Y2K Legal Issues:

First, we must recognize that the Y2K problem has been known to the computer industry since the late 1980s, and has been discussed in the general media since at least early 1996. Therefore, the problem was and is foreseeable, and with the investment of sufficient resources and the exercise of due diligence, presumably avoidable. This is a significant factor for legal analysis of the Y2K problem because as a general matter, whether you are considering contract issues, tort issues (i.e., negligent damage to property or personal injury) or insurance recovery issues, a claimant has a legal duty to prevent foreseeable losses, and to minimize damages to the extent that they are avoidable. Failure to take action to avoid foreseeable losses can forfeit your rights to recover damages caused by Y2K problems, or the right to recover your losses from insurers. Second, although there have been forty to fifty Y2K-related lawsuits filed in the United States within the last year to eighteen months, there have been very few court decisions issued. Many of the key questions about Y2K legal liability have yet to be answered by any court and lawyers must analyze these questions on the basis of general legal principles. A third general observation is that "contingency planning" is a necessary part of every Y2K program because you cannot and will not find all the problems. Beyond being good practical advice, a business that fails to include contingency planning as part of its Y2K program and thereby suffers serious disruptions of services and operations, runs the risk of being found to have a program that was seriously deficient and lacking in due diligence.

The media are replete with reports, information, and sheer speculation about what the Year 2000 (Y2K) computer bug will mean for society. It is difficult to project the actual effect Y2K will have on health care and on ORs. There are sufficient data, however, such that reasonable facilities, managers, and staff members should be taking action to identify and correct Y2K bugs in devices and systems used in patient care to the extent possible. Contingency plans should be formulated for worst case scenarios in the event that not all bugs are identified and corrected. The pervasive nature of computers and technology in health care and society's infrastructure means no individual OR nurse or manager can possibly address all the potential problems. We can expect, however, that perioperative nurses become active members of the facility-based teams addressing the potential problems and that they develop contingency plans that will work within their own settings. We can anticipate potential problems in patient data system software that may preclude the availability of accurate diagnostic and treatment results, as well as problems with microprocessor controls in basic infrastructure (eg, power and water, heating and ventilation) if they are not Y2K compliant. Data software and infrastructure systems are not the responsibility of perioperative nurses, but we should develop contingency plans for our areas should those systems fail.

You may think that only big business will be affected, but chances are that the problem may affect not only small to medium sized businesses but also individuals and households as well. 'Being affected' is only a simple way of putting it because you can be affected either as a person who has suffered loss or damage and you are seeking to find some remedies from somebody or you are that somebody who wishes to minimise the legal and economic risks that accompany these problems. What then is the Millennium Bug? Many computer systems are unable to cope with the change in dates from 1999 to 2000. The problem has arisen because computer programmers in the 1960s and 1970s represented years using only the last two digits (but not the century) in order to save computer space. This means that when the year 2000 arrives, computers may think that they have gone back in time to 1900 and therefore malfunction. Such a problem affects any electronic equipment containing a non-2000 compliant computer chip. While some equipment may continue to operate it may display incorrect dates.

Laferrera This article first appeared in the August 9, 1999 issue of Massachusetts Lawyers Weekly On July 20, 1999, President Clinton signed into law the "Y2K Act," legislation intended to curb the tidal wave of litigation many fear will wash over the nation as computers fail to correctly accommodate the transition to the year 2000. Public Law No. 106-37. The legislation has been considered, debated and amended in various forms by both houses of Congress for most of 1999, sparking considerable debate about the way in which year 2000 failures should be addressed by our legal system. This article will review the background of the Act and provide a detailed review of its provisions. Background Unlike last year's federal Year 2000 Information and Readiness Disclosure Act ("IRDA"), which is primarily intended to provide legal protection to parties who communicate about year 2000 issues, the Y2K Act establishes new rules for handling lawsuits arising from Y2K failures themselves. For instance, the Act requires a waiting period before the filing of a Y2K lawsuit, introduces new pleading requirements, alters the traditional rules of joint and several liability for damages arising from a Y2K suit, creates new contractual and tort defenses for parties defending Y2K suits, and imposes caps on punitive damages. The Act is far-reaching, imposing many new procedural and substantive requirements on Y2K actions filed in both federal and state courts.

It is nearly impossible these days to pick up a publication that does not somehow have an article dedicated to the Year 2000 (Y2K) problem. Media programs discuss the problem and forecast doom and gloom scenarios, while other stories focus on the impact the problem will have on businesses and government agencies. In the midst of all of these competing messages it often is difficult to discern what really are the implications of the Y2K problem for educational institutions and beyond that what can be done to minimize those implications. IMPLICATIONS FOR SCHOOLS There are a number of implications for educational institutions that may be attributed directly to the Y2K problem. When the Y2K problem does strike, it may result in financial, legal and administrative problems, not to mention the public image problem a Y2K failure may cause. Financially, costs to fix the Y2K problem are themselves very large. Schools and students reliant upon software that calculates subsidy, payroll and financial aid amounts have a vested interest in being assured those systems will still work after January 1, 2000. There also have been a number of lawsuits filed against companies that were unable to provide a service or whose product did not work because of Y2K problems. More such lawsuits are inevitable in the coming months. Many law firms are creating entire Y2K offices within their organizations to handle the anticipated litigation.

The Year 2000 Problem:
A Titanic in an Information Age?
Inevitably by now many have heard of the Year 2000 problem, or Y2K, but curiously many educational institutions are ignoring it. In the same way people denied the fate of the Titanic, people are denying the real threat this technology problem poses. While there are those whose warnings are extreme and lean towards a doomsday, that is not a reason to overlook the real impact this problem presents. But first, it is important to understand the two causes of this problem. The first stems from computer code that records a year with only two digits as opposed to four (98 instead of 1998). This practice was implemented early in computer application development in an effort to save money when data storage was expensive. The dilemma this poses for an organization is that many software applications and systems will fail or produce incorrect information when their applications read 00 as 1900 instead of 2000. While the second problem is more obscure, it affects everything from major application systems to simple spreadsheets. We have all been taught there are 365.25 days a year, and the accumulation of the fraction creates a leap year every four years. However, few people know the first year of any century is not a leap year, except every fourth century is counted towards a leap year. Because the year 2000 falls under this exception, some computers and software applications will launch March a day earlier than the rest of us.
