Like all federal agencies, the Department of Justice (DOJ) generally is required under the Freedom of Information Act (FOIA) to disclose records requested in writing by any person. However, agencies may withhold information pursuant to nine exemptions and three exclusions contained in the statute. The FOIA applies only to federal agencies and does not create a right of access to records held by Congress, the courts, or by state or local government agencies. Each state has its own public access laws that should be consulted for access to state and local records.

      What Are Identity Theft and Identity Fraud?

The short answer is that identity theft is a crime. Identity theft and identity fraud are terms used to refer to all types of crime in which someone wrongfully obtains and uses another person's personal data in some way that involves fraud or deception, typically for economic gain. These Web pages are intended to explain why you need to take precautions to protect yourself from identity theft. In one notorious case of identity theft, the criminal, a convicted felon, not only incurred more than $100,000 of credit card debt, obtained a federal home loan, and bought homes, motorcycles, and handguns in the victim's name, but called his victim to taunt him saying that he could continue to pose as the victim for as long as he wanted because identity theft was not a federal crime at that time before filing for bankruptcy, also in the victim's name. While the victim and his wife spent more than four years and more than $15,000 of their own money to restore their credit and reputation, the criminal served a brief sentence for making a false statement to procure a firearm, but made no restitution to his victim for any of the harm he had caused. This case, and others like it, prompted Congress in 1998 to create a new federal offense of

II. Elderly Victims Background Tips for Responding to Elderly Victims
  • Be attentive to whether victims are tired or not feeling well.
    Allow victims to collect their thoughts before your interview.
    Ask victims if they are having any difficulty understanding you. Be sensitive to the possibility that they may have difficulty hearing or seeing, but do not assume such impairments. Ask victims if they have any special needs, such as eyeglasses or hearing aids.
    Ask victims whether they would like you to contact a family member or friend.
    Be alert for signs of domestic violence or neglect, since studies indicate that 10 percent of the elderly are abused by their relatives.
    Give victims time to hear and understand your words during the interview.
    Ask questions one at a time, waiting for a response before proceeding to the next question. Avoid interrupting victims.
    Repeat key words and phrases. Ask open-ended questions to ensure you are being understood.
    Avoid unnecessary pressure. Be patient. Give victims frequent breaks during your interview.

As on 17.116.1996, the total sanctioned strength of Judges and Additional Judges of the various High Courts was 568. In addition, it has been agreed to create the posts of 09 permanent Judges and 38 Additional Judges in different High Courts. During 1.12.1995 to 17.12.1996, 93 fresh appointments of Judges/Additional Judges were made and, in addition 17 Additional Judges were appointed as permanent Judges. FAMILY COURT After the enactment of the Family Courts Act, 1984, 61 Family Courts have been set up so far: Uttar Pradesh-16, Rajasthan-5, Maharashtra -13, Orissa-2, Karnataka-4, Tamil Nadu-5, Kerala-5, Bihar-2, Assam-1, Manipur-1, Andhra Pradesh-6, and Pondicherry-1. After the approval of the Cabinet, orders have already been issued for creation of 15 posts of judges and 202 posts of supporting staff for the setting up of Family Courts in the NCT of Delhi. The NCT of Delhi has also been requested to take urgent steps for setting up the 15 Family Courts in the NCT of Delhi.
