Background
In Oct., 1998, Congress passed and President Clinton signed into law a new "sequel" to the unconstitutional Communications Decency Act. This new Internet censorship bill, the Child Online Protect Act (COPA, a.k.a. "CDA II") would establish criminal penalties for any "commercial" distribution of material deemed "harmful to minors". The numerous problems with this legislation include overbreadth, vagueness of definitions of key terms such as "commercial", an illegal attempt to force adults to give up privacy to excerise their right to read, prior restraints on publication, and a flawed "community standards" approach that would allow the most conservative jurisdiction in the US country to set the "decency" standards for all Web content nationally (indeed, globally). Just days after passage of this legislation, EFF in conjunction with the ACLU and EPIC (two other civil liberties organizations) filed a lawsuit challenging the constitutionality of this law and seeking to have it overturned. In 1999, A federal District Court issued a preliminary injunction against enforcement of the law, on the grounds that it is probably unconstitutional. On June 22, 2000, the Third Circuit Court of Appeals upheld the injunction. Back to Table of Contents

Women's Justice Center
The Pace Women's Justice Center is comprised of Pace law students and faculty, attorneys, and advocates dedicated to eradicating domestic violence and furthering the legal rights of women through skillful and innovative use of the law. The Center's goal is to give those who support battered women, the elderly, women with low income, and victims of sexual assault the legal tools they need to stop violence against women, seek economic justice, protect families and save lives. The Pace Women's Justice Center is a training, resource and direct legal services center. It creates and disseminates new techniques for legal intervention. Each year, we provide representation to hundreds of clients. Each year, we train dozens of law students and thousands of judges, attorneys, and others who work to eradicate injustice to women. Women's Division
The Women's Division serves as a national resource center to lawyers in providing protection for battered women and their children. Our work on domestic violence intervention includes legal training, scholarship and research, direct client work and public education.

    Liability
    Introduction Extension faculty frequently have questions concerning liability as it relates to their Extension assignment. This section of the module provides a brief overview of selected liability issues. After reviewing the liability section of this module you should be able to:
    • Describe the bases of liability
    • Describe protections provided by Florida law for University employees
    • Describe the procedures to follow upon receipt of a subpoena or lawsuit
    As employees of the University of Florida, Extension faculty have protection from certain actions taken during the course of their duties and responsibilities. This "official immunity" is provided through Section 768.28, Florida Statutes. This statute provides that "no officer, employee, or agent of the state or any of its subdivisions shall be held personally liable in tort or named as party defendant in any action for any injury or damage suffered as a result of any act, event, or omission of action in the scope of her or his employment or function unless the officer, employee or agent acted in bad faith or with malicious purpose or in a manner exhibiting wanton and willful disregard to human rights, safety or property." (Section 768.28)(9)(a), Florida Statues). As a result of this statute, the plaintiff's exclusive remedy in such cases of simple negligence is an action against the state agency, not against the individual employee.

    Mr. Chairman, distinguished members of the Subcommittee, I am privileged to speak to you today on the current status of existing anti-trafficking legislation. I have prepared a written statement; however, my remarks will be a brief summary of that statement. I have seven issues, which I would like to address. First, an anti-trafficking legislation must address all forms of trafficking . Here I would like to draw a distinction between commercial sex and non-commercial sex. Other forms of commercial sex besides prostitution, such as pornography and sex tourism, must be addressed by the legal system.     A report of the ad hoc Committee on Legal and Ethical Issues in the Treatment of Interpersonal Violence Table of Contents Introduction Section IV: Collateral Issues Section I: Professional roles Section V: Forensic Psychology ... Section III: Treatment This introduction provides a brief review of the issues faced by psychologists working in the areas of interpersonal violence. The problem includes the perception of a harassing backlash against psychologists who have been involved in interpersonal violence cases and issues. In particular, some psychologists who work with child or elder maltreatment, spousal / partner battering, and adults who recall memories of childhood abuse have been targets or personal and organized harassment. The forms of harassment have included personal threats and picketing of offices, media campaigns, as well as ethic and licensing board complaints and lawsuits. Psychologists who find themselves subjected to a nuisance or unsubstantiated grievance may experience vulnerability, loneliness, PTSD symptoms, or professional and financial consequences. They often experience isolation and secondary traumatization. Our committee was particularly concerned with various organized efforts developed to help alleged perpetrators of interpersonal violence and others pursue board actions, ethics complaints and nuisance lawsuits against psychologists who have served as therapist, forensic evaluator, expert witness, or client advocate for victims of interpersonal violence. Templates to file such complaints have been developed by various groups.     Law clinics confront tough issues

    Immersing themselves in contested child custody cases, adult and child orders of protection and child support hearings, students in the School of Law's Civil Justice Clinic learn effective lawyering skills and make a difference in the lives of neglected children and adult domestic abuse victims. "The clinic exposes students to people who are living in incredibly dire circumstances," said Jane H. Aiken, J.D., professor of law, who has taught the clinic the last two years. "The students become aware of the role that they as lawyers can have in rectifying those situations getting an order of protection to get the woman away from the man who is abusing her, helping her get into a shelter, giving her that lift so that she can focus beyond the day-to-day and find a way to change her life and the lives of her children." Working in small teams, the law students tackle six to 10 cases apiece throughout the semester. Each student spends a minimum of 24 hours a week in client-related work, from conducting fact investigation to interviewing and counseling clients to drafting pleadings. They also gain first-hand experience with pretrial and trial procedure, as they identify and interview witnesses, subpoena documents, conduct direct and cross examinations and negotiate settlements in the St. Louis City and County Family Courts.
