ATTENDANCE The Board believes regular attendance in the school accompanied by the responsibility to study and participate in school activities is essential to the learning process. Once a pupil arrives at school, he/she is expected to remain and attend each class throughout the day. Elementary and secondary students shall be present the minimum number of days as required by the State Board of Elementary and Secondary Education and enumerated in the Louisiana Handbook for School Administrators, Bulletin 741, to receive credit for course taken. Exception can be made only in the event of extended personal illness verified by a physician’s statement or if other extenuating circumstances exist and are approved by the Supervisor of Child Welfare in consultation with the school principal. Whenever a student is absent from school for three (3) consecutive school days, each school shall attempt to verbally notify the student’s parent, tutor, or legal guardian. If such verbal notification cannot be provided, the school shall provide written notification of the student’s absence. All students shall be under the jurisdiction of the school during normal school hours; from the time the student arrives at school each day until he leaves the school campus in the afternoon.

Background:

Waste management has changed drastically in the last two decades. In 1980 Louisiana had more than 800 landfills; today it has 24. Act 189 of 1989 mandated a 25% reduction in municipal waste being land filled, and advocated recycling and composting of municipal and other wastes. Before that, there was little organized recycling of municipal waste, and up to 25% of the material going to landfills was yard and tree trimmings. Almost all of the sewage sludge went to the landfill without any thought of alternate disposal. Many rural residents burned garbage in drums behind their homes. Industrial waste was often stored in open pits, and residues from harvesting and processing agricultural and forestry products were piled on the ground or burned. CURRICULUM AND INSTRUCTION
Health Education
Revised Statute (1998) requires elementary schools to teach health education and secondary schools to provide instruction in alcohol, tobacco, drug, and substance abuse prevention and education. Revised Statute (1994) requires a minimum of 16 hours per year of substance abuse prevention education per year for grades K-9 and a minimum of 8 hours of substance abuse prevention education for students in grades 10-12. Revised Statute (1980) states that all public junior and senior high schools shall provide instruction to all female students in the proper procedure for breast self-examination and the need for an annual Pap test for cervical cancer, although no student shall be required to take such instruction if his parent or tutor submits a written statement indicating that such instruction conflicts with religious beliefs of the student. The Louisiana State Board of Elementary and Secondary Education formally adopted Health Education Content Standards in August of 2002 with Bulletin 103 . The standards document also serves as a suggested curriculum framework, although local schools are not required to adhere to it.

    A. REQUIREMENTS

    Because resident classification is an important part of fee determination, admission regulations and other policies of the colleges and universities, it is important that the University have fair and equitable regulations which can be administered consistently, respecting the interests of both the students and the taxpayers of Louisiana. It is the responsibility of the student to provide the institution with such evidence that is deemed necessary to determine residence status.
    B. DEFINITION OF RESIDENCY
    Adapted from the University of Louisiana System Board of Supervisors Regulations Published in the Louisiana Register , Vol. 10, No. 11, 11/20/84. House concurrent Resolution No. 226 of 1986.
    A resident student for tuition purposes is defined as one who has abandoned all prior domiciles and has been domiciled in the State of Louisiana continuously for at least one full year (365 days) immediately preceding the first day of classes of the term for which resident classification is sought. "Domicile,” as the term is used in the context of residence regulations, is defined as an individual's true, fixed, and permanent home and place of habitation at which the individual remains when not called elsewhere for labor, studies, or other special or temporary purposes, and the place to which the individual returns after an absence. A nonresident student for tuition purposes is a student not eligible for classification as a resident.

    The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
    There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters.
