According to Federal Trade Commission regulations through the Children's Online Privacy Protection Act (COPPA), a Web site must get a parent's permission for children under 13 to disclose information. Also, remember that children under 18 should not be permitted to view information which is adult in nature. In addition, children under 18 may not be able to agree to contracts such as your Web site user agreement and purchase contracts. At Long Last, Final COBRA Notice Rules Issued They've been imminent for months. Finally, the Department of Labor (DOL) has issued final notice rules under the Consolidated Omnibus Budget Reconciliation Act (COBRA). Employers' obligations won't kick in until the first day of the next plan year that starts after November 26, 2004. In the interim, the DOL says it will consider employers to be in good faith compliance if they abide by notice requirements in last year's proposed regulations. However, the sheer number of cases underscores a critical reality for today’s industrial-organizational psychologist or human resource practitioner: it is almost inevitable that one or more elements of your organization’s performance appraisal system will attract legal scrutiny at some point in time. This likely scrutiny is particularly worrisome when considering the potential for jury trials, compensatory and punitive damages, and other burdens imposed in discrimination cases under the Civil Rights Act of 1991. favorable performance information that presents a risk of harm to prospective employers or third parties). Next, I take a closer look at substantive and procedural aspects of performance appraisals and the legal defensibility of employment decisions. I also examine discipline and related performance issues that arise under union and other employment contracts. I conclude with a discussion of emerging legal issues in performance appraisal such as those related to flexible job designs, security and privacy, and workplace violence. Kristina continues to struggle to find work, housing and to finish school, for both herself and her child. STATEMENT OF THE PROBLEM Young people who are on the streets are often there because of a long series of failures by those whose job it is to intervene and protect them. To make matters worse, the foster care system was set up to take infants and young children from neglectful and abusive homes and is not equipped to deal with the complex demands of adolescence. Although the child welfare and education systems are the greatest source of those failures, the legal system too is implicated in its failure to effectively advocate for the needs of adolescents and teenagers. Kristina faced a myriad of emotional, legal and survival challenges to address in order to gain the return of her child and to be able to provide a safe and stable environment in which to raise her infant:
