Access to Local Authority Education Records
of Children with Special Educational Needs

Written by Derek O'Carroll, Advocate. Parents and pupils may have a right to access to information about a child with special educational needs which information is held by the education authority (the "EA") for education purposes. This leaflet explains who can get access, to what records, when, and how much it costs. It also explains the exceptions and gives the legal references. It is a short guide only and is not a substitute for detailed legal advice. RIGHT OF ACCESS TO THE RECORD OF NEEDS WHO CAN GET ACCESS
  • parent of the recorded child or the recorded child himself (if the EA are satisfied that he can act on his/her behalf)
  • a "named person": (a person nominated by the EA to advise the parents of the recorded child (such as a psychologist))
  • a children's panel reporter
The following people may also have access to the Record of Needs (except for the comments made by the parent or recorded child) if the EA are satisfied there is a good reason for doing so.
  • a teacher concerned with the special educational needs of the recorded child
  • a social worker
  • a local health board official
  • a researcher (the name of the child cannot also be disclosed in this case unless essential to the research)
  • any other person (but only if the parent or child (if capable of acting for himself) has agreed)
If a copy or extract is given to any person other than the recorded child or parent, the EA can demand return of the copy or extract at any time.

The liability, rights and responsibilities of school personnel in maintaining a safe school environment are affected by a variety of local, state, and federal statutes, regulations, constitutional requirements, and judicial decisions. School policies also may play a key role in establishing liability and affecting the responsibilities of school personnel. Schools seeking to avoid liability for acts related to school violence, including the steps taken to prevent it, should become familiar with the legal requirements. The following pages offer a foundation to begin a legal audit of schools' current policies and practices for reducing school violence. The following list of legal considerations is not comprehensive. Before acting on any of these issues, consult with legal counsel.

Background to this Paper
On 28 August 1995, the then federal Attorney-General, the Honourable Michael Lavarch MP, asked the Australian Law Reform Commission (ALRC) and the Human Rights and Equal Opportunity Commission (HREOC) to inquire jointly into children and the legal proc ess. Our terms of reference are reproduced in this Paper. The ALRC is a federal statutory authority that examines, by referral from the Attorney-General, legal issues requiring reform. It makes appropriate recommendations to the Attorney-General and the Parliament. HREOC is an independent federal body with a variety of investigative powers to promote and protect the human rights of all people in Australia. HREOC can examine alleged infringements of human rights and make recommendations to remedy those infringements. Throughout this paper, the ALRC and HREOC will be referred to collectively as the Commissions.

Access — The right to visit and spend time with children or grandchildren. Affidavit — A written statement which is sworn before a Notary Public, Commissioner of Oaths or a Barrister as being the truth. Affidavits are included in most applications to the Court and set out the facts which the court must know in order to make a decision. Adjournment — Temporary delay of a legal proceeding. Adultery — Sexual relations between a married person and someone other than their spouse. Appeal — Review by a higher court of a decision made by a lower court. Child Support — Money paid by one parent to the other parent for the support of a child or children.
