The Americans with Disabilities Act (ADA) is a federal law that prohibits discrimination against persons with disabilities in these areas: Employment - This includes hiring, termination, working conditions, and need for an accommodation at your job because of disability. Public Accommodations Included as public accommodations are hotels, offices (including doctors and attorneys), shopping malls, restaurants, sports arenas, schools, zoos, hospitals, theaters, grocery stores, homeless shelters, libraries, etc. Public Entities This includes all local and state governmental services and programs, including state hospitals and public housing authorities. Transportation - Buses, trains, light rail must be accessible or alternatives offered. Auxiliary Aids Auxiliary aids (such as interpreters, TTY or amplification devices) must be made accessible for speech and/ or hearing impaired persons. The ADA applies to persons with psychiatric disabilities if the mental disability substantially limits one or more of the major life activities of the person.

Public Act 93-0078 (HB 56) (effective 1/1/04) Makes the following amendments to 730 ILCS 5/5-2-4, the law governing the confinement and release of persons found not guilty by reason of insanity (NGRI):
  • Permits a court to order the Department of Human Services to provide services to an NGRI being conditionally release under court order or to contract with any public or private entity to do so. Requires the Department to monitor the treatment of conditionally release NGRIs and to notify the court and the States Attorney if revocation is needed. Permits the period of conditional release to be extended by successive five-year periods not to exceed the maximum period of commitment (otherwise defined by the statute in relationship to the sentence the defendant could have received if committed). Currently, the original five-year period of conditional release may be extended once for an additional three years. Requires that any recommendation for conditional release to include an assessment of the defendant's need for psychotropic medication if released.

DISABILITIES LAW PROGRAM The Disabilities Law Program is a special project of Community Legal Aid Society, Inc. and is designated by the Governor as the Protection and Advocacy agency in Delaware. This program provides advocacy services to Delaware residents with physical or mental disabilities. Given limited resources, services are prioritized based on needs identified by consumer and community groups. WHOM DO WE SERVE? This article briefly reviews Section 504 and the Americans with Disabilities Act of 1990 and identi fies the criteria that are used to determine whether a student is both "disabled" and "qualified." Then, specific areas of admission, accommodation, and dismissal are examined. Finally, guidelines are presented that may be used by professors and administrators in their efforts to provide qualified students with disabilities with nondiscriminatory access to higher education.
Today, there are more students with documented disabilities in higher education than ever before 140,142 freshmen reported having a disability in 1996 (HEATH Resource Center, 1998). That figure represents over 9% of all freshmen (HEATH Resource Center, 1998), as compared with only 2.6% in 1978 (HEATH Resource Center, 1995). Although the process has been slow, colleges and universities (hereafter referred to as

Alert: California Supreme Court Confirms Broad Disability Discrimination Protections
February 25, 2003 Colmenares v. Braemar Country Club, Inc. , issued on February 20, 2003, the Court found that recent amendments to the FEHA merely clarified what had long been a distinction between California and federal law - that impairments need not be "substantially" limiting in order to qualify for state law protection. This decision has the effect of expanding the scope of California disability law beyond the definitions in both federal courts across the nation and California courts in the past, leaving potential coverage unpredictably broad. In Colmenares , plaintiff admitted that his "chronic back injury" did not "substantially" limit his ability to perform his work as a golf course maintenance crew foreman. Based upon that admission, the trial court granted summary judgment against plaintiff on the ground that he did not have a disability protected by the FEHA. While the case was on appeal, the California Legislature passed AB2222, which expanded the FEHA disability discrimination prohibitions, by, among other things

States may pass disability statutes so long as they are consistent with the ADA. Other statutes prohibiting discrimination against individuals with disabilities include the Fair Housing Act, Rehabilitation Act, Air Carrier Access Act, and the Individuals with Disabilities Education Act. Under the Fair Housing Act, it is unlawful to discriminate in any aspect of selling, renting, or denying housing because of an individual's disability. Owners are further required to make reasonable exceptions in their housing policies so as to afford equal housing opportunities to those with disabilities. The Rehabilitation Act prohibits discrimination on the basis of disability in programs conducted by Federal agencies, in programs recieving Federal financia assistance, in Federal employment, and in the employment practices of Federal contractors. Its standards mirror those of the ADA. Under the Air Carrier Access Act, air carriers are prohibited from discrimination against qualified individuals with physical and/or mental impairments.

Mission:
Since 1973, the Commission has been the primary entity within the American Bar Association focusing on the law-related concerns of persons with mental and physical disabilities. Its mission is "to promote the ABA's commitment to justice and the rule of law for persons with mental, physical, and sensory disabilities and their full and equal participation in the legal profession. The Commission is composed of lawyers and other professionals, many of whom have disabilities. Each year the Commission surveys Association entities to evaluate the progress the ABA has made in promoting lawyers with disabilities to leadership positions and issues a report with findings and recommendations. In addition, the Commission's Subcommittee on Lawyers with Disabilities addresses the concerns of lawyers and law students with disabilities. Also each year the ABA, through the Commission, presents the Paul G. Hearne Award for disability rights. Since 1976, the Commission has published the Mental and Physical Disability Law Reporter, which is the leading disability law periodical in the field. In addition, the Commission has a number of other publications, products, and services that are described below.
