New Agency Oversees ADR in Maryland
Draws on Support of All Community Stakeholders By Author
Date December 12, 2000 The use of ADR continues to expand across Maryland and the nation. Alternative Dispute Resolution (ADR) techniques are increasing in popularity in Maryland courts, schools, governments, businesses and communities as they effectively resolve conflicts and settle disputes without litigation, saving time, money and relationships. To build on this momentum, a new agency has been created to coordinate and advance the use of ADR across the state. It will work with MSBA’s new ADR Section to promote dispute resolution techniques in the courts and the legal community. MACRO, the Mediation and Conflict Resolution Office, will now oversee the expansion of ADR through a collaborative, multi-disciplinary effort. An independent, court-related agency housed within the Judiciary, MACRO will develop and enhance ADR services and education to state courts, communities, school, state and local government agencies, criminal and juvenile justice programs and businesses. This new agency, to be headed by Honorable Robert M. Bell, Chief Judge of the Court of Appeals, will be funded as part of the Judiciary’s budget. The new office will carry forth and build on the work of Maryland’s ADR Commission (ADRC), which held its last meeting in October before going out of existence. Chief Judge Bell created ADRC in 1998 when he issued a “call to action” to advance ADR in Maryland. Over the last two years, the Commission has promoted the widespread use of ADR measures, created a greater public awareness of its value in solving conflicts and educated citizens about the benefits of settling disputes outside of the courtroom.

Program Summary
A low cost, voluntary, confidential way to keep Maryland agriculture productive. What is conflict?
  • Understanding what causes conflict and how we choose to deal with it affects how we feel about the process and the people involved.
  • Conflict can be destructive or constructive. Conflict offers opportunity for growth and better decision-making concerning a shared problem.
What is mediation?
  • A voluntary, non-adversarial, interest-based process in which a third neutral party (the mediator) meets with..
  • ...two or more parties who have a conflict, to ...
  • ...facilitate discussion, and...
  • ...assist the parties in reaching a mutual resolution of their differences.
"Winning" in mediation may be...
  • Better understanding of the situation;
  • Less frequent or less harmful tactics;
  • Increased number of points
  • Fewer contentious parties
  • Changing the goal from "winning" to "doing well"
Benefits of Mediation
  • Mediation can be fast, and is usually successful.
  • Participants craft the solution themselves and are generally more committed than when a judge or hearing officer imposes a solution.
  • By attempting to resolve a dispute through mediation, you do not give up your legal rights to file a formal complaint or grievance. (The mediator does not have decision-making authority.)

Dear Black Excel Student and Parent Supporters This is a quick gateway (below) that you should consider immediately to resource help. Each state has aid sources
you should inquire about. No question about that! These
aid sources cover a wide range of programs, sometimes
including resident and fee reductions, "incentive awards,"
grants, scholarships, loans and more. High school guidance
counselors should be keeping you abreast in regard to what's
available. Often, however, this has not been the case. This
is a BLACK EXCEL tip. Call or write the appropriate state
agencies for information packages and assistance. Getting
your state "info and financial aid" packages could mean
savings to you and your child/students. -Isaac Black, Black Excel S T A T E A I D S O U R C E S ALABAMA Alabama Commission on Higher Education Suite 205 3465 Norman Bridge Road Montgomery, Alabama 36105-2310 State Department of Education Gordon Persons Office Building 50 North Ripley Street Montgomery, Alabama 36130-3901

Any portion of this Code may be reproduced and disseminated for educational purposes. As an organization dedicated to the improvement of measurement and evaluation practice in education, the National Council on Measurement in Education (NCME) has adopted this Code to promote professionally responsible practice in educational measurement. Professionally responsible practice is conduct that arises from either the professional standards of the field, general ethical principles, or both. The purpose of the Code of Professional Responsibilities in Educational Measurement, hereinafter referred to as the Code, is to guide the conduct of NCME members who are involved in any tinge of assessment activity in education. NCME is also providing this Code as a public service for all individuals who are engaged in educational assessment activities in the hope that these activities will be conducted in a professionally responsible manner. Persons who engage in these activities include local educators such as classroom teachers, principals, and superintendents; professionals such as school psychologists and counselors; state and national technical, legislative, and policy staff in education; staff of research, evaluation, and testing organizations; providers of test preparation services; college and university faculty and administrators; and professionals in business and industry who design and implement educational and training programs.

Based in Washington, D.C., and founded in January 1995 by Jack Jennings, the Center on Education Policy is the national independent advocate for public education and for more effective public schools. The Center works to help Americans better understand the role of public education in a democracy and the need to improve the academic quality of public schools. We do not represent any special interests. Instead, we help citizens make sense of the conflicting opinions and perceptions about public education and create the conditions that will lead to better public schools. The Center on Education Policy receives nearly all of its funding from charitable foundations. We are grateful to The Joyce Foundation and The Ewing Marion Kauffman Foundation for their support of our work on the No Child Left Behind Act. The Atlantic Philanthropies, The George Gund Foundation, and Phi Delta Kappa International also provide the Center with general support funding that assisted us in this endeavor. US State Government Aid The Free Application for Federal Student Aid (FAFSA) is used to apply for most state loan, grant and scholarship programs, in addition to the federal loans and grants. When you submit the FAFSA to the US Department of Education, they forward the information on the form to the state student assistance agency. Each state has a different FAFSA submission deadline. If you submit your FAFSA by March 1, you will be in time for all state deadlines, other than Michigan. If you miss the deadline, you will be ineligible to receive state aid for the entire academic year. Procedures for applying for state prepaid tuition programs and the national guard differ from state to state. The amount of information provided on the state web sites varies from state to states. Some states provide comprehensive information about residency requirements, loan, grant, scholarship and prepaid tuition programs and other state aid programs. Others provide minimal information. Through a sunset of that act, the employees were finally allowed to return to state service in 2002, only to realize that they would have to work and extra 6 years to make up time lost while contracted out. The House version of the bill, HB 812 was sponsored by Delegate Towanna Gaines, and it was also vetoed and overridden in the House of Delagates. In 2003, AFSCME Council 92 spearheaded the lobbying to return the service credit. After session ended, and Governor Ehrlich vetoed the bill, new lobbying began immediately and was ultimately successful.
