Two years ago, the U.S. Supreme Court launched a national debate over what candidates for judicial office should be able to say on the campaign trail. Today, the high court will consider a petition from a controversial New York judge who wants to continue and expand the debate, but has been thwarted by procedural obstacles in courts below.

Rehnquist's Olive Branch Too Late? Legal Times June 1, 2004 Responding to startlingly blunt criticism of the judiciary in recent months, especially from House Republicans, Chief Justice William Rehnquist last week created a committee to evaluate the federal judiciary's discipline system. Creation of the new committee was generally praised, and it may have taken some of the edge off the criticism from Capitol Hill. Same-Sex Marriage can Stay in S.F.

A San Francisco Superior Court judge on Wednesday brushed aside a call to disqualify the entire bench from same-sex marriage cases, saying the presiding judge's involvement in a suit over domestic partner benefits didn't create a conflict of interest. After a coordination hearing that lasted for about two hours Wednesday, Kramer concluded that cases that began as five separate suits one in Los Angeles should be coordinated in San Francisco Superior Court.

State Justices Take Up New Same-Sex Case
The Recorder The California Supreme Court on Wednesday unanimously agreed to review a gay rights case that raises questions about businesses' ability to discriminate based on marital status. The court also granted review in cases that could determine whether sex offender registration is required for someone who performs oral sex with a minor and whether lawyers and their experts could be disqualified from a case for failing to disclose they had obtained an opponent's confidential documents.
