Fair Housing
The Program The Federal Fair Housing Act, passed in 1968 and amended in 1974 and 1988, protects individuals and families from discrimination on race, national origin, color, religion, sex, familial status (meaning the presence of children in the home), and disability in all housing transactions, public or private. The Office of Fair Housing and Equal Opportunity (FHEO) of HUD is responsible for administration of fair housing programs and for processing fair housing complaints. The Civil Rights Division of U.S. Department of Justice is responsible for litigating on behalf of the federal government in cases of fair housing violations. As a result of the enactment of federal fair housing laws, all states and localities now have conforming fair housing laws. Much of the work to enforce the federal fair housing law is done by fair housing organizations. Private, nonprofit fair housing centers nationwide fight housing discrimination by providing education and outreach programs for both housing consumers and housing providers, investigating allegations of rental, sales, homeowners insurance, and lending discrimination, and conducting rental studies to determine the nature and extent of housing discrimination in the regions they serve. Program Intent The Fair Housing Act is one of the trilogy of federal laws that are the legacy of the Civil Rights movement that also includes the Civil Rights Act of 1964 and the Voting Rights Act of 1965. Legally sanctioned discriminatory housing practices created segregated and unequal neighborhoods and communities in all sectors of the country. Although no longer legal, residential segregation persists due to long-standing housing patterns and economic disparities. Besides its fundamental unfairness, residential segregation contributes to economic disadvantage by reducing access to jobs, transportation, and retail establishments. While overt discrimination in the housing market is less likely today, the promise of the fair housing and equal access to housing opportunities is remains unfilled as more subtle forms of discrimination protect deeply embedded resistance to racially integration.

Memorandum Of Understanding Among The Department Of The Treasury, The Department Of Housing And Urban Development, And The Department Of Justice Preamble The United States Departments of the Treasury, Housing and Urban Development, and Justice enter into this memorandum of understanding (MOU) in a cooperative effort to promote enhanced compliance with the Fair Housing Act (ACT) , 42 U.S.C. §§ 3601 et seq., for the benefit of residents of low-income housing tax credit properties and the general public. It is recognized that the Department of Treasury's (Treasury) Internal Revenue Service (IRS) is responsible for administering and enforcing the tax laws in the low-income housing tax credit program under § 42 of the Internal Revenue Code, 26 U.S.C. § 42. In accordance with § 1.42-9 of the Income Tax Regulations, 26 C.F.R. § 1.342-9, low income housing tax credit properties are to be rented in a manner consistent with the Act. Noncompliance of these properties with the low-income housing tax credit provisions is required to be reported to the IRS by state housing finance agencies under 26 U.S.C. § 42(m)(1)(B)(iii).

What Kentucky's Fair Housing Law Means
Kentucky's Fair Housing Law forbids discrimination in housing because of a person's color, religion, race, sex, national origin, familial status or disability. It is unlawful for a real estate operator, broker, or sales agent to:
  • refuse to sell, rent, lease or exchange real property for discriminatory reasons
  • refuse to receive or transmit good faith offers to purchase or rent.
  • deny any services or facilities relating to real property transactions
  • represent that real property is not available for inspection, sale or rental when in fact it is
  • retain a listing with the understanding that the seller plans to discriminate
  • discriminate in the terms or conditions of sale or rental
It is unlawful to coerce, intimidate, threaten, or interfere with any person in the exercise or enjoyment of any housing rights. It is unlawful for a financial institution to:
  • discriminate in the granting, rates, terms, conditions or services of financial assistance in real estate transactions

Stat. §§_52:27D-301 to -334, in order to satisfy "the constitutional obligation enunciated by the Supreme Court" in the Mount Laurel cases and to provide for "resolution of existing and future disputes involving exclusionary zoning" through "the mediation and review process" set forth in the Act rather than by litigation, and "to provide various alternatives to the use of the builder's remedy as a method of achieving fair share housing." ( Id. The heart of the New Jersey Fair Housing Act is N.J.
