Electronic Surveillance involves the traditional laws on wiretappingany interception of a telephone transmission by accessing the telephone signal itselfand eavesdroppinglistening in on conversations without the consent of the parties. Following the tragedies of September 11, there is growing support to give law enforcement agencies more power to tap into private communications to thwart further acts of terrorism by monitoring private electronic communications. State and federal policymakers face the challenge of balancing security needs via electronic surveillance against the potential erosion of individual privacy.

Introduction to Criminal Law - U.S.A.
The criminal justice system in the United States of America is a hybrid system, involving state and federal government agencies. The power to make criminal laws is divided between the federal and state governments. For examples, most crimes are punished under state laws but there are some federal laws which create and punish certain conduct as well. The Constitution of the USA gives the federal government jurisdiction over tax, interstate commerce and mail and on that basis, the federal government has enacted laws which create crimes such as failing to file an income tax return, transport a stolen car across state lines and defrauding the postal service. State criminal laws are usually consolidated in state penal, vehicle or health codes. For a sample state penal code, readers are invited to consult the Texas Penal Code . Also, procedural matters vary from state to state.

Hundreds more will do so as the week progresses. ( Full story This is a watershed moment in history, and yet it is far from the end of the story. Legal challenges suggesting other states need not recognize these Massachusetts marriages have yet to be resolved. Advocacy to amend the constitution to prohibit such marriages will doubtless continue, and President Bush today reiterated what he calls an "urgent" need for such an amendment. In addition as I will explain Massachusetts' governor has invoked an old state law that he claims means out-of-staters cannot enter into same-sex marriages in Massachusetts. But whether this law will prevent out-of-state couples from marrying in Massachusetts, or, perhaps more importantly, invalidate their marriages if they do, remains to be seen.
The legal background in Massachusetts
I discussed the events relating to same-sex marriage in Massachusetts in detail in a prior column so I will recap them only briefly here.

Abstract:
Many writers in recent decades have objected to the utilitarian aspects of substantive criminal law that cannot be squared with modern, retributivist versions of criminal justice. One particular target of the retributivists has been the use of strict liability, especially as it is applied in statutory rape cases. This article is an effort, not to take sides between utilitarians and retributivists, but to historicize the ideas and assumptions on all sides of the debates in criminal law, including the debate about strict liability in statutory rape.

Criminal Identity Theft and Assumption Deterrence Act
In October 1998, Congress passed the Identity Theft and Assumption Deterrence Act of 1998 (Identity Theft Act) to address the problem of identity theft. Specifically, the Act amended 18 U.S.C. § 1028 to make it a federal crime when anyone: knowingly transfers or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law. Violations of the Act are investigated by federal investigative agencies such as the U.S. Secret Service, the FBI, and the U.S. Postal Inspection Service and prosecuted by the Department of Justice.

"Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance." Article 18 of the Universal Declaration of Human Rights The essays listed below deal almost exclusively with North American constitutional law, and international, federal, state/provincial laws, and local laws that are related to religion. Separation of church and state is mandated by the 1 st Amendment to the U.S. Constitution. A similar principle has evolved largely through popular custom in Canada. The result of this separation, in our opinion, has been a vigorous religious life coupled with a relative lack of religious persecution. Many countries have traditionally had closer links between state and religion. This has led (and continues to lead) to serious persecution of minority religions in many areas of the world.
