Sources of Information on New York Legal Ethics
Thorough research into legal ethics questions leads to a variety of sources. These resources include formal written codes of ethics; state and federal statutes, court rules, case law and administrative rules and procedures; opinions of ethics committees; as well as law review articles, books and treatises. Code of Professional Responsibility The New York Code of Professional Responsibility (the text of which was first promulgated by the American Bar Association in August 1969) was approved by the New York State Bar Association and became effective in January 1970. The code was last revised extensively in 1999 based on the work of the "Krane Committee." The Code was also revised in 2001.The most up-to-date and authoritative version of the code is found in the two annotated codes Judiciary Law title, McKinney's Book 29 appendix and volume 19A of the New York Consolidated Laws Service (CLS). Reference Sources AMERICAN BAR ASSOCIATION AND OTHER AMERICAN LEGAL ASSOCIATIONS The Association of Trial Lawyers of America Roscoe Pound American Trial Lawyers Foundation adopted the American Lawyer's Code of Conduct in 1982. This code is more strict than the ABA Codes, particularly on the subjects of confidentiality and initiating sexual relationships after the commencement of the attorney client relationship. The Model Rules of Judicial Conduct were adopted by the A.B.A. Standing Committee on Ethics and Professional Responsibility in August of 1990. This Code was adopted by the U.S. Judicial Conference at their September 22, 1992 session, and is referred to by them as the Code of Conduct for United States Judges. The Code of Judicial Conduct was adopted in 1972 by the American Bar Association House of Delegates to replace the Canons of Judicial Ethics which had been in force for nearly fifty years. FLORIDA LEGAL ETHICS* The Florida State Bar Association was formed in 1907 and a Code of Ethics was drafted, but not adopted. In 1911, a portion of the reciprocity laws that were in effect under the "Carpet Bag Constitution," were reinstated. In 1928 another board of law examiners was created and practicing law without a license became a penal offense. In 1936, the Florida Supreme Court adopted the American Bar Association Canons of Professional Ethics. In 1949, the Florida Supreme Court ordered an integrated bar. Shortly after that, the Florida Bar began issuing ethics opinions and began sponsoring institutes on ethics, because no law school, at that time, offered courses on legal ethics. In 1954, the University of Florida College of L aw began mandatory training in legal ethics and the University of Florida Law Review devoted an entire issue to the subject of legal ethics.

Introduction
Research on Legal Ethics requires some different tools than other areas of law. We cannot rely on the standard primary sources - constitutions, statutes and codes, administrative regulations, and judicial opinions. The only true primary sources for mandatory authority are (1) the state codes of attorney ethics (or professional responsibility) for the jurisdiction, and (2) case law. Other sources discussed herein are secondary, persuasive authority. For additional information about sources for research on legal ethics, you can consult Resources for Research in Legal Ethics by Todd W. Grant (Law Annex KF306 .G73 1992). For information about legal ethics resources in Massachusetts, see section 5.6 in Handbook of Legal Research in Massachusetts , Mary Anne Neary, ed. (Law Ref KFM 2475 H36 2002).

04/30/04: A federal district court holds that the Gramm-Leach-Bliley Act of 1999, which requires financial institutions to provide to customers notices about policies concerning certain personal information, does not apply to law firms. You can read about the court's decision here. 04/30/04: Pennsylvania's Supreme Court adopted a package of rules to allow for greater "multi-jurisdictional practice. PDF files of the court's ruling and the text of the changes are available here and here. These rules are modeled on ABA Model Rule 5.5 and 8.5. 04/24/04: The American Bar Association's Section of Litigation's Task Force on Electronic Discovery Standards posted updated Civil Discovery Standards . The Task Force is soliciting comments, and intends to present the revised version of the standards in August 2004 to the ABA House of Delegates. 04/09/04: The Association of the Bar of the City of New York issues an ethics opinion on the ethical rules implicated by a lawyer's use of a domain name other than the firm name. "A lawyer or law firm may use a domain name that does not include or embody the firm's name or that of any individual lawyer, under certain conditions: the web site bearing the domain name must clearly and conspicuously identify the actual law firm name; the domain name must not be false, deceptive or misleading; the name must not imply any special expertise or competence, or suggest a particular result; and, it must not be used in advertising as a substitute identifier of the firm."
