Residency Requirements for Tuition Purposes
Effective date: Summer 2004
Applicable to: Students first admitted to the university as of Summer 2004 and thereafter.
A student enrolling at Ferris State University shall be classified as a "resident" or "non-resident" student for the purposes of administering admission, fees, and tuition charges. It is the student's responsibility to register under the proper "resident" or "non-resident". If a student has a question regarding his/her classification, the student should contact the Office of Admissions and Records at least one month before registering.
The following regulations set forth the major points governing determination of "resident" and "non-resident" status and the payment of "resident" and "non-resident" tuition.
I. General Provisions
  • Students who are domiciled in Michigan are eligible to be classified as "resident" for tuition purposes.
  • For University purposes, "domicile" is defined as the place where an individual intends his/her true, fixed and permanent home and principal establishment to be, and to which the individual intends to return whenever he/she is absent from the University.
    An individual whose activities and circumstances, as documented to the University, demonstrate that he/she is domiciled in Michigan will be eligible for classification as a "resident" student. An individual whose presence in the state is based on activities or circumstances that are indeterminate or temporary, such as (but not limited to) educational pursuits, will be presumed not to be domiciled in Michigan and will be classified as a "non-resident". In order to rebut this presumption, the burden of proof is on the student to demonstrate by clear and convincing evidence that he/she is domiciled in Michigan and, thus, eligible for "resident" classification.

    Charter schools are surging ahead as a reform movement. More than half the states now have legislation allowing charter schools and the number opening has tripled in the last two years. The enthusiasm could wane in the next few years and the number of charter schools dwindle or never amount to a sizeable movement. But the more pressing questions are how much autonomy they have and how accountable and effective they are. Charter schools first emerged when the state legislature in Minnesota passed a law allowing them in 1991. Charter schools are public and nonsectarian. They cannot ban any child from attending and they cannot charge tuition. For some charter schools in states with older laws, a reckoning is looming since five years is the most common deadline for renewal. One of the biggest issues that states will have to examine is the accountability required in exchange for the autonomy granted to charter schools. States with expansive laws, like Michigan and Arizona, cut the red tape and allow charter schools a lot of leeway. States with restrictive laws, like Hawaii and Rhode Island, discourage applicants because of all the hoops they must jump through to get a permit. In such states, charter schools have to apply for waivers from regulations and they must abide by collective bargaining agreements and are considered legally dependent on school districts. A study commissioned by the U.S. Department of Education shows that states with restrictive laws have fewer charter schools than states with more expansive ones. Hawaii had only two schools, compared to the 103 listed for Arizona in the federal report, although both passed laws in 1994. The ratio of half expansive and half restrictive laws has remained consistent since charter schools first emerged, says longtime charter school advocate Ted Kolderie.

HEADLINES June 11, 2003 Michigan Meeting Held to Urge No New Regulations for Homeschoolers On May 30, 2003, Paul De Pree, homeschooling father and trustee of Patrick Henry College, organized a meeting at state senator Tony Stamas' office. The purpose of the meeting was to put to rest certain concerns that there was a need for future legislation in Michigan to require more accountability for homeschoolers. In addition to the senator, Representative Sandy Caul, Representative John Moolenar, and Judge Doreen Allen were in attendance. Furthermore, Loraine and Pam Durfee, Dan and Sarah Hickman, and Steve and Michelle Mork, all homeschool parents, were there. HSLDA Senior Counsel Chris Klicka attended by speakerphone. Chris Klicka spoke first, describing the extraordinary academic success of homeschoolers at the elementary and secondary levels. He also explained how homeschoolers on the average score above average on the college entrance exams and, according to surveys at universities, the homeschoolers have a higher grade point average than the college average. He briefly described the intense legal struggle to be free in Michigan over the 18 years since he represented families that were homeschooling.

    The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
    There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.

    Michigan on the Wrong Track?
    Early in her new administration, Gov. Jennifer Granholm won high marks for addressing tough issues without damaging Michigan’s business climate. She closed a nearly $2 billion budget gap with some real spending cuts and without resorting to general tax increases. Gov. Granholm said all the right things about retaining jobs, and even ordered her Department of Environmental Quality to speed up air quality permits for industry. The Mackinac Center awarded the governor a "B-" for her first year. However, a number of recent Granholm administration actions threaten to put Michigan on the wrong track in terms of improving our economic vitality. Hopefully these missteps are aberrations, but it is not too early to raise a red flag by listing some of the bad policy moves:

    Michigan
    Under Michigan law, the Superintendent of Public instruction has supervisory power over all private, denominational and parochial schools, i.e. schools other than public schools giving instruction to children below the age of 16 years, in the first 8 grades. The sanitary conditions, the courses of study, and the qualifications of the teachers are intended to meet the same standards provided under the general school laws of the state. Mich. Com. Laws Registration/Licensing/Accreditation: Length of School Year/Day: Instruction in English: Discrimination: Teacher Certification: Under Michigan law, teachers in the regular or elementary grade studies in a private, denominational or parochial school, i.e. People v. DeJonge , 442 Mich. 266 (Mich. 1993). Persons without valid teaching certificates who have the requisite college credit may apply to the Michigan Department of Education for a teaching permit for employment in a nonpublic school under Mich. Admin. Code r. 390.1142 (full-year permit); 390.1143 (substitute permit); and 390.1144 (emergency permit). Curriculum: Special Education: The policy of the Michigan Department of Education, Office of Special Education and early Intervention Services on this matter is stated in Michigan's Special Education State plan:
