The Viability of future legal challenges to CIPA
Background
(United States v. American Library Association, application of the law in public libraries and school libraries. As such, the Supreme Court decision upholding CIPA does not foreclose future legal challenges to CIPA. In fact, some of the opinions in the case by Justices who upheld the law actually encourage future legal challenges if the application of the law creates limitations on free speech for adults. Typically, when the Supreme Court decides an issue, their decision is the final word on a legal issue. However, the decision in this case is unusual in that the case only decided the text of the law did not include provisions that, based on the way in which they were written, would clearly infringe on the First Amendment right of freedom of speech. The decision did not address whether the application of the law would also avoid infringing on constitutionally protected rights of free speech. Future legal challenges to CIPA, if they occur, would be based on the application of the law in public libraries and could potentially be raised by library patrons or by professional library organizations.

Securing Equal Justice for All: A Brief History of Civil Legal Assistance in the United States by Alan W. Houseman and Linda E. Perle. This document chronicles civil legal assistance for the low-income community in the United States from its privately funded beginnings, through its achievement of federal funding, to its expansion and growth into a national program operating throughout the United States. It also describes some of the political battles that have been fought around the legal services program and the restrictions that have come with government funding. It concludes with some brief thoughts about the future. (Publication No. 03-76). Fact Sheets: Every Door Closed: Barriers Facing Parents with Criminal Records. An Action Agenda. Each year, approximately 400,000 mothers and fathers finish serving prison or jail sentences and return home eager to rebuild their families and their lives. As these parents struggle to make a fresh start, they encounter many legal barriers that will make it very difficult for them to successfully care for their children, find work, get safe housing, go to school, access public benefits, or even, for immigrants, stay in the same country as their children. This new set of 8 two-page fact sheets, a joint project of CLASP and Community Legal Services, Inc., of Philadelphia, details the scope of the challenges these families face and offers solutions for federal, state, and local policymakers.
