Libya - Government
A summit meeting of North African Heads of State, held in Morocco in February 1989, concluded a treaty proclaiming the Union du Maghreb arabe , comprising Algeria, Libya, Mauritania, Morocco and Tunisia.
In 1994 Libya threatened to leave the UMA unless member states ceased to comply with
UN sanctions imposed on Libya, and in 1995 it refused to assume the chairmanship of the organization, owing to their continuing compliance.
In late 1988 tension between the USA and Libya increased after President Reagan stated that the US Government was considering military action against a factory at Rabta, outside Tripoli, where Libya was alleged by the USA to be preparing to produce chemical weapons.
In January 1989 an encounter occurred over the Mediterranean between US and Libyan military aircraft, in which two Libyan fighter aircralt were shot down.
Arab diplomats and the more pragmatic associates of Qaddafi had begun to urge a compromise over the Lockerbie issue, fearing that the imposition of further UN sanctions, particularly an embargo on sales of petroleum, would be disastrous for Libya.
In late June the GPC announced its decision to allow the two Lockerbie suspects to be tried a broad, provided that the proceedings were "fair and just". It suggested that such a trial might take place under the auspices of either the League of Arab States or the UN.

    Libya Government and Politics SWEEPING AND FUNDAMENTAL changes were introduced in Libya after Colonel Muammar al Qadhafi and his Free Officers Movement overthrew the Sanusi monarchy on September 1, 1969, and proclaimed the "Green Revolution." Because of the many radical and experimental policies that Qadhafi has tried to implement in Libya, he has been described frequently as a mercurial and quixotic leader. But while Qadhafi's policy making has been unpredictable, it has not been random or capricious. Rather, Qadhafi's political behavior has been dictated by his own elaborate and evolving normative political ideology, which he set forth in his three-volume The Green Book The essence of Qadhafi's philosophy is the Third Universal Theory, so-called because it is intended to be an alternative to capitalism and Marxism. The theory calls for the institution in Libya of what Qadhafi calls "direct democracy." In a direct democracy, as envisaged by Qadhafi, citizens govern themselves through grass-roots activism without the mediation or intervention of state institutions or other organizational hierarchies in the military, tribes, ulama, or intelligentsia. In an effort to implement direct democracy, Qadhafi altered or dismantled governmental and social structures. He launched a Cultural Revolution in 1973, instituted "people's power" in 1975, and proclaimed that Libya was a "state of the masses" in 1977. Finally, to emphasize his policy of decentralization, Qadhafi relinquished his own formal governmental position in 1979 and insisted he be referred to simply as "Leader of the Revolution."

    GOVERNMENT
    Libya’s political system is theoretically based on the political philosophy in Qadhafi’s Green Book, which combines socialist and Islamic theories and rejects parliamentary democracy and political parties. In reality, Qadhafi exercises near total control over the government.
    For the first7 years following the revolution, Colonel Qadhafi and 12 fellow army officers, the Revolutionary Command Council, began a complete overhaul of Libya’s political system, society and economy. On March 3, 1977, Qadhafi convened a General People's Congress (GPC) to proclaim the establishment of 'people's power,' change the country's name to the Socialist People's Libyan Arab Jamahiriya, and to vest, theoretically, primary authority in the GPC.
    Qadhafi remained the de facto chief of state and secretary general of the GPC until 1980, when he gave up his office. He continues to control all aspects of the Libyan Government through direct appeals to the masses, a pervasive security apparatus, and powerful revolutionary committees. Although he holds no formal office, Qadhafi exercises absolute power with the assistance of a small group of trusted advisers, who include relatives from his home base in the Surt region, which lies between the rival provinces of Tripolitania and Cyrenaica.
    The Libyan court system consists of four levels: summary courts, which try petty offenses, the courts of first instance, which try more serious crimes; the courts of appeals, and the Supreme Court, which is the final appellate level. The GPC appoints justices to the Supreme Court. Special 'revolutionary courts' and military courts operate outside the court system to try political offenses and crimes against the state. Libya’s justice system is nominally based on Sharia law.

    To tackle seriously the problem of human rights violations, including the detention/release dichotomy, at its grassroots, one should concentrate on bringing a minimum of reforms to the institutional structures of the state which, in its present form, allow every violation. Releasing 65 prisoners or 1000 is not a guarantee that other people will not be illegally jailed. The core of human rights problems in Libya lies in the structure of power, which generates gross abuses that constitute serious human rights violations. The “Jamahirya” system is structured in a way as to concentrate all powers in extremely few hands, with all powers ultimately held exclusively by President Qaddhafi or the “Leader”, as he likes to be called. The “Leader” is above the law of the land and above the institutions. He is neither accountable to the public nor to any other institution.
    The “Leader” has the power to interfere with everything, including the administration of justice by obstructing the work of the courts or by simply changing their judgement. He can also bypass the official judicial system by establishing special, field or emergency courts, the judgements of which he may alter or annul. There is no separation of powers in the “Jamahiri” system, which in turn means that there can be no legal or practical genuine safeguards to protect the citizens’ rights from State’s violations.
