Not Just the Law, It’s the Right Thing to Do

Tenbusch, Planner I, St. Lawrence County Planning Office April, 1999 Fair housing is the law: it involves legal protection when housing choice is restricted on the basis of race, color, national origin, sex, religion, handicap or other protected class. Both intentional discrimination and actions and conditions that have the effect of limiting choice are prohibited. In order to obtain local compliance with Federal law, the Department of Housing and Urban Development (HUD) has had a long-standing mandate requiring state and local jurisdictions and housing providers receiving HUD funds to meet certain standards or take specific actions to affirmatively further fair housing. These have included passage of local fair housing laws, fair housing marketing requirements, tenant selection and assignment criteria, program accessibility, reasonable accommodations, and other activities. HUD requires local communities to certify that they affirmatively further fair housing as a condition of receiving Federal funds; HUD defines this obligation as requiring the grantee to conduct an analysis to identify impediments to fair housing choice within the community; take appropriate actions to overcome the effects of identified impediments; and to maintain records concerning the local analysis and activities.

How to reach FHLP
Fair Housing Law Project Fair Housing Law Project (FHLP) works with two other agencies, Project Sentinel and Asian Law Alliance, to fight housing discrimination in the City of San José. FHLP now provides representation to victims of housing discrimination in all areas of Santa Clara County. What is housing discrimination? A landlord, manager, home seller, real estate agent, or manager may not discriminate on the basis of:
  • race or national origin religion disability familial status (having kids) sex marital status sexual orientation age source of income (though discrimination based on amount of income is permitted) operating a licensed home day care other arbitrary characteristics not relating to rental or sale qualifications
Discrimination can include refusing to rent or sell, offering different terms (such as a higher rent), asking questions or making statements about the categories listed above, evicting or harassing a resident, or steering people to certain areas of the complex or certain neighborhood. Fair Housing is the Law in North Carolina

This year marks the 35th anniversary of the Civil Rights Act of 1968. That landmark legislation, enacted in the aftermath of the death of the Rev. Dr. Martin Luther King, Jr., sought to ensure equal housing opportunity throughout our land. Unfortunately, we have not achieved that goal, which remains important today.
"Fair housing" means that everyone may freely choose a place to live without regard to race, color, religion, sex, national origin, handicap or familial status. These rights are now guaranteed under both federal and state law. Some cities and towns in North Carolina have passed local laws that prohibit illegal housing discrimination.
Persons Protected
Fair housing laws protect persons who are discriminated against in their housing choices due to a protected characteristic (race, color, religion, sex, national origin, handicap or familial status). Also, these laws protect tenants who are injured because of the discriminatory practices against others based on race, color, religion, sex, national origin, handicap or familial status. Therefore, for example, you may have the right to file a fair housing complaint or lawsuit if your landlord doesn’t like the race or religion of your visitors and tells you to move because of these visitors.
"Familial status" includes persons who live with minor children and pregnant persons. Certain elderly housing situations are exempt from the requirement not to discriminate based on familial status.

Do not be afraid to just pick up the phone and call. (Of course, some landlords may retaliate for getting the government involved. This is probably illegal so long as you are caught up on your rent, but you still will have to deal with this problem as well. See Retaliation Many elected officials have staffs to handle calls just like yours. The government also has numerous agencies at various levels which might be able to help you (city, county, state, federal). Use them. Calling your city council person, Texas house representative or Texas senator is a good starting place if you do not know which agency to call. Housing Law Clinic
Taught by Fred J. Fuchs This Clinic is a joint project of the Law School and Legal Aid of Central Texas. Students represent low income families on their housing-related legal problems. The primary focus of the work is helping clients (1) avoid homelessness and (2) access affordable housing. Thus, a good deal of the work involves representation of clients in threatened evictions and in denials of public housing, subsidized housing and Section 8 housing. The clinic also involves representation of clients in other aspects of landlord-tenant law. Some opportunity exists for real estate related work on behalf of individuals and community-based nonprofit groups. In the past students have drafted deeds, earnest money contracts, affidavits of heirship and leases. Students are responsible for interviewing clients, investigating their cases, researching legal issues, negotiating with opposing parties, drafting pleadings and discovery in eviction cases, and representing clients at administrative hearings and in court. Although a good deal of the work has a litigation bent (e.g., negotiation, drafting pleadings and discovery), actual court representation has been limited in the past with students successfully settling their cases. (Four federal court lawsuits have been filed by Clinic students during the past three years, with students drafting the complaints and completing discovery during the semester.)
