Appendix 2 Legal Services Attorneys Work With Public Housing Tenants to Obtain Rent Refunds and Credits by Richard Tenenbaum When Marsha Rhodes began her job as a security guard, her public housing rent was increased to reflect 30% of her new income. Due to a little-known rule, buried in a mass of federal regulations, however, Marsha has received a rent credit of $3,426. Marsha is just one of the many tenants throughout New England who may be eligible for a rent refund or credit based upon a federal provision mandating that public housing residents who secure employment and increase their income by participating in an employment training program receive no rent increases based on their earnings for 18 months after they get their jobs. Many tenants who have obtained employment have also been paying increased rents, and, like Marsha, may be entitled to rebates. Legal Eagles Find Provision Congress repealed the Aid to Families with Dependent Children public assistance program (AFDC), and it has been replaced by state-designed temporary programs. These new state programs generally require that recipients receive appropriate training and find jobs. For public housing residents, an increase in income means a corresponding increase in rent, equaling 30% of the additional income. Congress and HUD, therefore, took some action to mitigate the impact on families in which a family members has recently gone from welfare to work.

Which well-known housing advocate recently said, in discussing the implications of the recent repeal of the AFDC program: The absence of cash assistance, whether because of lower benefits, time limits, or sanctions tied to tough work requirements, may be most felt in housing, with increased eviction and moving, more doubling up and crowded conditions, and more violence-prone relationships. Stumped? None other than Mary Jo Bane, Assistant Secretary of the federal Department of Health and Human Services, until she resigned in protest at President Clinton's signing of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA). The most obvious way in which housing advocates must take account of welfare changes is that most federally subsidized tenants who are not elderly or disabled single persons or couples are recipients of Aid to Families with Dependent Children (AFDC) - now Temporary Assistance to Needy Families (TANF) - benefits:

Ambrogi For lawyers who work on behalf of the poor and disadvantaged, the Web provides critical support. Whether offering occasional pro bono services or devoting themselves full-time to public interest law, lawyers can use the Web to find practice guides, advocacy tools and legal updates. Last month's column looked at some of the broader, national sites related to pro bono and public interest law. This month's column surveys sites that focus on particular areas of practice, such as housing, welfare and mental health. Because the number of legal-service and public-service sites is so large, even this two-part column only scratches the surface of what is available. Virtually every legal services agency in every state has a Web site, as do the many bar-sponsored pro bono programs throughout the U.S. Space prevents including all of them here, but a comprehensive set of links to these sites can be found on the site of Maine's Pine Tree Legal Assistance From Housing to Welfare The National Housing Law Project is a national housing law and advocacy center based in Oakland, Calif. Our work has funding support through different programs; sometimes the funding requirements affect the kinds of services that the Advocacy Center can provide as well as the types of clients who can be served. The following are brief descriptions of the variety of programs and services which are part of the Advocacy Center.
1. The Federally Funded Programs
CAP (Client Assistance Program) For clients or applicants of Louisiana Rehabilitation Services who need assistance in securing rights guaranteed by the Rehabilitation Act. PAAT (Protection and Advocacy for Assistive Technology) For individuals in Louisiana who need legal assistance to obtain evaluations and appropriate assistive technology equipment or related services. PABSS (Protection and Advocacy for Beneficiaries of Social Security) For individuals who are beneficiaries of SSI/SSDI who are preparing for employment or seeking to obtain, maintain or advance in employment. PADD (Protection and Advocacy for Persons with Developmental Disabilities) For individuals with developmental disabilities in Louisiana who need assistance regarding education, legal rights, accessibility, public benefits, housing, legal status, juvenile issues and parental rights.

Housing Discrimination Legal Momentum is working to ensure that courts and government regulators recognize that discrimination against victims of domestic violence, sexual assault or stalking is unlawful sex discrimination under the Fair Housing Act and other civil rights laws. Housing: HOPE VI: The Right Paradigm for Affordable Housing Development? Topic: At the close of the 1990s, about one in eight American families were spending over 50 percent of their incomes on housing, while three in ten households were devoting at least 30 percent of their incomes to housing. At today's fair market rental prices, two-worker households earning the minimum wage cannot afford a typical two-bedroom apartment. Federal housing assistance still falls far short of relieving the severe cost burdens of the poorest households. The HOPE VI program represents a significant attempt by the federal government to integrate market, government, and social forces in response to America's housing crisis. In recent years, the program has become the chief instrument of an effort to improve the physical quality of public housing and to reduce the concentration and isolation of low-income families, encouraging Public Housing Agencies to retain experienced private developers to produce developments that attract middle income families to former public housing sites. In evaluating the success of this paradigm, panelists will envision the most promising responses to America's housing crisis. How well has HOPE VI been working? Do we care that Bush's 2004 budget is eliminating HOPE VI? Does improved provision of housing for poor Americans require a lesser or greater role for market forces than they play within the HOPE VI paradigm? Should the government have a lesser or greater role? Is the availability of social services for poor families really at the heart of success in housing development, whoever the provider?
