Making a Federal Case Of Identity Theft by Jonathan J. Rusch Note: This is an expanded version of an article scheduled for publication in the Fall 2001 issue of the Federal Trade Commission publication Fraudbusters
Cases such as these, which resulted in the identity thieves being sent to prison, are precisely the types of cases for which the federal identity theft offense was designed. Section 1028(a)(7), which was enacted as part of the Identity Theft and Assumption Deterrence Act of 1998, prohibits anyone from knowingly transferring or using, without lawful authority, someone else’s "means of identification" with the intent to commit, aid, or abet any unlawful activity that constitutes a violation of federal law or that constitutes a felony under state or local law. [18 U.S.C. § 1028(a)(7)] Under this section, a "means of identification" includes a wide range of identifying information: a person’s name, date of birth, Social Security number, driver’s license number, passport number, bank account number, and credit-card data, to cite just some examples. Even biometric data – digitized data uniquely linked to physical characteristics such as fingerprints, voiceprints, and retinal images – can be a "means of identification" covered by the Act. The Department has actively fostered closer interagency cooperation on identity theft in three significant ways. First, federal prosecutors in a number of states are making use of multiagency task forces and working groups that can share resources to investigate identity theft and related white-collar crimes.

ON2'S MPEG-4 POSITION PAPER In 1997, the Department of Justice approved a proposal by a group of nine companies and one university to create a one-stop-shop clearinghouse through the pooling of patents owned by this group. These patents were needed by entities looking to manufacture electronic equipment that stores or transmits compressed video data. This video compression technology is known as MPEG-2 and the jointly owned licensing agent for the MPEG-2 patent holders is named MPEG LA. Operating under the auspices of the MPEG-2 Approval, since 1997 MPEG-2 has obtained at least a 95% market share in the digital television video compression market. Fast forward to 2002, and a new group of companies (consisting of many of the MPEG-2 patent holders as well as some new patent holders) is attempting to pool patents for a new video compression technology called MPEG-4 . This group of companies is using the same licensing agent (MPEG LA) as the MPEG-2 group. MPEG-4 is aiming to be the international standard for interactive video compression in three fields: digital television, interactive graphics applications, and interactive multimedia, i.e. the World Wide Web. For MPEG-4 to become such a standard, MPEG LA will need approval by the Department of Justice of its new patent pool. There are two critical questions: (1) Does the 1997 MPEG-2 patent pool approval currently cover the new MPEG-4 patent pool? and (2) Should the 1997 MPEG-2 Approval cover the MPEG-4 Patent Pool?

(CBS) There are credible complaints that Arab and Muslim immigrants were beaten in federal detention, says an internal Justice Department report obtained by a newspaper.
Over the six-month period that ended in June, the Justice Department's inspector general found 34 complaints of rights violations that appeared credible, reports The New York Times. Some of the charges have yet to be fully investigated. Not all the complaints concerned physical abuse.
The report has been provided to Congress and will soon be publicly released. The complaints concern the way the Justice Department has enforced the 2001 Patriot Act, a law passed in the immediate aftermath of the Sept. 11 attacks that granted wider powers to federal law enforcement officers to conduct surveillance and detain immigrants. It follows another report by the inspector general that found "significant problems" in the Bush administration's actions toward 762 foreigners held on immigration violations after Sept. 11. The FBI took too long to determine whether they were involved with terrorism, as dozens endured "lock-down" conditions 23 hours each day and slept under bright lights, the report found.

Reno says goodbye and thanks to Justice Department

Attorney General Eric Holder, at podium, and FBI Director Louis Freeh WASHINGTON (CNN) U.S. Attorney General Janet Reno said goodbye to her Justice Department staff in a ceremony at the department Thursday and thanked them for their commitment to civil service. "I love the law, I love good and caring lawyers, but never have I loved people as much as I do you for what you do for this country," Reno said. She said serving the government and suffering "the slings and arrows of a free press" and the political process takes courage, but she urged them not to quit. "Yes, I've been cussed at, fussed at and figuratively beaten around the ears, but after eight years in this job, after seeing America, I know two things... I have never believed so strongly in this nation's future, in the righteousness of its ways as I do and I have never believed so strongly that we must continue to fight so that the law issues from all of the people and not just some," Reno said.

What Is Internet Fraud?
The term "Internet fraud" refers generally to any type of fraud scheme that uses one or more components of the Internet - such as chat rooms, e-mail, message boards, or Web sites - to present fraudulent solicitations to prospective victims, to conduct fraudulent transactions, or to transmit the proceeds of fraud to financial institutions or to other connected with the scheme. If you use the Internet with any frequency, you'll soon see that people and things online tend to move, as the saying goes, on "Internet time." For most people, that phrase simply means that things seem to happen more quickly on the Internet business decisions, information-searching, personal interactions, to name a few - and to happen before, during, or after ordinary "bricks-and-mortar" business hours. Unfortunately, people who engage in fraud often operate in "Internet time" as well. They seek to take advantage of the Internet's unique capabilities for example, by sending e-mail messages worldwide in seconds, or posting Web site information that is readily accessible from anywhere in the world - to carry out various types of fraudulent schemes more quickly than was possible with many fraud schemes in the past.
