Manitoba Government Fails To Establish Environmental Lien
by Robert Fishlock In what was likely the first judicial consideration of the environmental provisions of the federal Bankruptcy and Insolvency Act ("BIA"), Manitoba's Department of Conservation failed to establish its claim to priority over the proceeds of the sale of an insolvent company's real estate. In CIBC v. Isobord Enterprises Inc. , the Manitoba Court of Queen's Bench found the government department failed to comply with Manitoba's statutory scheme for issuing an environmental order, in this case an order to develop and implement a rodent control order. The department did not pay attention to the statutory requirements to establish that an emergency situation existed or, alternatively, to obtain court authorization to issue the order. Hold your Provincial Government accountable:
    The example of UNPAC Manitoba
UNPAC (MB) is an association that is dedicated to seeking equality for women through the implementation of the Platform for Action. UNPAC(MB) works to support the objectives contained in the PFA by working through community action, and with other organizations, locally and globally, for equality, development and peace. UNPAC(MB) has been working hard to get the word out about their governments slow progress on the PFA. The areas of poverty, violence, health for women provide a focus for their actions. Some of the particular issues of concern for Manitoban women include: the poverty of aboriginal women, discriminatory EI regulations, accessible day care, women's under representation on regional health boards, women's unpaid work, and lack of programs that address the violence in women's lives. In the words of Nancy Buchanan, the Beijing +5 Project co-ordinator, here are some of the specific strategies that UNPAC(MB) can share on how they are taking action to pressure the Manitoba government towards implementation of the Platform for Action.

INFRASTRUCTURE APPLICATION AND REVIEW PROCESS UNDERWAY IN MANITOBA December 18, 2000
WINNIPEG, Manitoba – Application forms for the new Canada/Manitoba Infrastructure Program are now available. The ministers responsible for the program, Ron J. Duhamel, Minister of Veterans Affairs and Secretary of State (Western Economic Diversification)(Francophonie), and Jean Friesen, Minister of Intergovernmental Affairs, made the announcement today.
"The Government of Canada is pleased to see the new program get underway," said Minister Duhamel. "This new partnership, with its new focus and objectives, will build on the previous infrastructure program and further our investment in the critical infrastructure on which we all rely. It also reinforces our vision for Canada as governments combine resources and expertise to work together for Canadians."
"We look forward to working closely with our federal and local government partners to ensure the program reaches those areas where infrastructure standards fall below provincial norms," said Manitoba Intergovernmental Affairs Minister Jean Friesen. "In addition, local governments are encouraged to partner together in regional projects whose benefits will extend to as many Manitobans as possible. Our aim is to provide the best investment for all Manitobans."
Applications have been mailed to local governments, including the Northern Affairs Community Councils. Local governments may also sponsor non-profit or private sector organizations seeking funding for infrastructure for public use or benefit. The deadline for the first project review period is January 31, 2001. Subsequent intake deadlines will occur twice a year, and approvals will be announced on an ongoing basis until the final approval deadline, April 1, 2005.
