Pro Bono Program

GENERAL RESOURCES
Pro Bono Definition

Pro Bono Program Pro Bono work benefits society and promotes a healthy community. Law students provide legal services to under-served populations or address important public issues without receiving pay or academic credit. In exchange, students benefit by gaining valuable skills, handling actual legal issues and working directly with clients. Most students report a tremendous sense of satisfaction gained from using their skills to help individuals in a tangible way. I. Program History and Purposes In 1995, the Student Bar Association asked law students whether they favored a mandatory "Pro Bono Graduation Requirement." Two thirds of the 217 respondents favored such a requirement. In the fall of 1996, the faculty unanimously approved a voluntary pro bono program. The full text of the Pro Bono Program approved by the faculty is attached as Exhibit "A," and is incorporated into these Guidelines by this reference. A pro bono component to legal education serves many purposes. First, it serves to introduce law students to one of the traditional aspects of the legal profession, public service, and to nurture at this earliest stage of their careers, the habit of sharing the skills and access to the courts which they are privileged to possess. Second, a pro bono component helps to fill the gap in legal services by providing a pool of pre-professional legal workers whose efforts make legal services more widely available. Third, a pro bono program counters the widely-shared public misperception that the legal profession is self-serving, vicious, greedy and insensitive. Fourth, students receive valuable exposure to clients and actual legal problems and learn hands-on problem solving.

About the Pro Bono Service Program
The Pro Bono Service Program is a new program which requires that all Harvard Law School students, beginning with the class of 2005, complete a total of at least 40 hours of law-related public service pro bono work as a condition for graduation. Our hope is that by giving back to the community, our graduates will develop a lifelong professional vision of how they can contribute to the public good. Students may work in programs that offer legal services to persons who cannot afford, in whole or in part, to pay for services, including non profit organizations, government agencies, and law firms doing pro bono work. Summer public interest work funded through the summer funding program can also count towards the requirement. Work at a law firm qualifies as long as the entire 40 hours is on a pro bono case and is uncompensated. The work may also be performed in a setting in which credit is given (clinical programs), in conjunction with a faculty pro bono project, in student-initiated projects, or in many of the HLS volunteer student organizations. Since this pro bono requirement is intended to teach law by experience, the student's work should involve the application or interpretation of law, the formulation of legal policy, or the drafting of legislation or regulations, and it should not be clerical in nature.

Cleveland State University's Cleveland-Marshall College of Law is combining law knowledge and community service through its pro-bono/community service program. Implemented two years ago when Steven Stein-glass became full-time dean, the program continues to attract students and earn national recognition in the process. Pamela Daiker-Middaugh, director of the program says, "It's part of every attorney's responsibility to give back to the community." She explains that the legal code of ethics says that attorneys need to be responsive to the needs of the community in which they live. Although the legal definition of pro-bono implies doing legal work for no cost, she explains that the term is used in this program to refer to a wide variety of services that students perform. Daiker-Middaugh says through this program the law school is carrying out CSU's broader urban mission by helping the city of Cleveland and its residents. Because many of Cleveland-Marshall College of Law's students will become future leaders in Cleveland and beyond, Daiker-Middaugh says that students should develop the habit to volunteer in neighborhoods and help those who are unable to help themselves. One continuous project at the law school is the Cleveland Bar Association/SPILO Education Initiative, ajoint program with the city of Cleveland and Case Western University College of Law.

  • Mission: Providing Individuals with Equal Access to Justice
The Pro Bono Program was developed in response to the growing need to provide legal services to the underserved. It has been estimated that there are at least 80,000 low income residents of Fairfax County. Those with legal problems cannot afford to pay for the services of a competent attorney. The Fairfax Bar Association and Fairfax Law Foundation support a vibrant and expanding Pro Bono Program which serves locations throughout the county. Volunteer lawyers, law students and paralegals help to staff the diverse projects. The Program is headed by a full-time Director of Pro Bono Activities, the only such position in the state of Virginia. Back to top
Some highlights of the Pro Bono Program:
    • Neighborhood Outreach Program:
Volunteer lawyers regularly go to sites throughout the county, such as homeless shelters and Family Resource and Community Centers, to provide free legal advice and referral information. The lawyers also have the opportunity to provide further assistance to resolve these cases, if they choose to do so. These locations are convenient, familiar and accessible to the clients who are often unknowledgable about how to access the justice system. The sessions are usually on weekday evenings and last approximately 2 hours. The volunteer lawyer usually participates about four times per year at a particular site. The Pro Bono Program offers free training and provides a comprehensive "Resource Manual" at each site.

This program offers students an opportunity to gain hands-on legal experience while making a difference in the community.
Students at all levels of learning and experience are encouraged to participate in the Center for Social Justice's Pro Bono Program. Students in the program donate a minimum of 35 hours of their professional time during a semester. Participation is noted on the student's law school transcript, and they receive special recognition at commencement.
Student volunteers have gained practical experience while assisting hundreds of disadvantaged people since the program was initiated in 1988. Our students report that their pro bono assignments have provided invaluable practical experience as well as tremendous personal satisfaction. Clients express gratitude for the services they receive, and our community has recognized the important services we provide.

The historical focus of our nationally recognized environmental law program is the stewardship of our air, land and water. Our Environmental Litigation Clinic offers students the opportunity to assist individuals and communities who are threatened with environmental harms, and who do not have the resources to obtain legal counsel. This value has permeated the law school’s ethos in recent years, with the establishment of John Jay Legal Services (JJLS), the Law School’s free legal clinic staffed by student attorneys admitted to the practice of law under the close supervision of full time faculty. Student attorney’s earn from two to six credits per semester as members of the clinical programs and externships that constitute JJLS, which includes:

Law school kicks off pro bono initiative
By Steve Gehrke Published: Thursday, January 15, 2004 First-year law students were introduced to the 2004 Pro Bono Initiative Program during the fourth annual kickoff Wednesday.
The Initiative was offered by the College of Law to promote public service in the legal field.
Co-coordinators JoLynn Spruance and Candice Rush helped create a jam-packed auditorium with pizza, drinks and guest speakers.
The program is instrumental in establishing an awareness among law students of the ethical responsibility to provide legal services for less fortunate members of the community, according to organizers. Through this opportunity, help is provided for people and organizations which otherwise could not afford legal assistance.
The students who volunteer these services often find themselves on the receiving end in the long run because of the opportunity to work with practicing lawyers. There is no shortage of such lawyers under the auspices of the initiative program, as an estimated 65 are participating this year.
Dean Scott Matheson opened the panel by praising past successes.

In October, the Federal Communications Commission (FCC) ruled that Bono's remark did not violate rules prohibiting indecent or obscene speech during broadcasts. The FCC reasoned that there was no violation because Bono was simply using the word "f" as a superlative, not in a sexual way. This month, during the Billboard Music Awards, "Simple Life" stars Nicole Richie and Paris Hilton were involved in the following exchange: Hilton told Richie, "Now, Nicole, remember, this is a live show, watch the bad language." Jokingly, Richie immediately exclaimed "F-!" She was bleeped. Later in the broadcast, Richie swore again, remarking, "Have you ever tried to get cow shit out of a Prada purse? It's not so f simple." This time, however, she avoided the bleep censor. Viewers heard her expletives loud and clear and some, especially parents of young children, were furious. Fox TV apologized, and has promised that it is "working to ensure it does not happen again."
