Domestic Violence Legal Issues Should be Incorporated Throughout Law School Curricula
Domestic violence legal issues should be incorporated into law school curricula as a core component of legal education. It may be easy to understand the benefits of raising these issues in clinical programs, which train students to represent or assist victims in the community. A more subtle need, however, is to alert lawyers to the ways in which domestic violence issues crop up in seemingly unrelated fields of law. Lawyers who practice any kind of family, criminal, tort, financial (including wills, trusts and estates, and tax law) or poverty law are likely to have cases complicated by domestic violence. Understanding how to spot domestic violence issues will assist lawyers to represent clients properly. Therefore, these issues must be raised not only in specialized clinics, but also throughout the curricula. Domestic Violence Legal Issues Should Be Raised in Core Curriculum Courses
Historically, domestic violence issues have not been raised in law school courses or addressed in mainstream legal journals. Traditional law school textbooks do not include domestic violence issues, and many law school professors do not incorporate domestic violence issues into their courses. Failure to address these issues penalizes all students. Regardless of the professional track a student chooses, it is likely that he or she will be faced with legal problems related to domestic violence as a practicing attorney. Since all students will benefit from an understanding of domestic violence issues, it is necessary to incorporate these issues into core curriculum courses.

A fellow member on the private-eye mailing list recently posted a message concerning the right way to open a recorded witness statement and what preferences should be used. This was in respect to his lawyer client pointing these things out as problems with the recorded statement:
My lawyer client felt that the problem I had with my preface was.......
A. That I did NOT offer the witness an opportunity to provide a written statement in lieu of an audio recording....on the recording itself.
B. That I did not record an advisory informing the witness that he was under no obligation to speak to me.
C. I did not TWICE seek the wit's specific consent to the statement.
When he first told me these things, I thought, like Julius thought, that something must have changed somewhere..... so I asked the other lawyer for his opinion. Like I reported in my orginal post... he did not see anything wrong with the way I was doing things. And once again, like Julius, I am still wondering if there has been a new decision..... or was my lawyer client just overly cautious.
Note that most insurance adjusters use this in their statement:

Definition of Witness
a) In domestic law: No definition of witness is provided in domestic law, though the duties and obligations required of witnesses can be inferred from statute, for example ss.155 and 291 of the Criminal Procedure (Scotland) Act 1995, and from the common law, as, for instance in the case of HMA v. Monson (1893) 21 R(J) 5. A co-accused is a competent but not compellable witness for another co-accused. In terms of s.266(9) a co-accused may consent to be called as a witness for the accused or may when giving evidence be cross-examined by the accused. Co-accused become compellable witnesses for both the Crown and Defence if they enter a plea of guilty or have been acquitted or the case against them has been deserted (s.266(10)). b) In European Law: No definition of witness is provided in the Convention but case law gives the term a broad definition, describing it as an "autonomous concept" (see Kostovski, Isgrò

Print Story Dr. Michael Plante was an obstetrician/gynecologist for Sinora Glenn. Following the hysterectomy, Mrs. Glenn went to a new physician, Dr. Charles H. Koh. Mrs. Glenn and her husband, Christopher Glenn, sued Dr. Plante for medical malpractice. In that same letter, though, he stated that he did not want to testify in court against another physician. After the Glenns filed their medical malpractice suit, the court held a scheduling conference, following which it entered a scheduling order. The Glenns listed Dr. Koh. As it progressed through the judicial process, the case was reassigned, for various reasons, among several judges. Ultimately, the Glenns asked the court for an amendment to the scheduling order, so they could have an opportunity to locate a more willing expert witness. Wisconsin Court of Appeals. The Glenns did not appeal from the denial of their motion to amend the scheduling order. The Court of Appeals noted that, under Wisconsin law, an expert witness can only be compelled to testify under compelling circumstances.

Abstract
The training, perspective, and motives of the engineer and of the lawyer differ in many respects. In these classroom exercises we explore these differences as manifested in the engineer serving as an expert witness in US courts of law. Some of the questions to be explored may be summarized thus:
  • What is an expert witness? What are some of the differences between the lawyer's motives and the engineer's duty that may affect how the engineer acts, or is expected to act, as an expert witness? Is the very function of the expert witness in conflict with the codes of ethics professed by the engineer?

To ethicist Margaret Somerville, a professor at the McGill Centre for Medicine, Ethics and Law and McGill's Gale professor of law, providing expert testimony is a duty that can help contribute a deeper perspective to issues faced in courts. Legal battles, after all, often bleed beyond courtrooms. Indeed, touchy court topics can create precedents that affect the general rules of law. "Courts are the Acropolis of the twenty-first century," she says, "where people are meeting and making decisions that will determine what will be the basic rules in society."

Load Time Is Crucial
The amount of time people must wait for your website to load will significantly affect how many of them stay to use your website. Be careful about your use of graphics some websites utilize very large graphics on their front pages, which can take a minute or more to load. Also, beware of eye-catching java applets, which can take a long time to load and may cause certain browsers to crash or hang. Your page should load in no more than twenty seconds for users on a dial-up connection.
Your Front Page Should Be Part Of Your Site
Be Careful With Your Background Images
Keep Differences In Platform In Mind
The intensity of your graphics will vary on Macintosh (where they will tend to appear brighter) and PC machines. Additionally, text size will vary, with text tending to appear slightly larger on a PC. If you are carefully paginating your text, make sure that the pagination works on both platforms.

Legal Disparities and the Child Witness
Laura Park, Ph.D. The ideal goals of our legal system are equality and fairness - “equal justice for all within an open, ordered, and impartial system” (Law Society of Upper Canada, 1996). A legal process designed for adults, however, cannot be applied to children’s cases under the assumption that adult and children’s testimonial capabilities are identical. Children, by virtue of their immaturity, bring both capabilities and limitations to the task of providing testimony. The law must reflect the reality that children are not miniature adults on the witness stand (Bala, 1991). In many ways the law recognizes that children are less developed than adults to understand situations and to make decisions and judgments as children are afforded a variety of special considerations designed to protect them by virtue of being a child.
