A mechanic's lien is a claim against the personal property on which the claimant has bestowed labor or furnished material for the value of the labor done or materials furnished. Anyone who has furnished labor, services, material or equipment and has properly complied with the notice requirement is entitled to file a mechanic's lien. All 50 states have been researched and it has been determined that only 34 states have laws on mechanic liens. We are Boston-area disability lawyers, fighting for the right of disabled individuals to full participation in our society, including the right to employment and educational accommodation. Discrimination against persons with handicaps or disabilities is prohibited by two major federal statutes, the AmericansWith Disabilities Act and in Section 504 the Rehabilitation Act of 1973 (29 U.S.C. sec. 794) . In addition the Massachusetts Constitution (Article 114 of the Amendments) prohibits discrimination of otherwise qualified persons on the basis of handicap, which is enforceable under Ch. 93, s. 103 of the general laws. Together they stand for the proposition that no otherwise qualified individual will be denied participation in or the benefits of a program on the basis of handicap or disability Congress first began seriously to address these problems in 1973 with passage of the Rehabilitation Act, including section 504. Modeling it after Title VI of the Civil Rights Act of 1964, "[C]ongress intended Section 504 to be a broad civil rights act aimed at providing equal opportunities for the handicapped." It would be very convenient if all state and federal codes, statutes, and caselaw were available on the World Wide Web. This would give lay people easy access to the laws that they must follow and it would allow attorneys to do legal research without having to leave their office to go to a law library, or pay for expensive collections of casebooks. Unfortunately, economic realities dictate that we may never see all of the substantive law of all the states on the Web. Several states receive quite a bit of income by selling the exclusive rights to publish that state's caselaw. In addition, it is quite expensive to publish and maintain a web site, and money for such a project is not available in all states. Caselaw on the Web ideally would include decisions from at least the last 30 years, a sophistocated search engine for locating relevant law, case summaries, headnotes, etc. Providing all of these on a Web site would be very expensive. Given the above, it is impressive how much substantive law

NEW IDENTITY THEFT LAWS WILL PROVIDE ASSISTANCE TO VICTIMS AND LAW ENFORCEMENT
On June 7th, 2004, Attorney General William H. Sorrell and Senators Dick Sears (Bennington) and John Bloomer (Rutland) announced at a press conference in Manchester today that a bill to protect consumers from identity theft has been passed by the Legislature. Governor Jim Douglas is expected to sign the bill into law tomorrow. The bill creates a new crime of identity theft, and provides new tools to assist victims. “Identity theft is a big problem getting bigger both here in Vermont and nationally. The financial losses to victims, both individuals and businesses, are staggering,” said Attorney General Sorrell. Identity theft occurs when a thief takes over a consumer’s entire identity by stealing critical private information (such as SSN, driver’s license number, address, credit card number or bank account number) so that the thief can use the stolen information to obtain illegal loans or credit lines to buy goods or services under the stolen name. Usually the identity thief changes the consumer’s mailing address on new or old accounts to hide his or her illegal activities.

    Updated March 2000 Laws establishing immunity from civil liability for health care providers delivering uncompensated care to indigent populations have been enacted in a majority of the states in the last decade. Viewed as a way to encourage health care providers to provider free care to underserved populations, states have removed the threat of civil suits against providers who are acting in good faith. Current State Statutes November 2001 OVERVIEW OF CURRENT RIGHTS OF CONSCIENCE LAWS Only one state (IL) protects the rights of conscience of all health care providers , institutions, and payers who refuse to provide any health care service based on a religious or moral objection. Forty-five state laws permit certain health care providers or institutions, or both, to refuse to participate in abortion services only , on the basis of religious or moral beliefs: AK, AR, AZ, CA, CO, CT, DE, FL, GA, HI, IA, ID, IL, IN, KS, KY, LA, MA, MD, ME, MI, MN, MO, MT, NE, NC, ND, NJ, NM, NV, NY, OH, OK, OR, PA, RI, SC, SD, TN, TX, UT, VA, WA, WI, WV, WY. Four states provide no protection for the rights of conscience of health care providers. ALABAMA MISSISSIPPI NEW HAMPSHIRE VERMONT The United States protects the civil rights of health care providers who conscientiously object to abortion and sterilization for individuals or institutions that receive federal funds. III. Civil Exemptions Undermine Parental Legal Responsibility
Despite Denials by HHS, Civil Exemptions Do Undermine Parental Legal Responsibility to Provide Care Common Law Does Not Effectively Restore Parental Duty When the Duty is Confused or Negated by Exemptions The cornerstone of present HHS policy on the exemptions is to allow states to exempt parents from neglect charges - thereby apparently absolving parents from responsibility for providing medical care. HHS, however, has alternatively argued that civil exemptions do not really negate such responsibility (in the absence of specific criminal statutes) since the common law provides for a duty to care. However, common law in the absence of a specific statute, provides no enforcement capability, so parents will have no incentive to carry out a common law duty when a specific statute appears to absolve them of the specific duty. Serious Ambiguities in Laws Confuse and Undermine Parental Duty to Care Civil religious exemptions are a maze of legal ambiguities, open to opposite interpretations. Either the parent must rely on spiritual healing no matter what the circumstances, or only in limited, non-serious circumstances.

    State Computer Harassment or "Cyberstalking" Laws
    Law enforcement agencies estimate that electronic communications are a factor in from 20 percent to 40 percent of all stalking cases. Forty-four states now have laws that explicitly include electronic forms of communication within stalking or harassment laws. State laws that do not include specific references to electronic communication may still apply to those who threaten or harass others online, but specific language can make the laws easier to enforce. Two reports from the U.S. Department of Justice provide detailed information on cyberstalking: Stalking and Domestic Violence: Report to Congress (May 2001) and Cyberstalking: A New Challenge for Law Enforcement and Industry (Aug. 1999). CyberAge Stalking , from LLRX.com , discusses the prevalence of cyberstalking and outlines state and federal statutes and case law. It also provides resources and information about how to protect against this crime.
