by Shoshana Felman The following excerpt constitutes the introduction and the first two (out of six) parts of the integral study; this opening, which includes a theoretical presentation of the project (and which precedes and leads into the concrete, detailed comparative analysis of the case and of the text) constitutes about one fourth of the integral study. We have deleted the footnotes for this electronic version. This paper will reflect on a famous case of law that has impacted on our timesthe O. J. Simpson (criminal) trialtogether with a famous literary text that bears, surprisingly, many resemblances to this contemporary case: Tolstoy's The Kreutzer Sonata. In both the legal drama of the case and in the literary drama of the text, what is at issue is a marriage that ends up in murder. In both, a jealous husband is arrested and is put on trial for the murder of his wifeand is acquitted. And yet the husband in Tolstoy's work acknowledges his guilt and is precisely telling us the story to explain not only why but how he killed his wife.

The German Judgments on Nazi Capital Crimes 1945-1999
Editors: Prof. Dr C.F. Rüter / Dr D.W. de Mildt The series Justiz und NS-Verbrechen / Nazi Crimes on Trial contains all of the postwar German trial judgments concerning Nazi crimes of a homicidal nature committed during World War II. The 22 volumes published previously in these series covered the West German court rulings for the 1945 to 1966 period. The publication of the series will now be continued covering the West German judgments handed down since 1966. Next, a new series will be published, entitled 'DDR-Justiz und NS-Verbrechen' and devoted to the East German judgments.
The East German series also includes the judgments regarding crimes committed during Nazi Germany's prewar years.
THE WEST GERMAN SERIES
OLD AND NEW
The publication of the first half of the West German judgments series (vols. 1-22) was completed in 1998 with the appearance of an index volume accompanied by a CD-ROM. The CD-ROM contains the full text of the 22 volumes, plus a retrieval function, which enables easy and systematic cross-text research of the judgments.
Old Besides the vols. 1-22 index and CD-ROM, there is also a preliminary index and systematic description of the judgments included in the second series. Finally, the editors of the series have also published an overview of all the trials, from 1945 onwards. This will help readers to find individual trials and basic information on each of them.

This is a great book. I like long books, but this one is short and sweet. Moves the story along, and explores the fascinating background to Lochner (including the history of the baking industry and the conflicts of interest to give but one example, the attorney for anti-union Lochner was in fact not an attorney and in fact was a union organizer in the past. Also discusses the Negative Rights (Substantive Due Process in law) doctrine and has a great bibliography.

July 28, 2003 The Trial of Jesus Leon Zitzer has a post up comparing Mel Gibson and historical Jesus scholars , which includes the comment:
Haim Cohn, an Israeli Supreme Court Justice in the 1960s and 1970s, published "The Trial and Death of Jesus" in Israel in 1968 and in America in 1971. While he didn't figure out the whole story (he left unresolved the stories of Barabbas and Judas), he did correctly explain the role of the priests who tried to save Jesus' life by a route independent of the one I used to come to the same conclusion. He performed an Einsteinian revolution in Gospel scholarship. Yet most scholars have ignored him and a few have disparaged him.
As it turns out, I've actually read this book, though it has been a few years, and I don't have it handy. Anyway, I don't have any comments ready yet, but watch this space for some discussion later this week about Haim Cohen's book, and about the trial and death of Jesus in general. In the meantime, you can read Leon. TrackBack
Comments This book is superb. At last a plausible reconstruction of what really would have happened. Why haven't more scholars reached these conclusions? What does this say? The Jewish leaders were innocent. Meanwhile visit Leon's site, it's quite superb.
