One year later, still no arrests in Yale Law bombing

Adam Henry

Friday marks the one year anniversary of the explosion of a bomb in an empty classroom at Yale Law School . In advance of that milestone, 1010 WINS reports today that despite an investigation that is still "very active," no arrests or indictments have yet been made , and none appear imminent. In happier news from New Haven, Yale Law reports that Professor Oona Hathaway has been named one of fifteen Carnegie Scholars in the Class of 2004. The Carnegie Corporation will provide financial support for her research project, "Between Power and Principle: A Political Theory of International Law," wherein she "will examine why states commit to and comply with international law." Joining Hathaway in the Class of '04 and also representing the legal academy is Professor Richard Pildes of the New York University Law School . With the Corporation's support, he will "research and write a book-length study on the relationship between democratic politics and constitutional law in the design of democracy itself."
Another NYU professor making law school news of late is leading constitutional law scholar Larry Kramer . Last Wednesday

[QUEERLAW] 01/23/95 majordomo@abacus.oxy.edu subscribe queerlaw QUEERLAW is a list devoted to discussion, analysis and promulgation of queer legal theory and all other aspects of sexual orientation and The Law. The idea behind the list is to facilitate discussion between a diverse number of assorted groups ranging from law professors and law students to individuals interested in how The Law affects, and is affected by, sexual minorities. QUEERLAW is intended to be a general (unmoderated) discussion mailing list. However it has a specific focus on topics related to *both* sexual orientation and the law. If you are interested in a moderated list you should consider 'gaylaw', the mailing list used for the publication of the National Journal of Sexual Orientation Law. This is an online legal journal dealing with sexual orientation and the law edited by Mary Sylla . The first issue is out and can be obtained at the Queer Resources Directory. If you do not know what the Queer Resources Diretcory is, send email to and a FAQ file will be sent to you automatically. You can also find out how to get a copy of the NJSOL by subscribing to the gaylaw list. To do that, you should send a message to

SUCCESSFUL FARMING reports USDA employees are using the Internet to prepare for emergencies, specifically a new web-based incident command system (ICS) training program. It "will help bolster resources to manage accidental or deliberate incidents that may threaten the US food supply, critical infrastructure or economy," says Agriculture Secretary Ann Veneman. The SOUTH CENTRAL TEXAS NEWS reports between 1999 and 2003, Cuba imported between 400,000 and 500,000 tons of rice. Vietnam shipped between 15-20% of the product. Rice is, also, shipped and purchased from Thailand. One problem for Cuba is that Vietnamese and Thai rice are of lesser quality than U.S. rice, but U.S. rice exporters can't do business in Cuba.

Privacy News Invasion of Privacy v. Freedom of Speech
The California Court of Appeal issued its opinion [PDF] in M.G. v. Time Warner, a case involving privacy rights and the California SLAPP statute. This is a case involving old media magazines and TV not Internet technology; however, the legal issues involved also pertain to Internet media and speakers. The Court held that in this case the claim of the individuals' whose privacy was invaded by the reporting of Time Warner overcomes the news medium's SLAPP motion. Supreme Court Diminishes Electronic Privacy The Supreme Court of the United States issued its opinion [PDF] in Barnicki v. Vopper , holding that a radio host cannot be sued for playing an audio recording of a cellular telephone conversation, despite a federal statute which made illegal both the interception of the conversation, and its disclosure by the radio host. The majority reasoned that the case pitted statutes banning disclosure of illegally obtained electronic communications against the First Amendment freedom of speech claims of persons with illegally obtained recordings to disclose them if their content pertains to a public issue. Senate Commerce Committee Holds Hearing on Muris Nomination The Senate Commerce Committee held a hearing on the nomination of Timothy Muris to be Chairman of the Federal Trade Commission. The hearing, which covered several other nominees as well, went smoothly for Muris, and all nominees. Republicans and Democrats expressed their support. Members questioned Muris about both online privacy and antitrust enforcement, but he said little in response.

6/2. The Senate Commerce Committee held a hearing on five pending nominations, including the nominations of Deborah Majoras and Jonathan Liebowitz to be Commissioners of the Federal Trade Commission (FTC). President Bush has nominated Majoras, a Republican, to replace Tim Muris as Chairman, and Liebowitz, a Democrat, to replace Mozelle Thompson. The hearing did little to establish these nominees' positions on technology related maters within the jurisdiction of the FTC, or their qualifications to be Commissioners. Most of the two hour long contentious hearing was devoted to gas prices on the West Coast. Ken Starr Says the Big Issue in the FCC's TRO and USTA II is Separation of Powers
