Note on the Legal History of Navassa Island

As a guano island, Navassa entered the territorial domain of the United States under contingent circumstances, and it is currently the only public land administered by the Interior Department that is also claimed by a foreign nation (Haiti). The following note outlines the legal history of the island and the U.S. claim.
Navassa is a two-square mile U.S. territory located in the Caribbean Sea, about seventy miles northeast of Jamaica and thirty miles west of Haiti (18 deg. 24 min. N, 75 deg. 01 min. W). The United States claimed Navassa Island under the Guano Islands Act of August 18, 1856. The Guano Act is currently embodied in federal statutes as U.S. Code, Title 48, Chapter 8, Sections 1411-1419. Section 1411 provides that:
Whenever any citizen of the United States discovers a deposit of guano on any island, rock, or key, not within the lawful jurisdiction of any other Government, and not occupied by the citizens of any other Government, and takes peaceable possession thereof, and occupies the same, such island, rock, or key may, at the discretion of the President, be considered as appertaining to the United States. In a letter to the U.S. Department of State dated November 18, 1857, an American sea captain, Peter Duncan, claimed Navassa for the United States under the Guano Act. A reply of the Secretary of State to Duncan in the archives of the State Department dated December 8, 1859, recognized Navassa as appertaining to the United States.

Abortion in Canada
A Short Legal History
The criminal code is amended to decriminalize abortions done by a doctor in a hospital after approval for the procedure has been given by a "therapeutic abortion committee" who has judged that a woman's life or health "would" or "would be likely" to be affected by continuation of pregnancy. No obligation exists for either doctors or hospitals to participate in abortion.
In the early 70's abortion is paid for by Medicare after initial statements that it would not be paid for by public funds.
Joe Borowski, former NDP Minister of Highways in Manitoba launches a court case asking that the 1969 amendments to the Criminal Code be declared invalid, and that the outlay of public money for abortion is unlawful because it contravenes the Canadian Charter of Rights.

When legal history is taught as a seminar, the professor and the students agree on a general broad topic of the law, papers are written on various aspects of the details of the general topic. The purpose of the legal history seminar is to give each student the opportunity to go into the historical background of a single point of current law. By having all of the students write within the same general field, it is hoped that the students will see various aspects of their own specific Ô h)Ԍtopic and of the general topic from different points of view. Also, the entire field will be put into a historical perspective. The course begins with a lecture on the general subject by the professor, then the students present their draft papers to the class for discussion and comment, and then the first draft is rewritten in the light of consultation with the professor and of the classroom participation from the other students.

by Lenny Flank (c) 2004 In 1957, the Soviet Union launched its Sputnik satellite, shocking the United States out of its intellectual complacency and dramatically illustrating the inadequacy of science education in the US. In response to the new "space race", Congress passed a number of laws like the National Defense Foreign Languages Act and the National Defense Education Act, instituting a crash program to bring American science education up to par. One of these new programs was the Biological Sciences Curriculum Study, begun in 1959, to produce new up-to-date biology textbooks. Written by professional scientists in their fields, the BSCS texts prominently featured evolutionary theory as the foundation of all the biological sciences. Within a few years, nearly half the high schools in the country were using BSCS biology textbooks, despite the fact that anti-evolution laws were still on the books in a number of states. In 1961, the Tennessee state legislature attempted to repeal the Butler Act, but failed after an acrimonious debate, during which one legislator equated evolutionists with communists: "Any persons or any groups who assist in any way to undermine faith in the teachings of the Bible are working in harmony with communism." (W. Dykeman and J. Stokely, "Scopes and EvolutionThe Jury is Still Out", New York Times Magazine, March 12, 1971, p. 72) In 1967, teacher Gary Scott of Jacksboro, Tennessee was fired for violating the Butler Act. He fought his firing in court and won, and the Butler Act was finally ruled unconstitutional by the Federal courts.

Introduction
The year 2001 marked the centennial of the first graduating class of the University of Washington School of Law . In celebration, the Gallagher Law Library has compiled a list of sources that contain historical information about the Washington legal community and the University of Washington Law School that are available in the Library. Below is an annotated list of those resources. Many of the titles are linked to their corresponding catalog records in MARIAN , the Gallagher Law Library catalog. The catalog records will provide further information about the availability of particular items, and the number of copies held by the Library. The historical collection can be a useful tool for academic and practitioner-focused research as well as a rich set of resources for tracing the careers of family members or colleagues.
Washington State Bench and Bar Collection
Arthur Beardsley was the head law librarian at the University of Washington School of Law from 1922 to1944. Dr. Beardsley was a lawyer, a librarian, and an historian. In 1939, Arthur Beardsley and Judge Donald A. McDonald began collecting newspaper clippings and photographs of Washington State lawyers and judges in an attempt to compile a history of Washington State's legal community. Dr. Beardsley used the detailed research to write a manuscript about Washington's legal history. The result of this meticulous research was a 42-chapter manuscript called

The Selden Society is the only learned society and publisher devoted entirely to English legal history. This includes the history of the law, the development of legal ideas, the legal profession, the courts and legal institutions, individual judges and lawyers, legal literature and records, the languages of the law, legal portraiture and costume; in short, researching the history of everything which is characteristic of our unique English common law and legal system. And because for most of the nation's history, the only continuous records have been legal records, there is in them a wealth of incidental information on every aspect of contemporary life and conditions to be found in no other source. The Society was founded in 1887 by Frederic William Maitland, with the support of the judges, the Inns of Court, the universities and the legal profession, in England, the United States and other countries. Queen Victoria was its first Patron and it continues to enjoy royal patronage. Membership: This now stands at nearly 1,700. It includes most of the major law and history libraries in the English-speaking world, as well as many leading national and university libraries in other countries. However most members are individuals: lawyers and historians, including many whose interest is amateur and who support the Society because of their sense of the importance of its work. We welcome new members. No formal qualification is needed; only an appreciation of the Society's achievement and a desire to be associated with its continuing work.

THE LEGAL HISTORY OF UTAH

Legal history describes the procedures and sanctions of an orderly society. Utah's legal history includes the laws, customs, ideas, institutions, and practices which have governed its settlers and citizens. Its legal history also includes economic, political, religious, and social developments.
The Native American inhabitants of Utah governed by custom and oral arrangement; their arrangements had slight influence on incoming white settlers and their institutions. Mormon pioneers settling in Salt Lake valley did so for the most part without offending Indian tribal rights since they settled in an intertribal no-man's-land. Likewise, Spanish civil law had little impact on white settlers in Mexican territory. Such a contract was short-lived anyway, since the Mexican War ended Mexican claims to Utah Territory shortly after Mormons settled Salt Lake Valley.
Early Utah law was introduced by Mormons into their communities, and consisted of a mix of divine law, natural law, state and federal laws, and Mormon practices. In time, an unwritten western common law would also emerge. Persons with legal skills were uncommon and not especially sought out until after the Civil War. However, early acknowledgment that government has a responsibility to supervise social and economic life resulted in the creation of a territorial legislature and the provisional State of Deseret in 1850.
For many years, Utahns relied on Mormon Church institutions for civil government. After the arrival of the Mormons in the Salt Lake Valley in 1847, an ecclesiastical council and a marshal directed municipal affairs. In December 1847 a General Council took over the affairs of civil government. Bishop's courts for local wards provided a judicial process, with ecclesiastical high councils serving as appellate courts. Bishops, stake high councils, and the LDS First Presidency officiated as courts. Police power was placed in the Nauvoo Legion, and law enforcement officers were appointed. Church tithes and offerings served as community revenues.

2350 BC: Urukagina's Code
This code has never been discovered but it is mentioned in other documents as a consolidation of existing "ordinances" or laws laid down by Mesopotamian kings. An administrative reform document was discovered which showed that citizens were allowed to know why certain actions were punished. It was also harsh by modern standards. Thieves and adulteresses were to be stoned to death with stones inscribed with the name of their crime. The code confirmed that the "king was appointed by the gods".
2050 BC: Ur-Nammu's Code
The earliest known written legal code of which a copy has been found, albeit a copy in such poor shape that only five articles can be deciphered. Archaeological evidence shows that it was supported by an advanced legal system which included specialized judges, the giving of testimony under oath, the proper form of judicial decisions and the ability of the judges to order that damages be paid to a victim by the guilty party. The Code allowed for the dismissal of corrupt men, protection for the poor and a punishment system where the punishment is proportionate to the crime. Although it is called "Ur-Nammu's Code, historians generally agree that it was written by his son Shugli.

I. Introduction Research in the history of crime and punishment requires the use of a variety of sources. Very often, it is necessary to consult sources beyond traditional cases and statutes. For this purpose, there are many finding aids, which can be used to locate pertinent primary materials. Also useful are topical treatises, bibliographies, historical compilations and online Internet sites devoted to the history of a particular subject. These secondary sources often also provide citations to primary and additional secondary sources. There are many, many more sources of information on this topic than can be listed here, so this guide gives only an overview of print, micro-media and Internet resources available to facilitate research in the history crime and punishment at the Georgetown University Law Center. Call numbers given are specific to the Edward Bennett Williams Library collection. The designation SPECL indicates the material is in Special Collections, and must be used there.

History The statutory precursor of the Subsequent Injury Fund, the Second Injury Fund, was created by Chapter 637 of the Acts of 1945 By Chapter 809 of the Acts of 1963 , Section 66 of Article 101 was repealed and re-enacted with amendments. One of the amendments to Section 66 abolished the Second Injury Fund and created in its place the Subsequent Injury Fund. In analyzing the Subsequent Injury Fund, the Court of Appeals in Subsequent Injury Fund v. Pack , 250 Md. 206, 308, 342 A.2d, 506, 508 said that its purpose was to persuade the employer to employ the handicapped individual , by limiting the liability, which the employer may otherwise have incurred. The Subsequent Injury Fund, funded by assessments imposed upon employers and insurers, by statute, would contribute the balance of the total award, so that the sum of the two payments would equal the compensation provided by statute for the combined effects of both the previous disability and the subsequent injury. In Pack , Judge Finan, speaking for the Court made an extensive analysis of the status of the Fund. The Court said: The narrow question, therefore, is whether the Fund is a "
