Employment Bulletin June 2002 NEWS RECENT CASES The world of work carries on, notwithstanding royal celebrations and football tournaments, and this month we take a look at genetic testing, race relations and whistleblowing. NEWS Genetic Testing Science fiction meets employment law this month with the publication of a Human Genetics Commission report on the storage and protection of personal genetic information. A specific chapter in the report is devoted to genetic testing and identifies two types of information that could be relevant in an employment context: 1. personal genetic information (eg family history) that suggests a risk of inherited disease; and 2. personal genetic information indicating that a person is susceptible to a particular occupational disease or allergic to a workplace chemical. The report recommends, amongst other things, that employers:
  • must not make job offers dependent upon applicants taking genetic tests; should monitor the health of employees by more direct means than genetic screening;

    At Long Last, Final COBRA Notice Rules Issued They've been imminent for months. Finally, the Department of Labor (DOL) has issued final notice rules under the Consolidated Omnibus Budget Reconciliation Act (COBRA). Employers' obligations won't kick in until the first day of the next plan year that starts after November 26, 2004. In the interim, the DOL says it will consider employers to be in good faith compliance if they abide by notice requirements in last year's proposed regulations. AHI will be presenting an audio conference on the impact of these final regs, as well as other issues that cause employers confusion when administering COBRA. Please click here for details.

    Two reports have just been published by the UK Centre for Economic and Environmental Development, providing the results of a major study into the impact of telework in five western European countries. The study found a wide range of benefits - both for companies employing teleworkers and for teleworkers themselves. These included better productivity, increased job satisfaction, improvements in employee health and an enhanced work-life balance.     The latest manpower study carried out by Statistics Denmark has revealed a decline of 44,000 full-time jobs and an increase of 56,000 part-time jobs over the last quarter.
