Refuses plaintiffs’ demand of $857 million Attorney General Phill Kline today reiterated his opposition to plaintiffs’ demand for an $857 million increase in state education funding, defending the constitutionality of the state’s school finance formula and the right of legislators and the governor to set funding policy.
"While the current formula might not be the best way to finance our schools, it clearly meets constitutional parameters," Kline said. "I will defend the legislature and the governor in their policy options and diligently work to prevent the dangerous trend of legislation through litigation."
The demand was the result of a 1999 claim filed against the state in federal court by the Salina, Dodge City, and other school districts. The mid-sized districts are demanding $857 million in additional annual school funding, claiming the current funding system discriminates against minority students and is, therefore, unconstitutional.
Kline said the $857 million demand, which would be in addition to the 52 percent of the state general fund budget now spent annually on K-12 education, was based on a funding study that in no way addressed racial deviations in funding. The fact that the settlement demand does not address the racial issues the plaintiffs raise undercuts the legitimacy of the discrimination claim, Kline said.

You also ask whether alcoholic liquor may be consumed by persons attending the function being held by the private association in the school-owned building or facility. The Hamilton Alumni Association has for several years been allowed by Unified School District No. 390 (U.S.D. No. 390) to conduct an annual reunion dinner and dance in a building owned by the school district. The only fee paid by the Alumni Association for use of the building has been to cover the costs of janitorial services required for cleaning the building. It has been alleged that alcoholic liquor was consumed on school grounds by persons attending the last Alumni Association reunion. In response to this information, you have advised the members of the Board of Education for U.S.D. No. 390 that the building remains property of the district during the time the Alumni Association conducts the reunion and that State law prohibits the consumption of alcoholic liquor on school grounds.

Fort Leavenworth History
In March 1827, the Adjutant General's Office in Washington, D.C. ordered Colonel Henry Leavenworth to set up a permanent camp near the junction of the Missouri and Little Platte Rivers. Colonel Leavenworth moved up the Missouri River with four companies of infantry and, on 8 May 1827, found a suitable area for a permanent camp. While waiting for official site confirmation, he started a tent camp. Small log and bark huts soon followed, built along what is now Scott Avenue, south of the Post Chapel. Permanent construction began around the Main Parade Area the following year. In September 1827, the site was approved and called Cantonment Leavenworth. Records show the strength of the camp as 14 officers and 174 enlisted men. Thus began one of the most important Army posts west of the Mississippi River. From here a branch of the Oregon Trail led up the steep hills away from the Missouri River. The huge corrals and supply yards for a branch of the Santa Fe Trail sprang up in this area. From here, traders and wagon trains began their long journeys to the West. When the Indian migration began in the 1830s, the post became the center of activities for Indian agents and found itself keeping peace among the tribes. The name of the post was changed to Fort Leavenworth in 1832. When the Mexican War broke out, the fort was used to outfit troops moving to the south. The post, under the command of General Philip Kearny, was the headquarters for the Army of the West. The 1850s were times of turmoil and bitter animosities in the United States. States' rights and slavery were the issues of the day when the territory around Fort Leavenworth opened for settlement in 1854. The town of Leavenworth was established in that year. At the beginning of the Civil War, the Army set up Camp Lincoln at Fort Leavenworth to muster men into the service, train them, and assign them to units for combat duty.

Introduction Special education funds appropriated annually by the Kansas Legislature are allocated to local school districts and cooperatives through a reimbursement system known as "categorical aid." The three components of this aid are: Transportation reimbursement (80% of actual costs) Catastrophic aid Special teacher reimbursement a. Professional FTE b. Paraeducator FTE c. Non-Public School Equivalency Funds for staff may be allocated on the basis of the number of full-time equivalent (FTE) positions, or on the basis of individual student contracts. Purpose The purpose of state special education funding is to supplement Federal allocations under the Individuals with Disabilities Education Act (IDEA), which currently funds approximately 12-13% of the total cost of providing special education and related services to eligible students. The Kansas Legislature has attempted to add to this limited Federal funding by allocating state funds in terms of a percentage of "excess costs," defined as the amount over and above the average cost of educating a student who is not receiving special education services.

SPENDING MYTHS EXPOSED
by Karl Peterjohn The final outcome of the 2004 Kansas legislature's fiscal battle is still in doubt. Recently the governor's proposed tax hike on property, income, and sales taxes sank like the Titanic in the Kansas house. March 11 the Shawnee Mission school district school finance proposal failed in the Kansas house too. This was despite a growing amount of lobbying coming from school spending growth advocates at the statehouse. Legislative observers are expecting another school finance plan to appear in the Kansas house soon, possibly as early as the week of March 15. Many legislators are still nervous about voting for higher taxes after their tax mistake of the destination sourcing mandate placed on retailers last year. An often overlooked factor in legislative opposition to more tax hikes in 2004 is the growing realization that so much of the "conventional wisdom" on state spending in general and school finance in particular is wrong.

For years the Police Department has kept such proceeds, despite a 1990 ruling by the Missouri Supreme Court requiring the proceeds to be distributed to local school districts. The funds generally must be distributed to the county treasurer, the state treasurer or the schools, depending on the source of the funds. In 1997 police filed a lawsuit asking the Jackson County Circuit Court to determine how the proceeds should be divided. The lawsuit claimed that different and often contradictory laws applied.

Adkins leaving Kansas Senate
Kansas State Senator David Adkins , Republican from Leawood, has decided not to seek re-election. Adkins was one of the few moderates left in the Kansas Republican Party, usually taking opposite positions on issues like abortion, gay marriage, concealed weapons, and school taxes. His district includes most of Northeastern Johnson County, and Adkins chairmanship of the Ways and Means committee gave him a lot of influence on behalf of the Kansas side of the metro area. Kansas ordered to close public schools
The judge has just dropped a bomb shell by ordering the state to close all public schools until the funding system is fixed. Late last year the judge gave the state a July 1 deadline fix the school funding formula, but the Legislature failed to deal with the issue in its just-concluded session. The state has already filed an appeal to the state Supreme Court, so no one knows yet when/if the closure might take affect. A charter school is an independent, publicly supported school. 2. Charter schools may be operated only in a metropolitan school district or in an urban school district containing most or all of a city with a population greater than three hundred fifty thousand inhabitants and may be sponsored by any of the following: (1) The school board of the district; (2) A public four-year college or university with its primary campus in the school district or in a county adjacent to the county in which the district is located, with an approved teacher education program that meets regional or national standards of accreditation; or (3) A community college located in the district. 3. A maximum of five percent of the school buildings currently in use for instructional purposes in a district may be converted to charter schools. This limitation does not apply to vacant buildings or buildings not used for instructional purposes.
