troops work to secure unsafe areas and bring food and medical care to those in need.
