Stuart Biegel has been a member of the faculty at the UCLA Graduate School of Education and Information Studies since and at the UCLA School of Law since 1989. Biegel is a recognized expert in the fields of Education Law and Internet Law, having completed major works of scholarship in both areas. His education-related publications include an exploration of Fourteenth Amendment rights (Cornell Law Review), an overview of church-state issues (American Journal of Education, University of Chicago ), a retrospective on bilingual education (Chicano-Latino Law Review), and an analysis of school choice policy under Title VI (Hastings Law Journal). His Internet-related publications include a recent book on cyberspace regulation (MIT Press). cyberlaw issues in education. In addition to his teaching, scholarship, and ongoing appearances at selected conferences, Biegel has been a prominent commentator on both education and Internet-related issues in both the traditional and the online media. Abstract
Space and Time
[FN 2] Nicole Stegner [FN 3] [FN 4] As the form of information changes from something tangible to something electronic, changes will occur in legal institutions and processes that have been oriented around particular physical spaces, and in legal concepts and doctrines that have depended upon a relationship with a particular space. [FN 5] became part of popular culture, Innis asserted that "the materials on which words were written down have often counted for more than the words themselves." [FN 6] Innis argued that while public attention is often focused on the content of the new medium, the key to understanding long term change lay elsewhere, particularly in how a medium either permits or hinders communication over space and either encourages or discourages the preservation of information over time. [FN 7] More than this, the law might be said to have a "sense of place" or be "of a place" in that there are informational places that are central to the process and operation of law. Law libraries are an obvious example of a legal information place, but so are individual items, such as books, or even artifacts, such as contracts. For such physical information places, however, the new technologies facilitate access or create new relationships with information by overcoming physical limits associated with the walls of the library, the binding of a book, and even the margins of a page.

Courts around the globe are being asked to apply traditional defamation laws to the novel legal issues presented by the new media and technology of the information age. Cyberspace is widely regarded as potentially fertile ground for defamation suits. Electronic bulletin boards, for example, now enable individuals to publish worldwide, without the benefit of any editorial checks, to potential audiences of thousands. Such messages can remain on the computers of subscribers for weeks, be printed, downloaded, and republished in e-mail. Electronic messages tend to be written in a less formal style than other communications and frequently address controversial issues. Indeed, some newsgroups are dedicated to gflamingh, the practice of posting messages which are particularly insulting or provocative and often blatantly defamatory.
