It’s a well-known fact that most small companies with limited budgets and multiple demands simply don’t think about hiring a lawyer until a problem develops. How and when does a startup or young tech company decide to choose a legal representative? Procrastinating or going cheap on this decision can cost your company dearly later on.
When do I need a lawyer?
You make the call. But even if you don’t engage a lawyer right away, it’s absolutely essential to obtain the services of a good tax accountant from the very start, said veteran Cleveland lawyer Ralph Scola. Many small companies rely on their financial advisor for certain legal matters—and that generally works for a while. But “you can’t represent yourself in a lawsuit if you’re a corporation,” said Mr. Scola. So, “if you’re going to form a corporation, get one.” Protect your IP. Any tech company’s first priority is protecting its intellectual property. But according to Mr. Scola, threats can come to any company in a host of disguises: a key employee goes to work for a competitor, you get sued, you sign a big contract and the client breaks it off, your vendors don’t deliver on a high-dollar deal, or they go bankrupt. Be proactive. To protect your business before problems develop, an attorney must know everything about how you do business—and that just doesn’t happen when you hire legal help on a bits-and-pieces basis. Instead, you can easily end up paying more when a problem does develop.

    It's the high-tech equivalent of a Tijuana divorce. When many Arizona couples decide to separate, they not only forgo hiring lawyers, they forgo visiting the court clerk as well. Instead, they make a quick stop at the local computer kiosk; a state-licensed software system asks the would-be divorcees for relevant information, then generates the court documents needed to present their case to a judge. The judge reviews the letter-perfect forms, hears the case - and presto: the bonds are broken. Welcome to the world of self-service law. Today, record numbers of citizens are engaging in pro se litigation (the Latin legalism for representing oneself in court) and other types of lawyer-free legal practice: wills, bankruptcies, incorporations, and basic contracts, for example. These basic legal tasks - long the bread and butter of many workaday attorneys - are fast becoming the province of do-it-yourselfers. But as more and more people try to navigate the legal system by themselves, will they stumble into legal quagmires without lawyers to guide them? And can the American legal system withstand an onslaught of enterprising amateurs? Probably so, says Gerry Singsen, Program Coordinator of the Program on the Legal Profession at the Law School. "Numerous studies have found that pro se litigants exercise pretty good judgment; they seem to have a pretty reliable sense of when they need a lawyer and when they don't.     There are a growing number of websites offering folks involved in divorce, child custody cases, and false allegations cases various "kits" to help them represent themselves. Some contain books; some have audio or video packages that come with them. Some even offer T-shirts, caps and coffee mugs. Some of them are offered by fringe dweller lawyers with failing law practices, some by disbarred lawyers and others by plain scam artists. All of them are a prescription for disaster. Whether they are offered for $9.95, $19.95, or something higher, folks you need a real LAWYER! Any advice to the contrary is bad advice. The law varies greatly from state to state. The law varies from time to time, what was law in your state last week may be changed today. Representing yourself in a matter as important as a divorce, a child custody dispute or a false allegation cases is beyond mere idiocy. It is world class stupidity. These issues are complex enough that not just any lawyer will do, much less somebody completely ignorant of the law and legal procedures such as the typical lay person.
