The Common Law The legal system of the United States is based on the common law of England. Even though the colonies revolted against the British empire, they retained its legal institutions. In fact, the colonists revolted precisely because they believed that their common law rights were being taken away. Today English law is still the law of the land in some states. The California civil code (Section 22.2) states that the "common law of England, so far as it is not repugnant to or inconsistent with the Constitution of the United States, or Constitution or laws of this state, is the rule of decision in all the courts of this state." The distinguishing features of the common law are that it is based on a system of rights and most of the law is judge-made. Rights are an abstract concept that can be confusing, but the basic idea is straightforward. Rights can be thought of as domains or spheres in which people are free to act without interference. The common law evolved to protect and define this "space." The legal categories that most people are familiar with are common law rights. Property defines the right to possess and own things. Contracts deal with the transfer and exchange of rights. Torts protect rights from accidents and aggression.

Tax Code Kills Civil Liberties
by Chris Edwards Chris Edwards is director of fiscal policy at the Cato Institute. Many Americans filing their income taxes are appalled by the large amount of earnings taken by the government. The income tax is also appalling from a civil liberties perspective because of its inequity, complexity and intrusiveness. While President Bush cut taxes, the tax code remains a monument to social engineering run amok. Help may be on the way with some congressional leaders planning to move ahead with reforms next year to replace the income tax with a low-rate consumption-based tax. That would go a long way toward reducing the following civil liberties abuses of the current tax regime. 1. Vertical Inequality. Although equality under the law is a bedrock American principle, individuals pay greatly different shares of their earnings to taxes. IRS data show that income taxes average 26 percent of income for those earning more than $200,000, but 10 percent for those earning between $30,000 and $75,000. Joint Tax Committee data show that 39 percent of households pay no income tax at all. 2. Horizontal Inequality.

A ccording to Article I, Section 10 of the Constitution, "no State shall pass any ex post facto Law.'' A similar provision that applies to Congress is found in Section 9 of the same article. At first glance these constitutional prohibitions seem simple enoughretroactive laws violate the Constitution. Unfortunately, the issue is not so simple. With one ruling in 1798, the Supreme Court succeeded in muddling the issue of ex post facto laws by holding that the prohibition of retroactive laws applies only to criminal, not civil, laws. In The Constitution of Liberty From a policy standpoint, as Hayek's analysis indicates, ex post facto laws are riddled with problems. Unfair and unpredictable, ex post facto or retroactive laws mar the American legal system and create an abundance of problems.[1] This article examines the origins of the constitutional interpretation of ex post facto laws, reviews sources favoring the prohibition of ex post facto civil laws, considers the damaging impact of retroactive laws on property rights, and proposes a solution to the debate over retroactive laws in which ex post facto civil as well as criminal laws would be constitutionally prohibited unless just compensation is provided for unfair retroactivity. Given that the clear constitutional ban on ex post facto laws does not distinguish between criminal and civil laws and given our own intuitions about fairness in the legal system, the prohibition on ex post facto laws should be extended to civil laws in order to prevent unfair and capricious changes in the law.

What is a citation?
A citation is a reference to legal authorities and precedents such as statutes, cases, regulations, and law review articles. Citations are used in arguments to courts, legal textbooks, law review articles and the like to establish or fortify the propositions argued. Citations to legal materials follow a standard format which makes it possible for anyone using a law library to find cited cases, statutes, regulations, and law review articles. Most legal citations consist of three basic parts: 1) the name of the case, statute, or article 2) a statement of where the item can be found in a multi-volume set of legal materials written as: volume number name of publication (or set) page number 3) a date A complete case citation looks like this: Brown v. Hundreds more will do so as the week progresses. ( Full story This is a watershed moment in history, and yet it is far from the end of the story. Legal challenges suggesting other states need not recognize these Massachusetts marriages have yet to be resolved. Advocacy to amend the constitution to prohibit such marriages will doubtless continue, and President Bush today reiterated what he calls an "urgent" need for such an amendment. In addition as I will explain Massachusetts' governor has invoked an old state law that he claims means out-of-staters cannot enter into same-sex marriages in Massachusetts. But whether this law will prevent out-of-state couples from marrying in Massachusetts, or, perhaps more importantly, invalidate their marriages if they do, remains to be seen.
