Are school vouchers Constitutional?
In a word, no , at least when they are used to pay for sectarian education. Vouchers, since they involve direct government funding of private school tuition, violate the Constitution whenever the private school involved uses this money to pay for religious instruction. Since the passage of the 14th Amendment the Supreme court has gradually made most of the Bill of Rights applicable to the states. The states, in other words, must now obey the guarantees embodied in the Bill of Rights, including the Constitutional prohibition against establishment of religion. This article explains the history of Supreme Court decisions relevant to school vouchers since the passage of the 14th Amendment. Briefly, our position is that, even though the Supreme Court has not gone far enough in enforcing the prohibition of religious establishment (note our criticisms below), there is no question that, on the basis of the law, voucher systems and other schemes for providing direct financial aid to religious schools are unconstitutional. Research and writing by Susan Batte After the Fourteenth Amendment made the Establishment Clause applicable to the states, the Supreme Court became the final arbiter of whether states could support religious schools through either direct or indirect funding. Before the Court could even reach this controversy, however, it first had to decide cases that arose as a result of the public right to educate all children colliding with a parent's private right to educate his child as he deemed appropriate (

Supreme Court Ruling on Chapter 2 Aid to Parochial Schools Mitchell v. Helms , 120 S.Ct. 2530 (2000) The United States Supreme Court, in a 6-3 vote, held that Chapter 2 of the Education Consolidation and Improvement Act of 1981 does not violate the Establishment Clause. Chapter 2 allows local public schools to loan classroom materials to private and parochial schools. Using Chapter 2 funds, a Louisiana public school district furnished local private schools, a majority of which are parochial, with computers, computer software and library books. Plaintiffs sued on the grounds that this diversion of federal funds to parochial schools violates the Establishment Clause, which forbids the government from making any law respecting the establishment of religion. Using Agostini v. Felton , 521 U.S. 203 (1997) as it’s guide, the Court determined that the parochial school’s Chapter 2 program did not have the effect of advancing religion. What is the purpose of this program initiative?

This initiative seeks to 1) deter young adults from beginning or continuing drug abuse; and 2) identify young adults who are involved in drug abuse so that they may be directed into appropriate drug treatment programs. The goal of the program is to help children who need it, and to reduce the collateral social costs attendant to drug abuse, such as uneducated youth, youth crime and violence, spiraling health care costs, and teenage pregnancy. Why is this program important?
Drug abuse fuels many of society's problems - crime and the spread of communicable diseases from the sharing of needles are two major examples. Statistically, 8 out of 10 drug abusers started as teenagers. Too many of our young adults are being lost to the devastating effects of drug abuse by becoming addicts, career criminals, and unproductive members of society due to lack of education and job skills. The District attorney's office continues to witness the tragic results of these trends and to experience the heavy caseloads resulting from drug abuse. Innovative programs must be implemented to halt these alarming trends and insure a positive future for our youth and our community..

Supreme Court upholds aid to parochial schools
By Jerry Filteau WASHINGTON (CNS) - In what was quickly hailed as a landmark ruling for school choice, the U.S. Supreme Court has upheld use of federal funds to help supply computer hardware and software and library and media materials to religiously affiliated schools. By a 6-3 decision June 28 the court reversed the judgment of the 5th U.S. Circuit Court of Appeals, which had said it was unconstitutional to include religious schools among the private schools receiving such aid in Jefferson Parish, La. The case is titled Mitchell vs. Helms. Four of the six-justice majority proposed what in effect would be a new, simpler neutrality test for the constitutionality of public aid to private schools. Two justices agreed that the Louisiana aid was constitutional but sharply opposed the other four's view of how the court should test such cases. The three dissenters also opposed revising the neutrality test. Archbishop Francis B. Schulte of New Orleans said he was "elated" by the Supreme Court's ruling.

Court Rules 6-3 On Equipment For Religious Schools
On June 28, the Supreme Court ruled 6 to 3 that a federal program which places computers and other instructional equipment, such as software programs, library books, projectors and televisions, etc., in parochial schools does not violate the constitutional separation between church and state. The case, Mitchell v. Helms , originated almost fifteen years ago in Louisiana, where a group of taxpayers challenged the federal provision of library books and televisions to public schools. As education technology advanced, the case shifted its focus to computers and software. The Supreme Court has previously permitted students of religious schools to receive publicly financed textbooks, remedial classes and transportation. The ruling overturns two precedents forbidding aid to religious schools for maps, projectors and other equipment. While the ruling narrowly applied to computers and instructional material, Justice Clarence Thomas' majority opinion could be interpreted as indicating a broad support for more direct public aid to religious schools such as vouchers, with neutrality as the key to constitutionality: "….if the government, seeking to further some legitimate secular purpose, offers aid on the same terms, without regard to religion to all who adequately further that purpose, then it is fair to say that any aid going to a religious recipient only has the effect of furthering that secular purpose." Chief Justice William Rehnquist, Justice Anthony Kennedy and Justice Antonin Scalia joined in the majority.

The oil and gas industry plays a pivotal role in the state. Louisiana is the third largest U.S. producer of oil and natural gas and is a center of petroleum refining and petrochemical manufacturing. During the oil boom of the 1970s and early 1980s, oil and gas accounted for 30 to 41 percent of the state's revenue, adding $1.6 billion to state coffers in 1981-82. Times were good; there was little incentive for the state to diversify its industrial base. However, what was good for the state economy was not necessarily good for public education.

Melinda Billings Melinda Jeffers Billings is the Magnet Lead Teacher and Technology Coordinator at Ryan Elementary School. She has a B.S. in Early Childhood Education and she taught Kindergarten for 7 years. She will graduate in August with a M.S. in Educational Technology. She has been teaching Computer Literacy for five years. The past three years she has been teaching Broadcast Communications and produces a daily, live, closed-circuit television show staffed completely by students.
