What is the Year 2000 Problem?
This article will describe a practical approach for the legal organization (law firms, legal departments and other similar groups) to identify and address these Y2k problems. Where Do We Stand? Unlike most other human endeavors, addressing the Year 2000 problem is subject to an immovable deadline; while Y2k related problems may begin much earlier, January 1, 2000 is an absolute 'last date' for non-compliant systems. Though considerable and encouraging progress has been made, it is clear that, in business, government and other important areas of computing, we are behind in locating and fixing the breadth of Y2k problems which we face. History is also unkind, as our collective record in bringing computer projects in on deadline is spotty at best. How Do Lawyers Solve the Problem? The prescription for solving Y2k problems is straightforward. Identify your computer-supported functions (especially those which cannot be done without), learn which of those items has Year 2000 problems, and fix or replace those which you identify. In parallel with that process, identify alternative methods of performing absolutely critical functions, should best-laid plans fail, hidden flaws arise , or unknown outside factors intervene. This article will outline practical means and methods to accomplish these goals.

The State of Florida Office of the State Court Administrator and the Florida Supreme Court retained the services of the Legal Technology Institute to assess the Year 2000 readiness of the State of Florida State Trial Courts. There are 67 County Courts and 20 Circuit Courts in Florida. The Legal Technology Institute prepared a Four Phase Strategic Approach:
  • LTI prepared a "Y2K Resource Handbook for State Trial Courts" to provide the individual courts with educational information and resources to assess their Y2K readiness. LTI also published a "Y2K Initiative for State Trial Courts Newsletter", to help Trial Courts keep abreast of Y2K developments.
    LTI prepared two extensive survey questionnaires - one for Court Case Management Systems and Hardware and one for Court Desktop Systems and Hardware. The surveys were distributed to all County and Circuit Courts with detailed instructions. LTI collected all questionnaires and entered the data into a custom designed database for evaluation and analysis. A comprehensive written report was prepared and presented to the State of Florida Court Technology Commission, Florida Supreme Court, and the Office of the State Court Administrator.

Y2K: The Legal Liability Millennium?
by Doug Bandow Doug Bandow is a senior fellow at the Cato Institute and former special assistant to President Reagan. The coming new millennium means different things to different people. Some fatalists believe it presages the end of the world. Some religious people believe it portends the return of Christ. Some lawyers believe it promises yet another financial cornucopia. Hundreds of disputes over the Y2K bug have already been settled out of court and at least 100 lawsuits have been filed. Several are class actions. One plaintiff alleges everything but the kitchen sink: fraud and deceptive trade practices, breaches of express and implied warranties, and negligence. Moreover, a number of cases in states like California and New York have been dismissed without prejudice, meaning they can be refiled, since no injury has yet occurred. Come Jan. 1 they are likely to reappear, along with a flood of new actions. Presumably at least some software makers should be liable for at least some of the expense of fixing the Y2K bug. Yet the issue is complex. Given the cost of memory and perceived half-life of software at the time, designers could be seen as having acted reasonably.

In 1999, NACCB scored a significant legislative victory for IT staffing firms potentially saving millions of dollars in unnecessary legal fees from unwarranted and frivolous lawsuits due to Y2K failures. On July 20, 1999 President Clinton signed public law 106-37, the Y2K Act. This enactment largely removes mounting pressure over the impending Y2K computer crisis. The protections offered by the new law will allow NACCB member firms and their IT professionals to address Y2K problems with less fear of unwarranted and frivolous lawsuits. As stated in the Y2K Act, one of its purposes is to "establish uniform legal standards that give all business. . . incentives to solve year 2000 computer date-change problems before they develop." It is important to understand that this Act does not provide carte blanche protection from liability in cases involving Y2K remediation. However, there are a number of provisions that are important to the IT staffing industry and for which NACCB fought very hard. Before those are detailed, it is vital to ascertain whether specific cases that arise from remediation are covered under the Act. If you have questions regarding coverage prior to entering into a contract it is advisable for you to contact an attorney who can verify your legal standing. The following provisions are important to note, and were supported by NACCB: (1) pre-litigation notice requirements, (2) duty for plaintiffs to mitigate damages, (3) punitive damages limitations, and (4) proportionate liability protections.

    BAPR to undergo ABA review
    The Wisconsin Supreme Court recently accepted an American Bar Association (ABA) offer to review and evaluate the Board of Attorneys Professional Responsibility (BAPR), the supreme court agency that regulates lawyer discipline. The ABA Center for Professional Responsibility will conduct the evaluation in mid-July at no cost to the Wisconsin court system. The ABA's confidential report will be submitted to the supreme court by Sept. 7, in time for the supreme court's Sept. 14 public hearing on BAPR and the structure of Wisconsin's lawyer discipline system. A team of five or six experts from the ABA Standing Committee on Professional Discipline will conduct the evaluation. The team will spend approximately five days interviewing BAPR staff, board members and other volunteers, bar officials, complainants, respondents' counsel, and members of the Wisconsin Supreme Court and the judiciary. The team also will review court rules, reports, and statistics, and sample disciplinary files. BAPR Chair Sharren Rose welcomes the ABA review. "The BAPR board has previously considered using the ABA's services," she recalls. "This visit should be very helpful. The ABA team will provide useful input concerning how our system compares with those of other states and how we can do better. It's a healthy process that every agency should undertake regularly."
