This guide is for those researching issues pertaining to the ADA. Note: law is subject to change. I. Statutes The ADA is found in each of three sources: United States Code (Range 145), United States Code Annotated (Ranges 145-146), and United States Code Service (Range 143). It is codified at Title 42, Section 12101 and following. There are many other sections of federal law concerning disabilities; for these, use the general index following each set. Tennessee statutes on this subject are located in the Tennessee Code Annotated (Range 156 and Reserve). Look in the index under "Disabled Persons" and other appropriate subject headings. II. Regulations Federal regulations implementing the ADA are found in the Code of Federal Regulations (C.F.R.) (Ranges 151-152). The Federal Register (Range 152) has proposed and adopted regulations. Adopted regulations appear first in this source and then are incorporated into the C.F.R. Teevan On September 30, 2000, Governor Gray Davis signed Assembly Bill 2222, legislation that significantly expands protection for disabled workers in California beyond the protections currently afforded by the federal Americans with Disabilities Act of 1990 ("ADA") [42 U.S.C. §12101 et seq.]. The new law modifies sections of the Fair Employment and Housing Act ("FEHA"), [Gov't Code § § 12940 et seq.], which is the California statute that prohibits discrimination in employment. AB 2222 went into effect on January 1, 2001. As you are aware, employers cannot discriminate against qualified job applicants or employees who are, have been, or become disabled. Both the federal ADA and the California FEHA prohibit discrimination in the workplace based on disability. In the past, California employers have been able to rely on ADA case law, as well as the accompanying U.S. Equal Employment Opportunity Commission ("EEOC") regulations, to interpret FEHA disability discrimination claims. Because the new law provides California employees with protections independent of, and in addition to, those of the federal ADA, employers will not always be able to apply federal precedent to the FEHA.

    How is an Objective Medical/Psychiatric Opinion Formed?
    A medical expert is a physician who has the requisite clinical experience and academic achievement to form an objective medical opinion to a reasonable degree of medical certainty. A forensic psychiatrist is a physician who integrates clinical experience, knowledge of medicine, mental health, and the neurosciences to form an independent, objective opinion. Relevant data is gathered and analyzed as part of a process of alternative hypothesis testing to formulate an expert medical/psychiatric opinion. This expert opinion can be effectively communicated by written report, deposition, or courtroom testimony. The applications of forensic psychiatry are widespread in settings ranging from health care and the workplace to criminal justice and public safety.     NYLPI's Disability Law Center ("DLC") works to enable people with disabilities to participate fully in the mainstream of American society and to dispel the notion that people with mental or physical disabilities are incapable of experiencing fully realized and accomplished lives. The core of the Center's work is impact litigation. In addition, staff members also advise and provide technical assistance to people with disabilities and their advocates, conduct trainings, and sit on private and government commissions. This work is furthered by assistance from the private bar, which is orchestrated by NYLPI's Disability Rights Task Force.     A misunderstood law BY ROBERT L. BURGDORF Twelve years ago, as I drafted the original version of the Americans with Disabilities Act, I never dreamed that this landmark civil rights law would become so widely misunderstood and my words so badly misinterpreted particularly by the body meant to protect the very rights guaranteed by the law. In its recent [1999 Sutton] ruling drastically narrowing who is protected by the Americans with Disabilities Act, the Supreme Court cited an article I wrote to support its idea that the ADA was intended to cover only 36 million people. The Court's reference to my writing as authority for its decision and express acknowledgment of my having written the original version of the ADA for the National Council on Disability was hugely ironic, however, for I happen to believe that the Court was dead wrong in its decision. The Court rested its ruling on the breadth of this major civil rights law on the interpretation of a congressional finding that 43 million individuals in the U.S. have a physical or mental disability. Justice O'Connor's sophistic reasoning was that the Council and the Congress intended to cover only a narrow group of 36 or 43 million individuals and not a broader class of 160 million people with health conditions that impair the normal functional abilities of an individual. In this bean-counting analysis, Justice O'Connor ignored the fact that the ADA, as originally proposed and as enacted, has a three-prong definition of an individual with a disability. Only the first prong deals with people with an actual disability and that is what the 43 million figure refers to.

    Role of the Americans with Disabilities Act
    Let's say you have thoroughly reviewed your emotional, physical, and financial situation and you have decided to return to the workforce. Before returning, however, it is important that you know your legal rights if you were disabled by the crash. Several federal laws protect the disabled from discrimination in the workplace. The federal Rehabilitation Act of 1973 prohibits employment discrimination by the federal government and federal contractors and subcontractors. The Vietnam Veterans Readjustment Assistance Act protects disabled veterans. Many states also have laws that protect disabled workers. The most important law in this area is the Americans with Disabilities Act (ADA), passed in 1990. This is a civil rights law designed to protect the millions of Americans with mental and physical disabilities, both as workers and as users of public and private facilities. Two sections of the act specifically apply to employees and job applicants of any employer who employs 15 or more people. Title I of the act requires employers to make reasonable accommodations for disabled applicants and employees who are qualified for a particular job. Title III requires employers to remove architectural barriers that prevent access to employees, customers, or users.
