Medico-Legal Investigation of Death Where death is not due to natural disease, most countries have legal procedures for investigating the cause of death. In England and Wales this is the 'Coronial System', whilst in Scotland such deaths are investigated by the Procurator Fiscal. In the US, many states have a coroner, whilst in others a 'Medical Examiner' system is in operation. In England and Wales approximately 200,000 deaths a year are reported to the coroner. Not all are referred for post mortem examination, however, an autopsy will be carried out in all cases where there are any suspicious circumstances, or suspected criminal involvement, as well as suicides, accidents and sudden or unexpected deaths. If a body is found where no doctor has been in attendance, the police will investigate and refer the case to the coroner. If there are no suspicious circumstances, the police involvement will usually cease. Any doctor may be called upon to confirm 'life-extinct', and in some countries that same doctor may also be able to issue a death certificate if he/she is satisfied from the history and circumstances surrounding the death. In this country, a doctor who has recently treated the deceased may issue a certificate if he/she believes that the death was due to the condition being treated by them, but if there is any doubt, they should refer the death to the coroner without issuing a certificate. In the larger metropolitan areas, such as London, Forensic Medical Examiners (FMEs), who are doctors specialising in clinical forensic medicine, may be the first person to attend a death, and they will determine whether the coroner should be informed.

    Judge and scholar Richard A. Posner speaks out on the Clinton impeachment, the Microsoft case, and nude dancing. Richard A. Posner might be the most important and influential legal thinker alive. A professor at the University of Chicago Law School since 1969 and a judge on the U.S. Court of Appeals for the 7th Circuit since 1981, he is the author or co-author of more than two dozen books, including Economic Analysis of Law (1973), which helped pioneer the thriving field of law and economics. He has also written hundreds of articles and book reviews, as well as some 1,800 judicial opinions. While economics informs his thinking, Posner is hardly a one-trick pony: He has addressed topics as diverse as cloning, rhetoric, Kafka, citation style, AIDS, euthanasia, literary theory, advertising, and ancient Greece; it's almost easier to list subjects he hasn't discussed. As widely esteemed as Posner is, he has also been widely attacked. Conservatives have questioned what they see as his moral relativism, as well as his skepticism that simple deductive legal analysis can lead to the "right" judicial ruling. The left objects to his attack on moral philosophy and his claim that there has been too much emphasis in the law on free-floating standards such as "fairness" and "social justice." And many on all sides have been troubled by his seemingly cold-blooded economic approach to human interaction, including examinations of rape, abortion, and the selling of babies.

    Hi everyone, I just want to make one point, and one point alone, very clear to all who have been embroiled in the recent debate over the Ku Kai change involving Matsuyama's Home Page. That point is this: We are a community, and as any other community, we have an established culture. Part of this culture is to ensure everyone has the opportunity to air their opinions whenever something comes along that may effect a significant population. The proposed change to the Ku Kai, most likely, would have affected many of the current participants in a variety of ways, had it been done without the opportunity to consider the ramifications and voice opinions. That was the basis for sending out the proposal for change. Never was their any intention or even an expectation that all of this legal chatter would take front row in the discussions. What I had hoped for was majority support, from current participants, for the proposed change to minimize the fall off of submissions to the Ku Kai. It seems that, in the end, this support is present. So, I expect the next Ku Kai to function as it always has, with minimal distraction and non-poetic postings. I am convinced to the highest degree that none of us will regret accepting this change. In fact, I'm sure that most of us will feel great satisfaction as a result of our willingness to give something back to our hosts at Matsuyama, while also expanding our opportunities to learn and grow as haiku poets.

    In the considerable body of literature devoted to legal writing, it is usually taken as a given that most lawyers write poorly. Since drafting is simply a form of writing used in legal instruments that seek to regulate conduct (principally statutes, regulations, wills, and contracts), it should come as no surprise that many commentators think that most lawyers draft poorly. I, too, have come to the conclusion, based on my experience drafting, reviewing, and negotiating contracts as a corporate lawyer in private practice, that many contracts are in fact inexpertly drafted and that almost all show room for improvement. I do not mean by this that drafters demonstrate a less-than-perfect grasp of the law or of transaction mechanics, though that may or may not be the case. I mean instead that many contracts, to a greater or lesser extent, are structured in a way that makes them less accessible to the reader and also use language that is less precise and efficient than it might be, in particular language that is unclear, wordy, archaic, pompous, or clumsyin other words, "legalese." Common drafting inefficiencies include gratuitous archaisms (such as the WITNESSETH that often precedes recitals); unhelpful use of verbs (in particular, rampant overuse of
