The issue of health plans merging, seeking joint ventures, or converting to for-profit entities has aroused considerable interest in recent years. This report looks at conversions and proposed conversions in other states with regard to the need for a clear legal process for the conversion; third party evaluation of the converting entity; a plan for the disposition of the assets of the converting entity; and well established foundations to manage the assets received by the State after the conversion takes place. RESEARCH
The Health Law and Policy Institute is committed to research and is actively engaged in the study of health issues affecting the state and nation. Each biennium since 1991, the Texas Legislature has appropriated special item funding to the Institute to study important issues of health law and policy. The Institute's studies on such issues as occupational injury and illness nonfinancial barriers to health care , and family violence and the health care system have helped to set the stage for legislative action. E-mail us at healthlaw@uh.edu for information about ordering these studies. 2002/2003 Health Policy Fellows In addition to its research for the Texas Legislature , the Institute has worked with other entities, such as the Texas Cancer Council , the National Institutes of Health , and the U.S. Department of Energy, on major research projects. From 1996 to 1999, the Institute coordinated the activities of the Texas Cancer Council's Managed Care Steering Committee, including furnishing speakers, tracking health care legislation at the local and national level, and providing the Committee with legal and policy research and briefing papers on a variety of issues related to managed care and cancer. The Institute monitored the development of Independent Review Organizations and health plan report cards. The Institute worked with the Committee on the development of three employer- and consumer-oriented publications: Small Employers Guide to Health Care Plans Cancer and the Law: 1998 Choosing a Health Care Plan" Recently, the Institute was involved in a project that profiled local tobacco worksite ordinances in the absence of state policy regulation. University of Houston researchers surveyed 201 municipalities in Texas and analyzed their ordinances regulating exposure to environmental tobacco smoke. See the

Predicting the Consequences of Changing Legal Remedies Available to ERISA Beneficiaries
Carole Roan Gresenz, Deborah R. Hensler, David M. Studdert, Bonnie Dombey-Moore, Nicholas M. Pace In November 1997, the President's Advisory Commission on Consumer Protection and Quality in the Health Care Industry published a report entitled Consumer Bill of Rights and Responsibilities. The report outlines the rights identified by the commission as consistent with high-quality health care, including health plan information availability, provider choice, access to emergency services, consumer participation in treatment decisions, respectful and nondiscriminatory care, confidentiality of medical information, and fair and efficient resolution of complaints and appeals. Despite a flurry of legislative activity regarding patients' rights in recent sessions of Congress, new legislation has not yet been enacted into law. Rival patient protection bills vary in scope, but one particularly contentious element in many of them relates to the final right delineated in the Consumer Bill of Rights and Responsibilities that of fair and efficient resolution of complaints and appeals. Specifically, leading proposals contain provisions that would increase the exposure of health plans to civil litigation. These provisions either (1) decrease the federal protection against lawsuits under state law enjoyed by entities administering employer-sponsored health benefit plans, (2) supplement the remedies available to beneficiaries of employer-sponsored health benefit plans under federal law, or (3) do both. Either provision requires amendments to the Employee Retirement Income Security Act (ERISA). ERISA has been interpreted by the courts to limit drastically the remedies available to individuals who want to pursue legal action against employer-sponsored health plans.

Gary Sherman In the past four years, online legal and non-legal information has erupted on the many databases which make up the Internet Information from around the world is now readily available at our fingertips. With enhanced access to worldwide networks of data bases, citation problems have also emerged. What format should we use to cite online cases and other materials? Various legal and other professional organizations have been addressing these questions for several years. Most of the proposed formats are still in the draft stages. This is probably because the online electronic database networks are changing daily, and new questions arise almost as quickly. While the various organizations continue to refine recommendations for citation systems that will not totally disrupt the way we do business today, we need some kind of guidelines to cite the sources that many of us are already using. This paper provides interim guidelines for citation of legal and non-legal sources. It is a combination of suggestions from legal and non-legal professional writing groups, applied to the legal context. The guidelines are basic and general in nature, and can be applied to the Michigan Citation System, the BLUEBOOK format, or others used by attorneys. But first, a bit of history to understand the context in which these guidelines are proposed.

State and local public health officers need to be familiar with the legal requirements in their jurisdictions regarding isolation of infectious persons and quarantine of exposed persons. Although most states have laws to compel isolation and/or quarantine, procedures may vary widely from jurisdiction to jurisdiction. Key persons, such as legal counsel, judges, and policymakers, should be identified and made part of your jurisdiction's planning for SARS. Step 2: Plan "due process"
Procedural due process is implicated when the government seeks to deprive an individual of "liberty" interests within the meaning of the Due Process Clause of the Fifth or Fourteenth Amendment to the U.S. Constitution. Many states, through statute or regulation, have established specific administrative and judicial schemes for affording due process to a person subject to a quarantine and/or isolation order. Schemes in other jurisdictions may not directly address this issue.
