Mr. Chief Justice Warren delivered the opinion of the Court. These cases come to us from the States of Kansas, South Carolina, Virginia, and Delaware. They are premised on different facts and different local conditions, but a common legal question justifies their consideration together in this consolidated opinion. The plaintiffs contend that segregated public schools are not "equal" and cannot be made "equal," and that hence they are deprived of the equal protection of the laws. Because of the obvious importance of the question presented, the Court took jurisdiction. Argument was heard in the 1952 Term, and reargument was heard this Term on certain questions propounded by the Court. Reargument was largely devoted to the circumstances surrounding the adoption of the Fourteenth Amendment in 1868. It covered exhaustively consideration of the Amendment in Congress, ratification by the states, then existing practices in racial segregation, and the views of proponents and opponents of the Amendment. This discussion and our own investigation convince us that, although these sources cast some light, it is not enough to resolve the problem with which we are faced. At best, they are inconclusive. The most avid proponents of the post-War Amendments undoubtedly intended them to remove all legal distinctions among "all persons born or naturalized in the United States." Their opponents, just as certainly, were antagonistic to both the letter and the spirit of the Amendments and wished them to have the most limited effect. What others in Congress and the state legislatures had in mind cannot be determined with and degree of certainty.

Judge Orders Kansas' Public Schools Closed

TOPEKA, Kan. The state must close its public schools this fall while it fixes constitutional flaws in its system for distributing aid to those schools, a district judge ruled Tuesday in a case that is already under appeal to the Kansas Supreme Court. Video Judge Rules Kansas Schools Must Close The order issued by Shawnee County District Judge Terry Bullock anticipates he will soon issue a follow up restraining order preventing the spending of any money after June 30. That means the Tuesday's order will not affect the current academic year. Dan Biles, an attorney for the State Board of Education, said an appeal of Tuesday's order will be filed quickly, and could stay Bullock's order past the start of the new school year. A brief review of recent accomplishments will demonstrate that the vision of 1863 as well as the risk surrounding our founding was well placed. Ninety-three percent of our students are from Kansas. Last year, our overall headcount was up 3.5% and represented a 16% increase in first time freshmen. Recent data from the Office of Career Services indicated that 99% of our graduates from May 1999 were either employed or enrolled in graduate school. ESU truly is the Kansas university to educate Kansans for the Kansas workforce. The E-State business education student organization (Pi Omega Pi) has been among the top ten chapters in the country for the past 34 years.

Mary Clapp -The First Woman Regent in Kansas EMPORIA - Kansas Governor John P. St. John sent a letter on July 14, 1882, to Mrs. Dexter E. Clapp of Yates Center: "I write you first to assure you of my very deep sympathy with you in the loss of your husband, and my very good friend, and second to tender to you the appointment as your husband's successor as Regent of the State Normal School, with the hope that you may do me the favor to accept. An early reply will be very much oblige." The letter was signed "Your friend, John P. St. John."

This is an appeal by the United School District No. 501, Topeka,
Kansas (grantee) from determinations by the Chief, International Equal
Education and Procurement Management Division, Office of Education (OE),
that the grantee has failed to meet its proper share of the project cost

of a follow-through program for three periods commencing August 1, 1972,

Kathleen Sebelius' proposed tax increase isn't enough to fix the unconstitutional school-aid system, according to a lead attorney in the lawsuit that led a judge to declare Kansas school financing inadequate and tell lawmakers to spend an additional $1 billion. advertisement "It's kind of like giving a thimbleful of water to someone dying of thirst," said Alan Rupe, a Wichita attorney. "Of course, they are going to want it, but it isn't enough to solve the problem." Rupe represents the school districts that successfully sued the state over funding issues. In December, District Judge Terry Bullock of Topeka declared the school-finance system shortchanged students, especially minorities. He gave the Legislature until July 1 to fix the problems. Last week, Sebelius opened the 2004 Legislature by offering a plan to increase state income, sales and property taxes to bankroll a $304 million spending increase for schools over a three-year period.

THE COMMON SCHOOL SYSTEM. Kansas Territory having been organized May 30, 1854, its first Territorial Legislature passed a school law August 30, 1855, and from that date the history of the public school system of Kansas properly began. The Territorial System. - Its object is indicated by the statues of 1855, Chapter 144, Article 2, Section 1, which reads as follows: There shall be established a common school, or schools, in each of the counties of this Territory, which shall be open and free for every class of white citizens between the ages of five and twenty-one years, provided that persons over the age of twenty-one years may be admitted into such schools on such terms as the Trustees of such district may direct. No Exclusion Because of Color. - Section 71 of Chapter 8 of the laws of 1858, declares: All school districts established under the authority of this act shall be free and without charge for tuition to all children between the age of five and twenty-one years, and no sectarian instruction shall be allowed therein. This section continued in force during the remaining period of the Territorial existence of Kansas.

Opaa! Food Management announced that Center School District food service employee Julia Patterson has been selected as the recipient of its Employee of the Year Award for the 2003-04 school year. Patterson was presented the award during an all staff meeting on May 25, 2004, by Opaa! Executive Vice President Robert Sanders, Vice President for Operations, Sheila Middleton and Regional Director of Operations Judy Helm. It was the last hour of the last day for 13 art IV Center High School seniors. Their professional career as Center students was drawing to a close. Were they spending this final hour exchanging addresses, sharing summer plans, snapping photos? No. Mrs. Woods' art IV class was busy creating an enormous chalk masterpiece of legendary musician Charlie Parker with the assistance and guidance from professional street painting artists from LaStrada dell'Arte. This masterpiece also happened to be their final exam. There were lots of smiles and laughter between these seniors. However, they had a job to do and a job they did complete - just in time to celebrate! Swing by Mrs. Woods' art class to view the masterpiece.

ATTORNEY GENERAL KLINE TO BE FEATURED SPEAKER
AT CLAY CENTER D.A.R.E. GRADUATION
Phill Kline, Kansas Attorney General, will be the featured speaker at Wednesday evenings Drug Abuse Resistance Education (D.A.R.E.) Graduation ceremony to be held at 7:00 p.m.at the Clay Center High School auditorium.
"I am honored to have the opportunity to address and congratulate these young people for their commitment to live drug-free lives," Attorney General Kline said. "Educating our youth about the devastation drugs cause needs to be a top priority for law enforcement. The D.A.R.E. program has been an important tool used to accomplish that goal and I am proud of this office's involvement in that program."
The Statewide D.A.R.E Program was created by the legislature in1999. The program has two staff members, whose duties include assisting and providing resources to D.A.R.E. officers across the state, making school visits, and coordinating the training required before officers can teach the lessons. D.A.R.E. was established in 1983 and continues to be an active partnership between parents, schools, and law enforcement. The program has grown to be the most popular and widely used prevention curriculum in the world.
Kansas has 257 D.A.R.E. officers representing 122 law enforcement agencies in 58 counties. In 2001, more than 130,000 Kansas students in 394 schools from 161 districts received the D.A.R.E. program.
