General legal history
Wisconsin's legal history is interesting and colorful, but generally unknown to the legal community or to the general public. This collection of articles explains the important role that the legal profession has played in the state development over the past 150 years.
Madison attorney and legal historian Joseph A. Ranney has worked to revive an interest in Wisconsin's legal history, authoring many of the articles in this collection. Anyone seriously interested in Wisconsin legal history should read Ranney's recent work, Trusting Nothing to Providence: History of Wisconsin's Legal System

Quota pars operis tanti nobis committur? - Seneca Memory - A practical quality which allows us to weigh what has already been done against what might be done now. Memory is therefore a key to responsible action....Romanticism is a fantasized version of the past. Unpleasant events and personal or national failures are erased, while comforts and successes are exaggerated. Or wrongs may be exaggerated and comforts and successes erased. On either side romanticism is intended to energize false hopes. In its most exaggerated form it denies the relevance of memory and constructs free-standing abstract ideologies. - John Ralston Saul what's new at this archive, the last modification having been made on 27 November, 2001 (always check what's new first!!), or go to the top of the archive

At the very least, this history can clarify some of the legal issues that countries that have very few restrictions on speech in general have adopted
http://users.telerama.com/~jdehullu/speech/sphist.htm
Legal History
Ariadne's Thread is designed to help you work out and defend your own views on the complicated subject of hate speech. The focus is chiefly on racist speech. Some fairly non-controversial history and commentary may serve as an introduction. Even this history, however, will show that what counts as hate speech is unclear, the rationale for protecting it varies, and American courts have been somewhat inconsistent in how they have dealt with the issues over the last 50 years. At the very least, this history can clarify some of the legal issues that must be resolved in order to develop a reasoned position on hate speech. In addition, there are closely related issues in moral and social philosophy that must be considered.
If we view the question on a broader scale, we discover that many countries besides the United States have considered the problem of hate speech, and some have adopted laws to restrict it. Even some countries that have very few restrictions on speech in general have adopted legal or constitutional restrictions on hate speech. In other words, many countries regard hate speech as having an especially poisonous effect on social life. In the United States, however, we have tended toward another view that emphasizes the value of unrestricted debate.
The First Amendment
The Constitution of the United States was drafted in 1787, ratified in 1788, and put into operation in 1789. The 10 amendments constituting the Bill of Rights were adopted in 1791. The first of these restricted the new government's powers with regard to speech and the press:

At noon on Jan. 9, 1878, leading lawyers from across the state assembled in the Wisconsin Supreme Court Chambers in the old Capitol in Madison to found a statewide organization of lawyers the Wisconsin Bar Association. On Jan. 9, 2003, the State Bar of Wisconsin, in celebration of its 125th anniversary, reenacted this founding meeting. The year 2003 also marks another significant milestone in Wisconsin's legal history: the Wisconsin Supreme Court 150th anniversary. The Wisconsin Legal History Committee, chaired by Chief Justice Shirley S. Abrahamson and State Bar President Pat Ballman, is steering the celebration of both anniversaries. Within these pages, you'll find events and activities commemorating the important role the legal profession, the organized Bar, and Wisconsin courts have played in the state's development over the past 150 years. You'll also find a collection of legal history-related materials written over time, plus new materials prepared in celebration of these significant legal anniversaries. Highlights

The message, smuggled out of Robben Island prison under great risk, read, "UNITE! MOBILISE! FIGHT ON! BETWEEN THE ANVIL OF UNITED MASS ACTION AND THE HAMMER OF THE ARMED STRUGGLE WE SHALL CRUSH APARTHEID!" Mandela, born in 1918, was the son of the chief of the Xhosa-speaking Tembu people. Instead of succeeding his father as chief, Mandela went to university and became a lawyer. In 1944, he joined the ANC, a black political organization dedicated to winning rights for the black majority in white-ruled South Africa. In 1948, the racist National Party came to power, and apartheidSouth Africa's institutionalized system of white supremacy and racial segregationbecame official government policy. With the loss of black rights under apartheid, black enrollment in the ANC rapidly grew. Mandela became one of the ANC's leaders and in 1952 was made deputy national president of the ANC. He organized nonviolent strikes, boycotts, marches, and other acts of civil disobedience.
