Cigarette Taxes, Black Markets, and Crime:
Lessons from New York’s 50-Year Losing Battle
by Patrick Fleenor Patrick Fleenor has been chief economist of the Tax Foundation and senior economist at the Joint Economic Committee of Congress. Executive Summary As large state government budget gaps have opened in the past year, lawmakers across the country are turning to cigarette taxes for added revenue. Twenty states raised cigarette tax rates in 2002, and more hikes may be on the agenda during state legislative sessions in 2003. Proponents of high cigarette taxes portray them as innocuous levies that improve public health. Yet those taxes have long been known to have a dark side. Since the first state cigarette taxes were imposed in the 1920s, black markets and related criminal activity have plagued high-tax jurisdictions. Such activity has proven to be resistant to law enforcement curtailment efforts. Thanks to recent city- and state-level tax hikes, New York City now has the highest cigarette taxes in the country—a combined state and local tax rate of $3.00 per pack. Consumers have responded by turning to the city's bustling black market and other low-tax sources of cigarettes. During the four months following the recent tax hikes, sales of taxed cigarettes in the city fell by more than 50 percent compared to the same period the prior year.

Executive Summary
Yet, this shift occurred precisely as cities were losing political clout in state legislatures due to population decline within city limits and rampant growth in suburban jurisdictions. Overall, the authors find:
  • Cities' dependence on state government has increased as the federal government has ceded more power to the states. As cities' populations have declined, they have become weaker in state legislatures that have grown more powerful due to federal policy. In the peak year of 1978, about 15 percent of city revenues came from the federal government. By 1999 that had decreased to 3 percent. Concurrently, the federal government has shifted a number of programs to the states, which control the rules and revenue mechanisms cities operate under. Traditional political coalitions cities have used to achieve their state legislative goals are no longer as effective.

Home rule amendment

LWVM supported passage of the home rule constitutional amendment in 1966. The people of every city and town were granted the right of self-government in local matters, limited only by the constitution and the standards and requirements established by state law. The amendment allows communities to adopt, revise or amend an existing charter under specific procedures. It put the responsibility for local government on the local level. Applying the Home Rule and Public Personnel positions, local Leagues can support removing their local personnel systems from state civil service, provided the local system is based on merit principles. At the same time, specific restrictions were placed on the powers of cities and towns and the power of the General Court to legislate through general laws was affirmed. This was important for continuity of function throughout the state and for setting standards of performance in broad areas of public concern such as education, housing, health, public safety and the environment. The Anti-Snob Zoning Act (Ch. 774 of the Acts of 1969) and the hazardous waste siting legislation of 1980 are examples of the state setting standards of performance in broad areas of public concern. Cost-sharing
The League finds it irresponsible for one level of government to force expensive programs on another level, and therefore, to implement standards, supports cost-sharing by all levels of government. Cost-sharing should develop a sense of responsibility, involvement and participation at each level of government. LWVM supports adequate funding by the state for state-mandated programs. ... Airline Passenger Finds Frog in Her Salad BOSTON (AP) - A study has found that nearly three out of four Massachusetts police departments engaged in racial profiling of minority drivers, prompting the state to launch a probe.
The Northeastern University study, released Tuesday, was commissioned four years ago by the Legislature and included 366 departments - from cities and towns and the state police, to university, state transit and Amtrak police agencies. Just 92 got a passing grade. Public Safety Secretary Edward A. Flynn warned against condemning departments that failed until more information can be gathered. The study caused the state to order 249 departments to collect a year's worth of data on all traffic stops. "We are not today finding any agency guilty of having engaged in racial profiling," he said. "Data collection is not punishment."

Barnes Aquifer, MA
Background
The Barnes Aquifer is widely recognized as one of Massachusetts' most important regional groundwater supplies. The aquifer is over 12 miles long, and is either the sole or primary water source for four municipalities within the Connecticut Valley of western Massachusetts, including the cities of Holyoke and Westfield as well as the towns of Easthampton and Southampton. The aquifer is composed of well-sorted, coarse sands and gravels that were deposited approximately 14,000 years ago by a retreating continental glacier. Currently, 12 municipal wells and a large (108 unit) well field tap the Barnes Aquifer to supply 21 million gallons of water per day to the 60,000 residents of these communities. The aquifer's recharge area is under heavy development pressure from large-scale residential subdivisions and industrial parks. Potential sources of contamination to the aquifer are underground storage tanks, businesses which use hazardous wastes, linear sources (sewer, power, roads), defoliants (which are used to clear rights-of-way for power lines), road salting, agricultural chemicals, houses and businesses with private septic systems, and the improper storage or disposal of solvents which are used to clean equipment. In the past twenty years, various wells in the Barnes aquifer have been contaminated due to traces of ethylene dibromide (EDB) and trichloroethylene (TCE).

The Massachusetts Institute for Local Public Health is An alliance of local public health interests that have come together to define common goals for improving local public health, and to  collaborate on specific training, education and related activities.             The Institute is sponsored and initially funded by the Commonwealth’s Departments of Public Health and of Environmental Protection. The Institute is guided by the Local Health Coordinating Council (LHCC), which is co-chaired by the two state Commissioners and whose members represent  public health professional  associations, graduate programs, community health providers and government agencies.  There is an  LHCC subcommittee functioning  as the Institute’s steering committee.             The MISSION for the Institute is to strengthen the capacities of  local public health agencies through workforce education, leadership training, program research, and community education, and by promoting strategic alliances.    CHALLENGES             Contemporary public health issues are increasingly  addressed at the local and  regional  levels. In concert with the state government,  local boards of health and health departments are  at the core of the Massachusetts public health system, striving to  ensure  safe water, food and housing, to reduce the use of tobacco, to  encourage healthy behaviors, to provide school health services, to control the spread of communicable diseases, to promote prevention of chronic disease, and to provide many other services. Local public health leaders and practitioners typically are  responsible for health policy-making, community health assessment, assurance of accessible community health services, management of public health services delivery, and enforcement of health, sanitation and environmental regulations.

On the positive side, Massachusetts has a reasonably good capital plan that coordinates and prioritizes its projects, and reasonable monitoring and evaluating of most projects throughout their implementation. The state House of Representatives has made facilities maintenance a theme of its budget over the past several years (although the Senate has been less interested), so some progress has been made on that front.
HUMAN RESOURCES: B-
Worker training is strong here, with a standard that every employee should aim for 30 hours of training a year. Recruiting has also become more aggressive. Last year, agency recruiters spent a day at a Six Flags job fair, to introduce young people to public-sector careers they might not have considered.
MANAGING FOR RESULTS: C
Massachusetts has issued about $2 billion worth of social service contracts, and most of these now include performance measures. Some simply describe outputs, but a majority include outcome measures; and the state is working hard to improve their quality.
INFORMATION TECHNOLOGY: C
The big challenge in Massachusetts is to come up with an IT governance structure that will encourage agencies to work effectively with one another. There has been some progress in this direction, and a broad-based e-government initiative has the potential to help. Still, the biggest current problem is insufficient integration among the agencies.
