Therapist for Fayette schools files complaint
SAYS WHISTLEBLOWER ACT VIOLATED By Tracy Kershaw-Staley HERALD-LEADER STAFF WRITER
A Fayette County Schools employee has filed a complaint alleging that the special education director reduced her hours and salary to discourage her from reporting that two special needs students didn't receive proper services. Occupational therapist Carlotta Abbott says Peggy Blanton violated the state's Whistleblower Act in April when she changed Abbott's compensation, according to the complaint filed June 20 in Fayette County Circuit Court.

Posts: 72 What's an IEP? (and other special needs) My husband and I are being considered for the adoption of two siblings in Colorado (we're from Indiana, which I've heard has a tough person in charge of ICPC!).
Anyway, their profile is a little vague, so I was hoping someone could define the medical terms in "plain English" for us:
1. "The children's developmental challenges are met with an Individualized Education Plan." (What does this mean? Would they be behind academically, or is it physical/developmental?)
2. They "...have difficulty focusing on one activity at a time" and "take medication and receive therapeutic services." (For what? Adhd? Something else?)
3. They also "receive weekly physical, speech, and occupational therapies to help them with coordination, muscle tone, and speech impediments."

Staff shows optimism on plan for repair

Slightly more than half of Fayette County's schools failed to meet new federal goals, mirroring statewide achievement problems for low-income and disabled students. Twenty-six of Fayette County's schools didn't have enough students performing proficiently or better in math or reading to meet standards under the new No Child Left Behind law. Poor results from one or more subgroups of students such as low reading scores for Hispanic students or low math scores for poor children tripped up many schools. Sixteen elementaries, seven middle schools and three high schools will have to improve by next year to avoid federal sanctions. (Morton Middle School was not given an overall grade because of confusion over testing of students with limited English skills.) The percentage of students achieving proficiency on state exams had to meet statewide goals ranging from 16.5 percent to 47.3 percent, depending on the grade level and subject tested. Thirteen schools that otherwise would have failed met the goals with a statistical process the state used to account for possible errors in testing. The method boosted some results.

Should it? Considering this question from legal and moral standpoints, the author also shares the challenges faced by one student's family. Legal Issues Section 504 of the Rehabilitation Act of 1973 and the 1992 Americans with Disabilities Act may seem puzzling to the non-lawyer. Myths and half-truths abound. Some consultants and lawyers advise that schools and church buildings must be made totally accessible. Many board members and administrators fear that the cost of accommodations will be so high as to force schools and parish programs out of existence. Some school personnel continue to question accepting students with special needs. Can the average Catholic school provide the program adjustments needed by these students? This question should not be answered without a clear understanding of legal requirements. Discrimination Law Federal law prohibits discrimination on the basis of race, sex, disability, age, and national origin. Although discrimination on the basis of religion or creed is also prohibited, the right of religious institutions to give preference to their own members is upheld. Practically, this means that Catholic schools and programs may give preference to Catholic students and may give hiring preference to Catholic teachers and other employees.

Bills protecting young children, those with special needs pass House
A bill to protect young schoolchildren and students with special needs by making sure their classrooms are on the first floor or near exits passed the Kentucky House of Representatives yesterday. Rep. Tom Burch, D-Louisville, the primary sponsor of House Bill 81, said the legislation would ensure that the students would be in areas where they could easily exit schools during emergencies. Although the state fire code already includes the protections, Burch said many schools are not following the code. The bill would impress upon school administrators what is expected of them, he said.
