  • The House and the Senate are collectively known as the Massachusetts General Court, http://www.magnet.state.ma.us/legis/legis.htm The annual session of the General Court for each year begins on the first Wednesday of January and dissolves when the legislative business is completed for the year and the legislators vote to "prorogue" (dissolve). If proposed legislation is not enacted by the end of the session, it dies and must be reintroduced in the next session. The General Court's website provides information on legislators, committees, the current version of General Laws of Massachusetts, bill tracking and bill text of the current legislative session, session law texts from 1997-, as well as House Journals from 2001- and Senate Journals from 1998-.
  • How does a bill become law?
  • Proposed legislation Proposed legislation may be filed: (1) by the Governor; (2) as a recommendation from the a state officer or agency; (3) in a report of a special commission specifically appointed to do so by the General Court; (4) as a committee bill; or (5) by petition. Legislators may introduce a bill by petition, and also the Massachusetts Constitution guarantees citizens the right to introduce bills via initiative petition. Mass. Const. Amend. Art. 48. Public hearings After filing, proposed legislation is referred to one of the joint committees, and a public hearing on each bill is mandatory. The committee summarily reports (e.g., recommends without producing a written report) that the bill ought to pass or ought not to pass, and indicates if the bill was discharged to another committee, and/or if the committee redrafted it and assigned it a new bill number.

Motor Vehicle Laws Emergency Vehicles, Right of Way Registration of Vehicles Seven Day Registration Transfer Law The law allows a vehicle owner a period of seven (7) calendar days from the date the registered motor vehicle or trailer was sold, traded,etc., to transfer the registration to the newly acquired vehicle with the registration plates from the previously registered vehicle or trailer. During this 7-day period, the owner may operate the newly acquired vehicle with the registration plates from the previously registered vehicle. The registration transfer must be completed by 5:00PM of the seventh calendar day following the date of the transfer of the previously registered vehicle. For the purposes of determining when the seven days begins and ends, the Registry of Motor Vehicles believes that the statutory language "from the date of transfer until five o'clock post meridian of the seventh calendar day following the date of transfer..." means that the day of transfer is the first calendar day of the seven day period. As an example, if the transaction occurred on June 17th, the 17th would be the first day and 5:00 PM of the 23rd would be the end of the seventh calendar day. The seven (7) day registration transfer law replaces the two/ten day law which allowed an owner two days or ten days to transfer registration, depending on whether the vehicle was new or used and if it was traded to a Massachusetts dealer. As with the two/ten day law, the purpose of the seven day transfer law is to allow the purchaser sufficient time to transfer their registration and obtain insurance coverage on the newly acquired vehicle.

    Immigrants' Employment Rights and Remedies MASSACHUSETTS LAW LIMITS TRANSPORTATION FEES CHARGED TO TEMPORARY WORKERS
    Immigrants' Rights Update, Vol. 16, No. 2, April 12, 2002 A law that limits the amount of fees that temporary employees may be charged for transportation to and from the places where they are temporarily employed was enacted recently in Massachusetts. The new law states that a "staffing agency" or employer that offers temporary workers transportation to the work site for a certain fee can charge only the actual transportation cost or three percent of that worker's daily wages, whichever is less. Moreover, such a fee may not reduce the worker's daily wages below the minimum wage. Most importantly, if the agency, work site employer, or anyone working for either the agency or work site employer require a worker to use the transportation services, the new law prohibits them from charging any fee. Finally, the law requires a staffing agency or work site employer or anyone acting on their behalf to obtain written authorization from a worker before deducting any transportation fees from his or her wages. The worker must be provided a copy of the signed authorization, which must be in a language the worker understands. Any person who violates the new law is subject to civil fines. It is common practice to require temporary workers, many of whom are immigrants who work for low wages, to pay a transportation fee as high as $15 per day. Massachusetts' Acting Governor Jane Swift signed the new law, which amends section 27C of chapter 149 of the Massachusetts General Laws, on Feb. 13, 2002.

    INTRODUCTION
    As a general rule, legal research requires the use of many different sources. The type and nature of the sources used often depends upon the issues under examination, as well as jurisdictional considerations. State-based legal research may involve the use of sources which are unique to that jurisdiction. This guide provides an overview of the legal research process in Massachusetts. It focuses on the primary sources: the constitution, statutes, administrative law, case law, and court rules, along with the major finding aids for these sources. Secondary sources such as legal encyclopedias, treatises, and periodical literature will also be reviewed.
