INTRODUCTION
The rules that regulate lawyers' conduct are generally promulgated by the ABA and then adopted by states. The earliest standards adopted by the ABA were the Canons of 1908. In 1969/1970, the ABA adopted the Code of Professional Conduct. Many states adopted this Code. Some of these states switched to the Model Rules of Professional Responsibility when the ABA adopted them in 1983; others retained the Code. Thus, both the Model Rules and the Code of Professional Conduct are still published. They appear in several sources (see Standards and Opinions, below). Amendments to the ABA standards are noted in the annual ABA Reports and in the monthly ABA Journal . The ABA's Standing Committee on Ethics and Professional Responsibility and its predecessor committees have issued ethics opinions since 1924 (see Standards and Opinions, below) In Minnesota, the relevant rules are the

First Things 41 (March 1994): 21-27. Chicago's financial district and the seat of its city government are only a few blocks apart, yet they belong to two different worlds. I learned this in my first few months of law practice in 1964 when, as low person on the totem pole, I had to handle routine motions in both state and federal courts. There was scarcely any difference in atmosphere between my firm's sedate quarters in the Continental Bank building and the austere federal courthouse just around the corner. An aura of solemnity surrounded the federal judges in their courtrooms, as it did our senior partners in their spacious but simply furnished offices. Lawyers exchanged pleasantries and conversed genially in the hallways of both places. To walk from lower LaSalle Street to the municipal and county courts on Washington between Clark and Dearborn, however, was to pass through a culture warp. From the outside, Chicago's Civic Center on its massive concrete plaza was no less imposing than the federal building. Inside was bedlam. The Civic Center was filled with everything that made Chicago such an exhilarating and alarming city-jostling, shouting, joking, cajoling, backslapping, backstabbing, bargaining, dealing, favors granted, grudges paid with interest, intimidation, bribery, conciliation, grand gestures, obscene remarks, and the occasional spontaneous act of generosity. In the courtrooms, protocol was more or less observed, but the strain was often too much for the regulars. One young litigator from my firm never forgot his first appearance in municipal court. Full of himself, he stepped up when his case was called, and began, as we were taught to do in law school: "May it please the court, my name is Edward R. Lev and I represent the Continental Illinois National Bank and Trust Company of Chicago." The judge glared down at the unfortunate newcomer and remarked (to the delight of seasoned hands): "Well, bully for you!"

Course Syllabus Additional Readings Welcome to the course home page for Ethics of Law and Lawyering, as the undergraduate course is called, and Legal Ethics Seminar, as it is known in the law school, at Washington and Lee University. A Civil Action , did exactly that, by taking protracted depositions and by persuading the judge to split the trial into three separate proceedings. Others argue that the defense firms did nothing wrong, and Jan Schlictman's mismanagement of his law practice, not the "hardball" tactics of the defendants, caused his financial ruin.) We will talk about many similar dilemmas, all drawn from actual cases, during the course of the semester. This year we will take a somewhat different approach, and look at these questions first from the standpoint of jurisprudence the philosophy of law. The first major work we will read is Jeremy Waldron's Law and Disagreement , a recent book which seeks to explain the authority of law as a necessary institution in a complex, pluralistic society in which people disagree about moral questions. Although he does not address this question directly, we will use the book as the basis for constructing a theory about how we ought to understand the moral status of the professionals who make this system function namely, lawyers. Links to Primary Sources of Professional Responsibility Law Cornell Law School American Legal Ethics Library. An excellent collection of links to state bar association material (local versions of the Model Code and Model Rules, disciplinary opinions, bar admission information) and, in populous states, narrative overviews of the local law of lawyering, prepared by prominent law firms. There is also a topical overview, which collects disciplinary rules under subject categories (competence, conflicts of interest, and so on). All of the information is cross-indexed and interlinked with other pages for ease of use. This is a top-notch site, and should be one of the first resources you consult when conducting research on professional responsibility issues.
    Virginia Resources. For students and lawyers interested in Virginia professional responsibility law, there are excellent resources at the Cornell site, including the current Code of Professional Responsibility, the newly (Jan. 1, 2000) adopted Rules of Professional Conduct, and a comparison chart of the Code and the Rules. We are also fortunate to have access to an outstanding summary of Virginia ethics opinions , painstakingly prepared by Tom Spahn, a partner at McGuire Woods. LEOs are written based on a hypothetical set of facts presented by the requesting attorney and reflect the judgment of the committee. The opinions are not binding on any judicial or administrative tribunal. A legal ethics opinion applies ethics rules to a hypothetical set of facts and states whether the activity or conduct complies with or violates such ethics rules. The committee will not decide questions of law nor make any factual determinations. Also, the committee will not issue an opinion if a prior LEO is dispositive of the inquiry. Finally, the committee may decline to issue an opinion if the issue or question raised is the subject of collateral litigation or a pending bar complaint.

What Every Client Should Know About Legal Ethics
Have you ever wondered what ethical obligations lawyers owe their clients? Ethical issues came to the forefront for Colorado lawyers when the Colorado Supreme Court adopted the Colorado Rules of Professional Conduct, (effective in 1993), and Colorado lawyers had to learn a whole new set of ethical rules. Colorado's rules of legal ethics are more protective of clients than almost any other state's. The Rules are both written and enforced (in lawyer disciplinary or "grievance" proceedings) by the Colorado Supreme Court. This article introduces clients to some of the more important issues. The Client-Lawyer Relationship: The Rules recognize that the client establishes the objectives for the lawyer's representation. After consulting with the client, the lawyer may then determine the means of pursuing these objectives. There are a few limits on the client's choice of objectives. For example, a client may not ask a lawyer to violate the Rules or other law, and a lawyer may not counsel or assist a client in committing a crime or fraud (but may discuss consequences of the client's conduct). Some of lawyers' ethical duties to their clients are discussed below. Other important duties include competence, diligence, communication, and proper handling of client funds and legal fees. Confidentiality and Disclosure: Lawyers' general obligations of confidentiality to clients are probably stronger than ever, but so are lawyers' disclosure obligations in court cases. All information relating to representation of a client is now presumed confidential. The only exceptions are for disclosures expressly or implicitly authorized by the client, information necessary to prevent a crime the client intends to commit, and information necessary to use in proceedings concerning the lawyer's representation of the client. The Rules also impose disclosure requirements which may outweigh the confidentiality obligation in some circumstances. For example, certain necessary information must be disclosed in court proceedings, even if the client would prefer not to disclose. Both Federal and Colorado courts have recently broadened their disclosure requirements, requiring both lawyers and clients to disclose relevant facts and documents in court proceedings.
