Fact Sheet Regarding Maryland Church-Exempt Schools 1. What is meant by the term "church-exempt" school? Maryland law, Education Article, §2-206, Annotated Code of Maryland, exempts nonpublic schools that are governed and operated by a bona fide church organization from holding a Certificate of Approval from the State Board of Education. This means that a church-operated school is not required to meet the educational standards that have been established by the Maryland State Board of Education for nonpublic schools under COMAR 13A.09.09. "Church-exempt" schools must, however, register their operation with the Nonpublic School Approval Branch of the Maryland State Department of Education. 2. Is a church-exempt school required to comply with any approval or licensure requirements?

History of the Regulations The administrative history of these Regulations dates back to 1970. Since then, the Regulations have been revised periodically. The Regulations were last amended in 1994. Currently the Maryland State Board of Education is considering additional revisions to the language in the Regulations. 9:00 a.m. Minutes and Reports 1. Opening and welcome – Chairman Raskin Chairman Raskin called the meeting to order at 9:05 a.m. He asked for additions to the agenda and none was proposed. He requested and the Board concurred without objection that the order of business be altered to take up items 7 and 8 dealing with proposed regulations ahead of any cases.
2. Approval of minutes of June 27, 2002 Mr. Merkowitz moved and Mr. Gant seconded approval of the minutes as presented with the proviso that non-substantive edits could still be made. The motion carried.
3. Chairman’s report Chairman Raskin observed that the state employees labor board and the S HELRB are the first newly created boards in a State in twenty years, so little guidance is available. He noted that the Board is moving into an adjudication phase of its mission, much of which will occur in executive session, and he expressed appreciation for the patience of all the interested parties. He indicated to the audience that the Board knows that the parties are working on their relationships, and the Board’s decisions should be helpful.

  • Maryland community college students who have completed the associate degree or students who have completed 56 semester hours of credit with a cumulative grade point average (GPA) of 2.0 or higher on a scale of 4.0 shall not be denied direct transfer to a Maryland public four-year institution. A Note about Laws and Regulations:
Laws are passed, or enacted, either by a state legislature or the United States Congress. After a state or federal law is passed, the resultant regulations are published, or promulgated, to clarify the intent of each section of the law. Both state and federal regulations carry the weight of the law, and must be followed. Federal regulations provide minimum standards for state programs to follow. State agencies, such as the Maryland Department of Education, issue regulations to define how state and federal laws will be implemented, and may add regulations, as long as they do not conflict with federal regulations. Thus, it is important to understand both the federal and state regulations when discussing a particular program like early intervention. The early intervention regulations accompanying the Individuals with Disabilities Education Act are written, and updated periodically, by the U.S. Department of Education. They are published in the Federal Register as 34 CFR Part 303, Early Intervention Program for Infants and Toddlers with Disabilities. Maryland State Department of Education regulations incorporate the federal early intervention regulations, and are compiled in the Code of Maryland Regulations (COMAR). COMAR contains 33 Titles, with each Title corresponding to a department or agency; COMAR Title [13A.13.01] addresses the Maryland Infants and Toddlers program.

HEADLINES June 26, 2003 Proposed Change to Homeschooling Regulations Author: Maryland Department of Education Summary: The Maryland Department of Education originally proposed a rule that would require homeschoolers to file an assurance of consent notice every year. The latest version of the rule changes is not quite as restrictive. (See details below.) Status: The Maryland Board of Education passed these new rules on June 24, 2003. Requested Action: None at this time. HSLDA's Postion: HSLDA is never in favor of imposing greater restrictions on homeschool families. The new rules clearly do that, although the burden would have been greater had we not moved the Department to retreat from its original demand. We believe the proposed regulations, however, are the best possible outcome for the near term.

Food Service Manager Certification Food Service Managers must pass an approved 16-hour certification course, and must file an application with the local heath department to obtain a Certified Food Service Manager photo identification card. A standard passport-type photo and processing fee must be submitted with each application. Montgomery County: $30.00 Fee, valid for three (3) years. Baltimore City and Howard County require that at least one Certified Food Service Manager be on staff, but does not necessarily need to be on-site during food service operations. The following text is from the Maryland State Department of Education Press Release, STATE BOARD LAUNCHES REGULATORY PROCESS THAT COULD TIE THE HIGH SCHOOL ASSESSMENTS TO GRADUATION (December 4, 2003). The Maryland State Board of Education agreed on December 4th to begin the process of developing regulations that would require high school students to pass the four High School Assessments before receiving a Maryland High School Diploma. The multi-faceted concept also would provide other pathways to high school completion, including a local high school diploma, a diploma for certain students with learning disabilities who have Individualized Education Programs (IEPs), and a certificate of program completion. Assessment passage would not be the sole criteria for graduation, however, as other high school completion requirements that are currently in place - such as successful completion of coursework and service-learning work - would remain. The State Board launched the regulatory process on a 9-2 vote, but the concept has a long way to go before final approval.

AFSCME Makes History with Veto Override SB 78 restores retirement service credit to state employees at the Baltimore City Child Support Enforcement agency who had lost that credit while involuntarily privatized for 6 years. Through a sunset of that act, the employees were finally allowed to return to state service in 2002, only to realize that they would have to work and extra 6 years to make up time lost while contracted out. The House version of the bill, HB 812 was sponsored by Delegate Towanna Gaines, and it was also vetoed and overridden in the House of Delagates. In 2003, AFSCME Council 92 spearheaded the lobbying to return the service credit. After session ended, and Governor Ehrlich vetoed the bill, new lobbying began immediately and was ultimately successful.
We Did It! Pay Raise, Steps, and Beating Back Health Insurance Increases! After management threatened to increase prescription drug co-payments to $10, $20, and $30, AFSCME also lobbied hard. As a result, for the first time ever, the legislature adopted language in the state budget which requires that any changes in plans and co-pays must be negotiated through collective bargaining. The board has no formal sponsor registration requirements for courses or providers. Inform clients that we are a member of NASBA and have issued credits in their state since 1992.

NOTE: in the past Maryland required review and approval for each individual self-study program (under PES' program sponsor agreement number E-1035). However, effective June 30th, 1998 they stopped this practice and no longer require approval for sponsors or courses. To carry out the purposes of the Order of the Court of Appeals of Maryland, passed on March 28, 1966, establishing the Clients’ Security Trust Fund (as of July 1, 2002, name changed to "Client Protection Fund of the Bar of Maryland"), the Trustees have adopted the following regulations pursuant to Md. Rule 16-811d.(iii). The Trustees will be guided, but not necessarily bound, by such regulations. a. Eligibility 1. Attorney-client or fiduciary relationship. No claim will be recognized by the Trustees unless an attorney-client or fiduciary relationship existed with a member of the Bar of the Court of Appeals of Maryland when the loss was incurred as a result of a defalcation by the said Maryland attorney. The Trustees consider that a “fiduciary relationship” means, for example, a lawyer acting in a fiduciary capacity traditional and customary in the practice of law in Maryland, such as a court-appointed lawyer, a personal representative of a probate estate, a trustee of an express trust, a guardian, a custodian acting per statute, or an attorney-in-fact by written appointment. 2. Businesses with ten or more employees.

Since 1987, Maryland has had stable homeschooling regulations that have served the state well. These regulations were developed through a collaborative effort of Maryland homeschoolers, the Maryland State Department of Education, and the Maryland legislature. Relations have remained on a cordial basis with an unspoken agreement that open communications would continue and that homeschoolers would have an opportunity to participate in formulating any regulations that would affect them. Unfortunately, that cordial relationship was threatened when the homeschooling community was surprised last year by proposed changes to the homeschooling regulation. In October, the proposed changes were published in the Maryland Register, (Vol 29, Issue 21) with a period for public commentary ending on November 19, 2002. No homeschoolers had participated in creating the proposed changes and none had been notified. It was only by chance that the proposal was noticed by a homeschooler and an effort was mounted find out more information. October 30, 2002
