The 174-page document, filed June 3, attacks a U.S. District Court decision that said Microsoft violated a patent, owned by the University of California and its Eolas spinoff.

    Clinic Files Brief in Support of Supreme Court Review for Death Row Inmate
    amicus curiae brief with the U.S. Supreme Court in support of death-row inmate Thomas Miller-El's petition for writ of certiorari . This is the third amicus brief the clinic has submitted in support of Miller-El. Miller-El was sentenced to death in Texas in 1986, after the prosecution used 10 of its 11 peremptory challenges to strike qualified African Americans from the jury. Miller-El's appeals are based on the rule of Batson v. Kentucky , which prohibits racial discrimination in the exercise of peremptory challenges in jury selection. Last year the Supreme Court ruled 8-1 that the 5th Circuit Court of Appeals had refused to consider Miller-El's Batson claim based on a standard of review that was too demanding. It concluded that Miller-El had clearly demonstrated his case should be heard by the 5th Circuit. In March 2004 the 5th Circuit again ruled that prosecutors had not intentionally excluded African Americans from Miller-El's capital jury, which prompted the clinic and Sidley Austin to file the most recent amicus brief in support of the petition.

    Wireless network now at Law Library
    Laptop users who frequent the Law Library are now able to access the Monash network without plugging in to a wall outlet. ‘Wireless-Net’ – a facility that enables laptop users who have a registered wireless card to access the Monash network using wireless technology – has been installed in the first floor discussion room. Library staff and Law Library users alike have been eagerly awaiting the installation of this facility and are already making full use of it,” reported Law Library Manager, Lisa Smith. Library users who wish to access the Monash network in the Law Library using a laptop or PDA are advised to read the information on how to connect to the wireless network supplied by the Information Technology Services. Wireless facilities are also currently available in the Sir Louis Matheson Library, Caulfield Library, Peninsula Library and Pharmacy Library. Plans are underway to make the facility available at all branches of the library by 2005. For more information on laptop and wireless facilities in the library refer to the web page of the branch you intend to visit.

    Four men face criminal complaints under the Can-Spam Act for sending out millions of unsolicited emails for weight-loss products The US Department of Justice has filed a criminal complaint against four Detroit-area men under the federal Can-Spam Act, in the first case sparked by the legislation.
    In a filing on Wednesday in the US District Court of Michigan, federal attorneys contend that Daniel J. Lin, James J. Lin, Mark M. Sadek and Christopher Chung violated the terms of the Can-Spam Act by creating massive email campaigns that marketed fraudulent weight-loss products. The Can-Spam Act takes aim at individuals who create and dispense unsolicited and fraudulent email. Gina Balaya, a spokeswoman for the US Attorney's Office of Detroit, said Chung and Sadek were arrested and appeared in court on Wednesday. The men were subsequently released on unsecured bonds of $10,000 (£5,654). The two Lins have not yet been reached by authorities, she said. The criminal complaints are good for a period of 30 days, during which Assistant US Attorney Terry Berg will decide whether to seek an indictment.

    Britain is awash with 5.8GHz networks that aren't complying with Ofcom regulations, warn experts. But is the regulator relying on wireless operators to turn each other in? Companies and organisations across Britain are breaking the law by running high-speed wireless networks that don't comply with spectrum restrictions, a wireless expert warned on Tuesday.
    These networks are running at 5.8GHz without the safeguards introduced by Ofcom when the band was opened up, according to Paul Munnery, managing director of Wireless CNP, which designs and installs wireless networks. When Ofcom made the 5.8GHz band available to use under a "light-licensing" regime in December 2003, it ruled that network equipment had to include dynamic frequency selection (DFS) technology to minimise interference with military radar, because the Ministry of Defence already used the band, and transmit power control (TPC) to ensure that a network transmitted at the lowest power level possible. Munnery told the Wireless LAN Event in London on Tuesday that the companies using such networks without DFS and TPC could soon feel Ofcom's wrath.
