Whalen As we celebrate the landmark U.S. Supreme Court decision regarding civil rights in Brown v. Board of Education, it is important to remember the important role that Kentucky had in making the decision possible. In doing so, we should take a look the separate contributions of Berea College, Justice John Marshall Harlan and Justice Stanley Reed. The Supreme Court of the United States unanimously decided in May 1954 to not only outlaw segregated public schools but to outlaw separate but equal services or accommodations by the states. This decision by the Court overturned almost 60 years of "legal" segregation as authorized in the Court's decision in Plessy v. Ferguson. Of the three contributors only Justice Stanley Reed directly took part in the Supreme Court's decision in Brown v. Board of Education. In looking at Kentucky's contributions toward Brown v. Board of Education, we look first to Berea College in the foothills of the Appalachians in Berea, Ky. Berea College had been providing higher education for blacks as well as whites since the Civil War. In 1904, the Kentucky General Assembly passed legislation which prohibited colleges, schools or institutions from providing instruction to persons of the "white and negro race." The law also provided a fine of $1,000 for institutions that violated this law and an additional fine of $100 a day for violating the law after a conviction. Furthermore, anyone found teaching to whites and blacks would be fined $1,000 and $100 per day for each day of integrated instruction after an initial conviction.
